Grievance Step 2. If the grievance is not settled at Step 1 it shall be submitted in writing to the Employee Relations Representative designated by the AVP Department of Human Resources and Employee Relations no later than five (5) working days following receipt of the Step 1 reply. This grievance shall be signed by the Employee and the YusApuY President or designated representative. The Employee Relations Representative and the appropriate management representatives shall meet to discuss the grievance with the Grievor, a Union Officer and other appropriate Union representatives. The Step 2 meeting shall be held within thirty (30) working days of the filing of the Step 2 grievance unless the Parties agree otherwise. The Employer's written Step 2 reply shall be given no later than five (5) working days following the Step 2 meeting.
Grievance Step 2. If the grievance is not settled at Step 1 or if Step 1 has been omitted, the following procedure shall be followed.
1. The employee may, not later than ten (10) days after receipt of the written disposition of Step 1, submit to the Assistant Superintendent - Human Resources and Operations a written request for a meeting at Step 2 for the purpose of settling the grievance.
2. Not later than five (5) days after receipt of such a request the employee and the Union representative shall be notified of the time and location of the Step 2 meeting.
3. The date of the Step 2 meeting shall be not later than ten (10) days after the date of notification.
4. The meeting at Step 2 shall be before the Superintendent and/or such member of the Superintendent’s staff as he/she shall designate.
5. The grievant shall be present and a Union representative shall be present if the employee so requests.
6. Not later than five (5) days after the conclusion of the hearing at Step 2 the Superintendent or his/her designee shall submit a disposition in writing to the grievant. A copy shall be sent to the Union representative and to the Human Resources Department.
Grievance Step 2. In the event that satisfaction still cannot be obtained, the employee shall within ten (10) work days of receiving the decision, forward the grievance to the most senior manager, or designate, within the division. At the request of either party, a meeting shall be held at this Step. If a meeting is held, the manager or their nominee may be accompanied by a representative from Human Resources. The employee may choose to be accompanied by a union representative. If a meeting is requested at this step, it shall be held within five (5) work days of receipt of the written request for a meeting. The decision must be communicated in writing to the employee within seven (7) work days of the date that the senior manager received the grievance, or within seven (7) work days of the meeting if one is held.
Grievance Step 2. If the grievance is not settled at Step 1, the Union may, within seven (7) calendar days after receipt of the Company's written Step 1 Grievance response, submit a written request to the Human Resources Representative for a Step 2
Grievance Step 2. Upon receipt of the written grievance, the Assistant General Manager or their designee will within seven (7) working days, schedule a meeting with the appropriate parties, including the Chief Xxxxxxx, Shop Xxxxxxx, grievant (s) and AOM (if necessary). A verbal agreement will be reached between the parties at to the date of the meeting. Following the second step meeting, the Assistant General Manager (AGM) or their designee will provide a written second step answer to the Shop Xxxxxxx within seven (7) working days. The Shop Xxxxxxx will either accept the answer, and the grievance will be considered resolved, or the Shop Xxxxxxx will reject the answer and process the grievance to step 3 of the grievance procedure, and will provide response within seven (7) working days of the resolution response.
i. In order to resolve grievances at the lowest possible step, both Company and bargaining unit witnesses may be present during the course of the second step meeting so that a thorough investigation of the facts can be known to both the Company and the Union.
Grievance Step 2. If satisfactory settlement of the grievance is not reached or the Company fails to respond within the required times at Step 1, the union may appeal. The appeal will be sent to the appropriate Director. The grievance will be considered at a meeting with the appropriate Director or their designated representative. This appeal must be made in writing within fourteen (14) calendar days after receipt of the Company's written response at Step 1. It shall be a mutual responsibility to meet within fourteen (14) calendar days after it has been appealed to Step 2. A written response will be provided by the Company within fourteen (14) calendar days after the Step 2 meeting.
Grievance Step 2. If a satisfactory resolution is not reached in Step #1, a meeting will be scheduled with the Chief Xxxxxxx, Area Xxxxxxx, Associate, and AGM. The meeting will be held within one work week of receipt of the written grievance. Management will give their written answer to the grievance, within one work week applicable to the shift, to the Chief Xxxxxxx.
Grievance Step 2. In the event that satisfaction still cannot be obtained, the employee shall within ten (10) work days of receiving the decision, forward the grievance to the most senior manager, or designate, within the division. Grievance Step 2. If Step 1 does not resolve the issue, the grievant may submit the written grievance to the Vice President of Academic Affairs within ten (10) business days after the answer in Step 1. Within ten (10) business days of the receipt of the grievance, the Vice President of Academic Affairs shall render a written decision to the grievant and send a copy to the Association’s grievance chairperson. Grievance Step 3 – If Step 2 does not resolve the issue, the grievant may submit the written grievance to the President or designee within ten (10) business days after the answer in Step 2. Within ten (10) business days of the receipt of the grievance, the President or designee shall render a written decision to the grievant and send a copy to the Association’s grievance chairperson. Grievance Step 4 – If Step 3 does not resolve the issue, the grievant and the Association shall notify the President or designee within ten (10) business days after the answer in Step 3 that the grievance will be submitted to arbitration. The Association shall request a list of arbitrators from the Public Employment Relations Board within ten (10) business days of notice to the President as provided in the preceding paragraph. The arbitrator shall have no authority to amend, modify, nullify, or add to the provisions of this agreement. The arbitrator’s decision will be final and binding upon both parties, unless he/she has exceeded the authority as listed above. The entire cost of the arbitrator’s service shall be borne equally by the parties. Other expenses shall be paid by the party incurring same.
