Background Screening Requirements. DB agrees that before any of its employees, agents or sub-consultants will be permitted on school grounds while students are present, such employees, agents or sub-consultants will be fingerprinted and have their backgrounds checked as provided by Florida law. DB’s employees, agents and sub-consultants will coordinate with the Owner to arrange a mutually convenient time for the Owner to conduct the fingerprinting. DB agrees to bear the cost of the fingerprinting/background checks. The Owner has the right to refuse entry onto any school grounds to any individual whose background check does not meet the requirements established by the Owner pursuant to Florida law.

Background Screening Requirements. The minimum background check process shall include: 3.3.1. A check of the following through a law enforcement agency or a Professional Background Screener accredited by the National Association of Professional Background Screeners or a comparable standard: 3.3.1.1. Social Security Number Trace; and 3.3.1.2. Criminal Records (Federal, State and County criminal felony and misdemeanor, national criminal database for all states which make such data available). 3.3.2. Before allowing Access, if it is determined that a Contingent Worker or Vendor Staff has a criminal “Conviction” (misdemeanor or felony) regardless of adjudication (adjudication withheld, a plea of guilty or nolo contendere, or a guilty verdict) within the last ten (10) years from the date of the court’s determination for the crimes listed below, or their equivalent in any jurisdiction, the Vendor is required to not allow that individual Direct or Indirect Access until the requirements of section 3.3.3 have been met. The Potentially Disqualifying Offenses are crimes (in any jurisdiction within and/ or outside of the United States of America) where the nature of the criminal activity is such that a reasonable Vendor would agree that the Contingent Worker’s employment would create a risk of injury, loss, or damage to people and/or property of Citizens. Examples of these types of Potentially Disqualifying Offenses or crimes include, but may not be limited to, the following: 3.3.2.1. All Felony Convictions; 3.3.2.2. Burglary/Robbery; 3.3.2.3. Aggravated assault; 3.3.2.4. Sexual Battery; 3.3.2.5. Kidnapping/False imprisonment;
Background Screening Requirements. In accordance with the requirements of §1012.465, §1012.32 and §1012.467, F.S., and DCPS Board Policies as amended from time to time Contractor agrees that Contractor and all of its employees who provide or may provide services under this Agreement will complete criminal history checks, and all background screening requirements, including level 2 screening requirements as outlined in the above-referenced statutes and DCPS Board Policies prior to providing services to DCPS at Contractor’s expense. Additionally, Contractor agrees that each that of its employees, representatives, agents, subcontractors or suppliers who are permitted access on school grounds when students are present, who have direct contact with students or who have access to or control of school funds must meet level 2 screening requirements as described in the above- referenced statutes, and DCPS Board Policies. A non-instructional contractor who is exempt from the screening requirements set forth in §1012.465, §1012.468 or §1012.467, F.S., is subject to a search of his or her name or other identifying information against the registration information regarding sexual predators and sexual offenders maintained by the Department of Law Enforcement under §943.043 and the national sex offender public registry maintained by the United States Department of Justice. Contractor will not be charged for this search. Further, upon obtaining clearance by DCPS, if DCPS deems necessary, DCPS will issue a photo identification badge which shall be worn by the individual at all times while on DCPS property when students are present. Contractor agrees to bear any and all costs associated with acquiring the required background screening including any costs associated with fingerprinting and obtaining the required photo identification badge. Contractor agrees to require all its affected employees to sign a statement, as a condition of employment with Contractor in relation to performance under this Agreement, agreeing that the employee will abide by the heretofore described background screening requirements, and also agreeing that the employee will notify the Contractor/Employer of any arrest(s) or conviction(s) of any offense enumerated in DCPS Policies within 48 hours of its occurrence. All Contractor staff, representatives, agents, sub-contractors or suppliers onsite at each school location must have been issued, and must wear, the contractor badge evidencing the satisfactory completion of the required Level 2 screening at all times. The Vendor shall consider the following factors in making the determination: a.) nature and gravity of the offense, b.) the amount of time that lapsed since the offense, c.) the rehabilitation efforts of the Vendor Staff, and d.) relevancy of the offense to the Vendor Staff’s Access. Background Screening Requirements. In the event that a contractor who is hired by Faneuil has been identified through random or scheduled audit as not meeting the background screening requirements defined in this section, Faneuil agrees to pay or reimburse Xxxxxxx Xxxxxx all management fees paid for the individual Contractor.
