Nondiscrimination/Affirmative Action. Section 1. The University and the Union agree that neither will discriminate against any employee by reason of race, color, creed, religion, age, sex (except where age or sex is a bona fide occupational qualification), marital status, sexual orientation, political affiliation, national or ethnic origin; membership in a Union; disabled or Vietnam era veteran; or the presence of any sensory, mental or physical disabilities unless based on a bona fide occupational qualification reasonably necessary to the normal operation of the University.
Nondiscrimination/Affirmative Action. A. The District shall ensure that all applicants and employees are considered only on the basis of job-related qualifications. The District shall elect employees as needed on the basis of merit, training and experience, and there shall be no illegal discrimination against any employee or applicant because of race, creed, color, sexual orientation, including gender expression or identity, national origin, marital status, religion, sex, age or the presence of sensory, mental or physical disability or the use of a trained dog guide or service animal by a person with a disability. In accordance with the Kent School District Affirmative Action Plan, the District retains the right to choose the better-qualified applicant based upon bona fide occupational qualifications.
B. In implementing this Agreement the District shall recruit, employ and assign personnel in conformity with state and federal rules, laws, regulations and directives and in accordance with the Affirmative Action Plan of the Kent School District.
Nondiscrimination/Affirmative Action. In connection with the performance of work under this contract, the contractor agrees not to discriminate against any employee or applicant for employment because of age, race, religion, color, handicap, sex, physical condition, developmental disability as defined in s. 51.01(5), Wis. Stats., sexual orientation as defined in s. 111.32(13m), Wis. Stats., or national origin. This provision shall include, but not be limited to, the following: employment, upgrading, demotion or transfer; recruitment or recruitment advertising; layoff or termination; rates of pay or other forms of compensation; and selection for training, including apprenticeship. Except with respect to sexual orientation, the contractor further agrees to take affirmative action to ensure equal employment opportunities.
19.1 Contracts estimated to be over fifty thousand dollars ($50,000) require the submission of a written affirmative action plan by the contractor. An exemption occurs from this requirement if the contractor has a workforce of less than fifty (50) employees. Within fifteen (15) working days after the contract is awarded, the contractor must submit the plan to the contracting state agency for approval. Instructions on preparing the plan and technical assistance regarding this clause are available from the contracting state agency.
19.2 The contractor agrees to post in conspicuous places, available for employees and applicants for employment, a notice to be provided by the contracting state agency that sets forth the provisions of the State of Wisconsin's nondiscrimination law.
19.3 Failure to comply with the conditions of this clause may result in the contractor's becoming declared an "ineligible" contractor, termination of the contract, or withholding of payment.

Nondiscrimination/Affirmative Action. If applicable, FireGiant and its subcontractors (if relevant) shall abide by the requirements of 41 CFR §§ 60-1.4(a), 60-300.5(a) and 60-741.5(a). These regulations prohibit discrimination against qualified individuals based on their status as protected veterans or individuals with disabilities, and prohibit discrimination against all individuals based on their race, color, religion, sex, or national origin. Moreover, these regulations require that covered prime contractors and subcontractors take affirmative action to employ and advance in employment individuals without regard to race, color, religion, sex, national origin, protected veteran status or disability.

Nondiscrimination – General- Lessee for itself, and as a requirement for any sublessee, their personal representatives, successors in interest, and assigns, as a part of the consideration hereof covenants that: (1) no person on the grounds of race, creed, color, religion, sex, age, national origin, sexual orientation, marital status, disability, or political belief or affiliation will be excluded from participation in, denied the benefits of or otherwise be subjected to discrimination in the use of the Premises; (2) in the construction of any improvements on, over, or under the Premises and the furnishing of services thereon, no person on the grounds of race, color, religion, sex, age, national origin, sexual orientation, marital status, disability, or political belief or affiliation will be excluded from participation in, denied the benefits of, or otherwise be subject to discrimination.
B. Nondiscrimination - Business Owner - This Lease is subject to the requirements of the U.S. Department of Transportation's regulations, 49 CFR Part 23. Lessee for itself, and as a requirement for any sublessee, agrees that it will not discriminate against any business owner because of the owner's race, color, national origin, or sex in connection with the award of performance or any concession agreement, management contract or subcontract, purchase or lease agreement, or other agreement covered by 49 CFR Part 23.

Within fifteen (15) working days after the Agreement is awarded, the Contractor shall submit the plan to the Wisconsin Department of Administration for approval. Instructions on preparing the plan and technical assistance regarding this clause are available from the Department. The Contractor shall post in conspicuous places, available for employees and applicants for employment, a notice to be provided by the Department that sets forth the provisions of the State of Wisconsin's nondiscrimination law. Agent hereby agrees that Agent will not discriminate against any employee or applicant for employment because of race, color, religion, sex, national origin, age disability, or veteran status. As a government contractor we are incorporating the following regulations into this Agreement, as applicable: 41 C.F.R. §§ 60-1.4, 60-300.5, 60-741.5 and 48 C.F.R. §§ 52.222-26, 52.222-35–52.222-37, 52.222-40, 52.222-54. The following language is also incorporated, as applicable: This contractor and subcontractor shall abide by the requirements of 41 CFR 60-300.5(a) and 41 CFR 60- 741.5(a). Nondiscrimination/Affirmative Action. The Concessionaire for itself, its personal representatives, successors in interest and assigns as a part of the consideration hereof does, hereby covenant and agree that:
a) No person shall be excluded on the grounds of race, color, sex, or national origin from participation in, denied the benefits of, or otherwise be subjected to discrimination in the use of the Premises;
b) In the construction of any improvements on, over, or under the Premises and the furnishing of services thereon, no person shall be excluded on the grounds of race, color, sex, or national origin from participation in, denied the benefits of, or otherwise be subjected to discrimination; and
c) The Concessionaire shall use the Premises in compliance with all other requirements imposed by or pursuant to Title 49, Code of Federal Regulations, Department of Transportation, Subtitle A, Office of the Secretary, Part 21, Nondiscrimination in Federally-assisted Programs of the Department of Transportation – Effectuation of Title VI of the Civil Rights Act of 1964, as may be amended from time-to-time. In the event of a breach of any of the above non-discrimination covenants, the Authority shall have the right to immediately, and without notice, reenter the Premises, and the Premises, including all improvements thereto, shall thereupon revert to and vest in and become the absolute property of the Authority and its assigns. This provision shall not be effective until the applicable procedures of Title 49, Code of Federal Regulations, Part 21 are followed and completed, including exercise of expirations of appeal rights. The Concessionaire assures that it shall undertake an affirmative action program as required by 14 CFR Part 152, Subpart E, to insure that no person shall be excluded on the grounds of race, creed, color, national origin, or sex from participating in any employment activities covered in 14 CFR Part 152, Subpart E. Further, the Concessionaire assures that no person shall be excluded on these grounds from participating in or receiving the services or benefits of any program or activity covered by that Subpart.
