Grievance Step 1. If the grievance is not settled as provided for in Article 8.02 above, it shall be set forth in writing on a grievance form provided by XxxXxxX, signed by the Grievor and a Union Xxxxxxx and given to the supervisor. The written grievance shall be submitted no later than ten (10) working days following receipt of the supervisor's reply provided for in Article 8.02 above, and shall contain details of the grievance, the specific provision(s) or interpretation of the Agreement that has been allegedly violated and the relief sought. A Step 1 meeting shall be scheduled and held within ten (10) working days of the filing of the Step 1 grievance unless the Parties agree otherwise. Grievance Step 1. The employee is required to file a written grievance with their supervisor and the Director, Human Resources. A grievance must contain a complete and full statement of the difference pursuant to a specific clause of this Agreement and must state the particular relief requested on behalf of the grievor. Grievances shall be submitted on a form satisfactory to the Union and the Employer. Grievances not submitted within five (5) work days of the action giving rise to the grievance or five (5) work days from the time that the action should reasonably have been known to the grievor shall not be considered. By mutual agreement between the Employer and the Union, a grievance regarding the suspension or dismissal of an employee may commence at Step 2 of the grievance procedure. At the request of either party, a meeting shall be held at this Step. If a meeting is held, each party may have in attendance those persons (not to exceed two (2) in number) whom it feels will assist in resolving the difference. However, the Parties will inform each other no later than two (2) work days prior to the meeting whom they plan on having in attendance. If a meeting is requested at this step, it shall be held within five (5) work days of receipt of the written request for a meeting. The supervisor shall provide a written response to the grievor within ten (10) work days of receipt of the written grievance or within ten (10) work days of the meeting if one is held.
Grievance Step 1. If a mutually satisfactory resolution of the problem is not reached in the problem-solving meetings or if such meeting has been waived, a grievance shall be put in writing and formally presented to the manager within twenty-eight (28) calendar days after the date the employee first had knowledge of the circumstance that led to the grievance. The written grievance shall state the nature of the grievance and the specific portion of the Agreement allegedly violated. It shall be a mutual responsibility to meet to consider the grievance within fourteen (14) calendar days after it is presented. The Company will provide the union with a written response to the grievance within fourteen (14) calendar days after the Step 1 meeting. GRIEVANCE STEP 2

With the exception of a grievance that may be submitted directly at Step 2 as provided for in this Agreement, no grievance shall be deemed to exist unless there has been a meeting as provided for in Article 8.02 above, at which both a Union Xxxxxxx and a manager is present. If the complaint is not resolved at this meeting it shall be set forth in writing on a grievance form provided by the Union, signed by the Grievor and a Union Xxxxxxx and given to the manager. The written grievance shall be submitted no later than ten (10) working days following receipt of the manager’s or the designate’s reply provided for in Article 8.02 above, and shall contain details of the grievance, the specific provision(s) or interpretation of the Agreement that has been allegedly violated and the relief sought. A Step 1 meeting shall be scheduled and normally held within ten (10) working days of the filing of the Step 1 grievance. The meeting shall include the Employee, a Union Xxxxxxx, and the Employee’s manager and another manager. The manager shall give a written Step 1 reply to the Union, with a copy to the Employee, no later than ten (10) working days following the Step 1 meeting.

The appropriate Manager (normally the supervisor’s manager) and the Union must, within seven (7) calendar days after the presentation of the grievance form to the appropriate Manager, establish a date to meet to discuss the grievance. The Company will furnish a written response to the Union within ten (10) calendar days after this Step 1

A. Any resolution reached through Step 1 of the grievance procedure shall be binding only for the particular grievance and shall not be considered precedent setting. Such settlements shall not be utilized in any legal or arbitration proceeding except in connection with a claim that the settlement has been violated.
Grievance Step 1. Grievances of the Employer or the Union, arising out of interpretation or enforcement of this Agreement, shall be settled between the Employer directly involved and the duly authorized representative of the Union, if possible. Grievance Step 1. 1. Not later than five (5) days after a grievance is filed, the supervisor will notify the grievant and the OAPSE representative of the date, time and location of the meeting in Step 1.
2. The date of the Step 1 meeting shall be not later than ten (10) days after the date of notification.
3. At the Step 1 meeting, there shall be present:
a. The supervisor of the grievant; and
b. The grievant; and
c. An OAPSE representative, if the individual so requests.
4. Not later than five (5) days after the conclusion of the Step 1 meeting, the supervisor shall submit his disposition in writing to the grievant.
5. A copy of the disposition shall be given to the OAPSE representative and to the Assistant Superintendent of Human Resources and Operations.

Grievance Step 1. If after the Complaint Step the matter is unresolved, the grievant may submit the written grievance to her/his immediate supervisor within five (5) business days from the meeting date at the Complaint Step. Within five (5) business days of the receipt of the grievance, the immediate supervisor shall render a written decision to the grievant and send a copy to the Association’s grievance chairperson.
