The Innovative Work Schedule clause establishes alternative or flexible working hours or arrangements for employees, differing from traditional fixed schedules. This may include options such as compressed workweeks, flexible start and end times, or remote work arrangements, depending on the needs of the business and its staff. By formalizing these non-standard schedules, the clause helps accommodate diverse employee needs, improve work-life balance, and enhance productivity, while ensuring that both employer and employee expectations are clearly defined and managed.
Innovative Work Schedule. Where mutually agreeable to the Employer and the nurse concerned, a normal workday may consist of ten (10) hours when the workweek schedule is based on four (4) ten (10) hour days. Where mutually agreeable to the Employer and the nurse concerned, a normal workday may consist of twelve (12) hours. The starting and ending time for ten (10) hour and twelve (12) hour shifts shall be mutually agreeable between the nurse and the nurse’s manager/supervisor. Innovative work schedules that deviate from the normal work week or normal work day that are implemented for a nursing unit or on a Hospital-wide basis shall be mutually agreeable to the Employer and the nurse involved, and the Association shall be given notice and an opportunity to bargain about the work schedule. Copies of all innovative schedules shall be attached to this Agreement. Education days, EIB days and PTO days will be paid (not earned or accrued) in either eight (8) hour increments or in increments equal to the nurse’s innovative work shift at the nurse’s option to be exercised by the nurse no more frequently than once per calendar year. Education hours paid pursuant to Section 12.6, Education Time, shall be for the amount of scheduled work hours a nurse has actually missed due to attending and traveling to and from an education program. If a nurse is not scheduled to work, education hours paid pursuant to Section 12.6 of this Agreement shall be for the actual hours attending and traveling to and from an education program, not to exceed eight (8) hours or the length of the nurse’s innovative schedule, as chosen by the nurse in accordance with the provision above in this section.

(a) For an employee working under an innovative work schedule, Paid Time Off (PTO) and Extended Illness Bank (EIB) hours will be paid (not earned or accrued) for the length of the normal scheduled work day, and education days will be paid in increments equal to the hours of the educational class (however, with the Employer’s approval, the nurse may take education hours up to the length of the normal scheduled work day). (b) A nurse who is working on an innovative work schedule, who wishes to discontinue that schedule, may apply for other open positions. Additionally, an innovative work schedule shall be considered reinstated automatically following any period of paid or unpaid leave, or recall from layoff. (c) Innovative shifts may be terminated by either party, without cause, upon thirty (30) days’ written notice. If the Hospital determines the need to eliminate innovative schedules on a unit wide basis, the Hospital will contact the Local Unit Chairperson and Association thirty (30) days prior to the event and discuss the timing and procedures before taking any action.

Education days, sick leave, and annual leave will be paid (not earned or accrued) in either eight (8) hour increments or in increments equal to the nurse’s innovative work shift, at the nurse’s option, to be exercised by the nurse no more frequently than once per calendar year. A nurse working an innovative work schedule who wishes to discontinue working such schedule may apply for other open positions. A ten or twelve-hour shift agreement shall be considered reinstated automatically following any period of paid or unpaid leave, or recall from layoff.‌
