Notice of Shift Schedules. Schedules of shift work for regular employees and auxiliary employees working a scheduled shift shall be posted at least five (5) days in advance of the starting day of a new schedule. However, the Employer will make every effort to post shift schedules fourteen (14) days in advance and employees involved will be consulted prior to any change in the shift schedule in order to determine their availability. In the event that employees' schedules of shift work and/or hours of work are changed without the five (5) days' advance notice required, they will receive a premium of fifty cents (50¢) per hour for work performed on the first new schedule shifts to which they changed in addition to their regular pay. Subsequent shifts worked on the new schedules shall be without this premium.

However, the Employer will make every effort to post shift schedules fourteen (14) days in advance, and employees involved will be consulted prior to any change in the shift schedule in order to determine their availability. In the event that an employee's schedule of shift work and/or hours of work are changed without the forty-eight (48) hours advance notice required, the employee will receive the second shift premium pursuant to 14.02 for work performed on the first new scheduled shift to which they changed in addition to their regular pay. Subsequent shifts worked on the new schedules shall be without this premium.

(c) In the event that an employee's schedules of shift work are changed without 48 hours' advance notice, the employee may choose to decline the shift scheduled.

(a) In the event that the shift for a regular team member or temporary team member working a scheduled shift roster is changed without 48 hours advance notice and if such change is the result of the actions of another team member covered by this agreement utilizing the benefits provided for by the provisions of this agreement, the team member will receive a premium of $2.50 per hour effective September 1, 2015.
(b) In the event that a team member shift is changed without five days advance notice and the change results from causes other than defined in Clause 15.3 (a), the team member shall receive pay at the applicable overtime rate for work performed on the first shift to which they changed except that if the change results from no fault of the Company they shall not receive pay at overtime rates but shall receive the premium defined under Clause 15.3 (a).

Subsequent shifts worked on the new schedules shall be without this premium.

(b) In the event that an employee's shift is changed without five (5) days advance notice and the change results from causes other than defined in Article 9.3(a), the employee shall receive pay at the applicable overtime rate for work performed on the first (1st) shift to which he/she changed except that if the change results from no fault of the Employer he/she shall not receive pay at overtime rates but shall receive the premium defined under Article 9.3(a).
(c) Where the hours of operation require employees to be scheduled for work outside the standard hours listed in Article 8.1, shift schedules shall be established by mutual agreement at the local level. The shift patterns shall be either five (5) days on and two (2) days off or four (4) days on and two (2) days off unless otherwise agreed to by the Parties to this Agreement. Once the shift pattern and the length of the meal period have been agreed to, the length of the work day will be required to meet the annual hours outlined in Article 8 of this Agreement.

Subsequent shifts worked on the new schedules shall be without this premium.
