Operating Area. Rider agrees not to use, operate, and/or ride the Vehicle in any no-ride zone and further agrees not to transport the Vehicle outside of permitted service areas.
Operating Area. COUNTY grants to CONTRACTOR the right to use that certain property hereinafter referred to as “Operating Area”, shown as the T-Lot and Employee Shuttle Service Route on Attachment D – Maps, which attachment is attached hereto and by reference made a part hereof. COUNTY shall have the right to close, reassign, relocate, expand and reduce any portion of the Operating Area shown on Attachment D - Maps during the term of this CONTRACT by providing CONTRACTOR with 30 days’ prior written notice, unless an emergency exists, in which case COUNTY shall provide verbal or written notice as soon as practicable. COUNTY shall make available alternative space that is reasonably comparable for CONTRACTOR’S operation. CONTRACTOR shall not make any modifications, including but not limited to, the expansion or reduction of the Operating Area without prior written approval from COUNTY Project Coordinator. CONTRACTOR shall not install equipment of any kind outside the Operating Area unless authorized in writing by COUNTY Project Coordinator prior to installation. COUNTY may alter, repair, maintain, remodel, expand, remove or improve any of the facilities at the Airport or any of its appurtenances, including but not limited to, CONTRACTOR’S Operating Area. CONTRACTOR acknowledges and agrees: a. That COUNTY is granting to CONTRACTOR the right to use the Operating Area only. b. That COUNTY retains a fee ownership for federal income tax purposes in and to the Operating Area, as well as all other ownership burdens and benefits connected with such fee ownership. c. That CONTRACTOR has not been granted any direct or indirect right or option to purchase the Operating Area from COUNTY at any time during or after the termination of this CONTRACT.

Operating Area. The Operating Area is designated as the Xxxxxx District, Xxxxx County, West Virginia and shall include the xxxxx, the surface and subsurface equipment associated with the gas xxxxx, the gas gathering system, the gas pipelines from the xxxxx to the master sales meters and the well access roads, hereinafter simply as the “xxxxx”. Operating Area. Operating Area is where forest development and other activities will continue. (See map X attached for proposed Operating Areas) For the Southern portion of the plan area the following will apply: • The forest industry recognizes that the South Forum Plan Area includes a number of visually sensitive areas that are very important to Recreation and Tourism interests. • Much of the same area is also highly productive forest land of significant value to the forest industry and reductions in the available land base will have significant AAC implications. • Generally, the industry believes that both visual quality and timber harvesting interests can be addressed most effectively through: 1) attaching a range of priority to visual important areas at a strategic level 2) engaging in a collaborative and professionally focused/managed discussion to develop visual quality objectives at a more detailed scale 3) proceeding carefully, in a manner that recognizes forest development will continue, while learning from the lessons learned in the field. 1. The Xxxxxxxxx Protection Area would preclude industrial logging and mining but would be subject to the development of a management strategy developed in collaboration with First Nations, adjacent communities and rec/tourism interests. 2. SMZ1 consists of the area that is adjacent to and surrounds the Protection Area and another is centered on upper knight Inlet near the Ahnuhati Inlet. SMZ1 would be managed to provide a landscape surrounding the Protection Area that is consistent with the expectations of water-based rec/tourism users and would also provide for very carefully planned and executed forest harvesting. SMZ1 land would include preservation, retention and partial retention VQOs. Visual Quality Objectives (VQOs) for SMZ1 will be determined through the process described below. Effort will be made to ensure forest harvesting operations in SMZ1 are scheduled to avoid conflict with high-season rec./tourism use of the area. 3. SMZ2 consists of two polygons, one surrounding SMZ1 and another centred on Xxxxxxxx and Xxxxxxx Islands. SMZ2 will be managed to provide for both high levels of recreation and continued forest harvesting. SMZ2 lands would include primarily partial retention and retention VQOs although preservation and modification VQOs may be appropriate in some settings. The following table includes all Federal and state permits held by persons participating in the sector, and indicates whether each permit is enrolled and will actively fish in a sector, or will be subject to the provisions of the common pool.

Exemption request: DSM when ASM is present The Northeast Coastal Communities Sector requests an exemption from all dockside monitoring requirements for trips on which an at-sea monitor is present. Rationale: There is no need for redundant monitoring of the same trip by both an at-sea and a dockside monitor because the at-sea monitor will already achieve the catch verification objective of the dockside monitor for that trip. The expense of additional dockside monitoring is unnecessary and overly burdensome for the Sector members. 2. Exemption request: DSM for jig fishery The Northeast Coastal Communities Sector requests an exemption from all dockside monitoring requirements for all trips conducted by jig fishermen. Rationale: Jig (hook and line) fishermen can target cod with virtually no bycatch of other stocks. This has been demonstrated by this gear type during the 2010 fishing year and in past years. Furthermore, jig fishing yields far fewer fish caught than other gear types, and thus monitoring of this gear type is cost ineffective in terms of dollars spent per monitored pound of fish. 3. Exemption request: DSM for hook gear dogfish directed trips The Northeast Coastal Communities Sector requests an exemption from all dockside monitoring requirements for all trips using demersal longline, handgear, and jig on targeted dogfish trips. Rationale: Dogfishing trips yield extremely low groundfish bycatch with a hook gear type. The cost of dockside monitoring per pound of groundfish monitored in the directed dogfish fishery using hook gear is too low to justify the burden that this monitoring places on the fishery. 4. Exemption request: ASM for hook gear dogfish directed trips The Northeast Coastal Communities Sector requests an exemption from all at-sea requirements for all trips using demersal longline, handgear, and jig on targeted dogfish trips. Rationale: Dogfishing trips yield extremely low groundfish bycatch with a hook gear type. The cost of at- sea monitoring per pound of groundfish monitored in the directed dogfish fishery using hook gear is too low to justify the burden that this monitoring places on the fishery. 5.
