Other Provisions Relating to the Grievance Procedure. A. Every grievance must be brought to the building principal. In cases in which the employee is grieving the action(s) of the building principal, the employee may approach the Superintendent or his or her designee with his or her grievance at the informal level. The building principal maybe involved in any effort to settle a grievance at the informal level.
B. No reprisal of any kind shall be taken by, or against, any participant in the grievance procedure by reason of such participation.
C. All documents, communications, and records dealing with the processing of a grievance shall be filed separately from the personnel file of the participant(s) and are not valid basis for evaluation. Time limits herein may be extended only by mutual agreement, signed by the parties.
D. Time limits herein apply to teachers on leave of absence, other than sick leave, as if such teacher were present and working.
E. Steps of the grievance procedure shall be conducted during non-regular work hours, although any particular step may be conducted at another time if such time is mutually agreeable.
F. If there is a failure at any step to communicate the decision on a grievance within the specified time limit, the grievant shall then have the right to appeal at the next step of the procedure.
G. Any grievance not advanced from one step to the next within the time limits, shall be deemed resolved by the answer at the previous step.
H. Any grievance which arose prior to the effective date of this agreement, or after the termination date of this agreement, shall not be processed.

2. The grievance shall (1) name the employee involved, (2) state the facts giving rise to the grievance, (3) identify the specific provisions of this Contract alleged to be violated, (4) state the contention of the grievant with respect to the grievance and,

D. All documents, communications, and records originating as a result of the filing of a grievance shall be filed in a separate grievance file and shall not be kept in the grievant's official personnel file.
E. Nothing in this agreement shall prevent the SEIU/FPSU or an individual grievant who is not represented by SEIU/FPSU from withdrawing the grievance at any step of the process with prejudice. A grievance, once withdrawn, may not be re-filed without the mutual written agreement between the District and SEIU/FPSU.
F. Failure of the grievant to proceed with the grievance within the timelines herein stipulated shall result in the dismissal of the grievance. A dismissed grievance may not be refilled without the mutual written agreement between the District and SEIU/FPSU. Failure of the District or its representative to take the required action within the times provided shall entitle the grievant to proceed to the next step of this grievance procedure.

9. There shall be no appeal from an arbitrator's decision if within the scope of his authority as set forth above. It shall be final and binding on the Association, its members, the teachers, the employee or employees involved, and the Board.
10. AII documents, records, and material relevant to a grievance which are on file in a teacher's personnel file shall be made available to the grievant.
11. The Association may file a system -wide grievance at Step Three subject to the time limit designated in Step Two, paragraph 3. X. Xx non-tenure teacher may use the grievance procedure in any way to appeal discharge or a decision by the Board not to renew such teacher's contract.
X. No tenure teacher shall use the grievance procedure to dispute any action by the Board which is in accordance with the state tenure laws.
L. No teacher shall use the grievance procedure to appeal any decision of the Board or administration if such decision is pursuant to any order of or written agreement with any state or federal regulatory commission or agency. In the event the School Corporation comes under any court order or conciliation agreement with any state or federal regulatory commission or agency the carrying out of which would affect the terms of this agreement, the parties agree to negotiate in regard to such terms within the scope of the conciliation agreement or order.
M. The association shall discourage any attempt of its members to appeal to any court or labor board from a decision of an arbitrator.

B. Time limits herein may be extended only by mutual agreement, signed by the authorized representatives of each party. In the event a grievance is filed after May 15 of any year, the Board shall cooperate in processing such grievance at least through Step 3 of the grievance procedure.
C. Any grievance not advanced from one-step to the next, within the time limits, shall be deemed resolved by the answer at the previous step.
D. Any grievance which arose prior to the effective date of this Contract shall not be processed with the grievance procedure.
