Pollution Measures. As it is expected that operation of construction machinery will generate coarse particles and noise during construction, the following measures will be taken: water sprinkling, covers on load-carrying platforms of vehicles, installation of sound-proof sheets near houses and use of low-noise heavy machinery. As for water pollution, water-shielding steel-pipe sheet-pile foundation and steel sheet piles will prevent muddy water from flowing into rivers, and muddy water will be treated in detritus tanks before being discharged so that the environmental criteria of the country will be satisfied. All excavated soil (about 14,000 m³) will be used for the construction of approach roads in the project. The result of the bottom sediment survey conducted as part of EIA confirms that the soil does not contain heavy metal or any other harmful substance exceeding the criteria. ⑤ Natural Environment: The target area does not apply to a vulnerable area, such as national park, or its surrounding. The Xxxxxx and Gumti Rivers may have rare species of river dolphins, which may be affected by the underwater noise and vibration from pile driving and nighttime lighting. If any river dolphin is spotted, pile driving and the operation of construction vessels will be suspended and nighttime lighting will be limited to the construction sites. Therefore, no serious adverse impact on the natural environment is expected. ⑥ Social Environment: Although the Project is carried out within the land owned by the executing agency and does not require land acquisition, it required the involuntary relocation of a total of 294 residents for the construction of the three bridges. The relocation was carried out according to the regulations of the country and the Resettlement Action Plan (RAP). There was a meeting with residents during the development of the RAP, where the project outline, compensation through payment of the replacement costs, support measures, monitoring plan, complaint handling mechanism, etc., were explained. Meeting participants made requests for a construction planning that will minimize relocation, the provision of appropriate compensation and measures to support livelihood recovery, and asked questions about relocation schedule. No special opposition against the project was identified throughout the meeting.

The area required for land acquisition is about 16.1ha. The procedures of the resettlement and land acquisition are taken in line with the Philippine laws and regulations and Resettlement Action Plan (RAP) which is prepared based on the JICA Guidelines. At a stakeholders’ meeting held during the RAP preparation, explanation and consultation was made on the Project description, compensation and contents of support of resettlement process, relocation place, etc. From the consultation, there are no specific adverse opinion observed against the implementation of this Project. Support of resettlement process is provided by the National Housing Authority (NHA) and LGUs under the responsibility of DOTC. ⑦ Other/Monitoring: Based on the environmental management plan and environmental monitoring plan, contractor implements monitoring of air, noise, vibration, etc. of the project site under the supervision of DOTC during the construction period. The executing agency held meetings to explain the land acquisition and resettlement to the residents to be affected according to the latest development plan of bridges and approach roads and reached agreement with the residents about the resettlement action program for each of the project bridges. ⑦ Other/Monitoring: In this Project, the construction contractor is responsible for monitoring the air, noise, water, and other pollution during construction, and the executing agency is responsible for monitoring the noise and other pollution after the commencement of the service. The executing agency will also monitor the processes of the land acquirement and resettlement as well as the recovery of livelihoods while receiving support from consultants and local NGOs. Moreover, external monitoring will be carried out by a third-party organization under contract.

Pollution Measures. During the work, the appropriate pollution preventive measures will be taken according to Egyptian construction guidelines and other resources to prevent construction materials from scattering and prevent paint and oil/grease from polluting soil in the area. Also, water will be leached appropriately, and work hours will be limited to control noise and vibrations. After handover, emissions are expected to comply with Egyptian and IFC air quality standards. Wastewater will first be treated at existing wastewater treatment plants, and then discharged at a water quality compliant with Egyptian standards.

  • Taxation Measures 1. Except as provided in this Article nothing in this Agreement shall apply to taxation measures. 2. Nothing in this Agreement shall affect the rights and obligations of the Parties under any tax convention. In the event of any inconsistency between the provision of this Agreement and any such convention, the provisions of that convention shall apply to the extent of the inconsistency. 3. Without prejudice to the application of paragraph 2, the disciplines referred to hereinafter shall apply to taxation measures: (a) Article 7 (National Treatment) of Chapter 2 (National Treatment and Market Access for Goods) and such other provisions of this Agreement as are necessary to give effect to that Article to the same extent as does Article III of the GATT 1994; and (b) Article 106 (National Treatment) of Chapter 8 (Trade in Services), subject to the exceptions provided for in Article XIV letters (d) and (e) of the GATS, which are hereby incorporated. 4. The provisions of Article 133 (Expropriation) and Annex 9 (Expropriation) of this Chapter shall apply to taxation measures alleged to be expropriatory. 5. The provisions of Article 139 (Investor-State Dispute Settlement) apply with respect to paragraph 4 of this Article. 6. If an investor invokes Article 133 (Expropriation) and Annex 9 (Expropriation) of this Chapter as the basis of a claim to arbitration according to Article 139 (Investor-State Dispute Settlement), the following procedure shall apply: The investor must first refer to the competent tax authorities described in subparagraph 7(c), at the time that it gives written notice of intent under Article 139 (Investor-State Dispute Settlement), the issue of whether the tax measure concerned involves an expropriation. In case of such referral, the competent tax authorities shall consult. Only if, within 6 months of the referral, they do not reach an agreement that the measure does not involve an expropriation, or in case the competent tax authorities of the Parties fail to consult with each other, the investor may submit its claim to arbitration under Article 139 (Investor-State Dispute Settlement).

  • Environmental Measures (i) The Contractor agrees to conduct its activities in connection with the Agreement in such a manner so as to comply with the environmental requirements which includes, inter alia, all the conditions required to be satisfied under the environmental clearances and applicable law, and assumes full responsibility for measures which are required to be taken to ensure such compliance.

  • Remedial Measures Upon becoming aware of an alleged security breach, Contractor’s Contract Manager must set up a conference call with the Department’s and the Customer’s Contract Manager. The conference call invitation must contain a brief description of the nature of the event. When possible, a thirty (30)- minute notice will be given to allow Department personnel to be available for the call. If the designated time is not practical for the Customer, an alternate time for the call will be scheduled. Contractor must share all available information on the call. The Contractor must answer all questions based on the information known at that time and answer additional questions as additional information becomes known. The Contractor must provide the Department and Customer with final documentation of the incident including all actions that took place. If the Contractor becomes aware of a security breach or security incident outside of normal business hours, the Contractor must notify the Department’s and the Customer’s Contract Manager and in all events, within one business day.

  • Pollution Pollution means the actual, alleged or threatened discharge, seepage, migration, dispersal, release or escape of pollutants at any time.

  • Emergency Measures Additional measures and/or other special requirements necessary during periods of critical fire-weather conditions shall be included in the fire prevention and presuppression plan.

  • Interim Measures Notwithstanding any requirements for alternative dispute resolution procedures as set forth in Articles 18(B), any party to the Dispute may apply to a court for interim measures (i) prior to the constitution of the arbitral tribunal (and thereafter as necessary to enforce the arbitral tribunal’s rulings); or (ii) in the absence of the jurisdiction of the arbitral tribunal to rule on interim measures in a given jurisdiction. The Parties agree that seeking and obtaining such interim measures shall not waive the right to arbitration. The arbitrators (or in an emergency the presiding arbitrator acting alone in the event one or more of the other arbitrators is unable to be involved in a timely fashion) may grant interim measures including injunctions, attachments and conservation orders in appropriate circumstances, which measures may be immediately enforced by court order. Hearings on requests for interim measures may be held in person, by telephone, by video conference or by other means that permit the parties to the Dispute to present evidence and arguments.

  • Accident Prevention Health and Safety Committee (a) The Employer and the Union agree that they mutually desire to maintain standards of safety and health in the workplace in order to prevent accidents, injury and illness. (b) Recognizing its responsibilities under the applicable legislation, the Employer agrees to accept as a member of its Accident Prevention – Health & Safety Committee at least three (3) representatives, one from each base, selected or appointed by the Union from amongst bargaining unit employees. At any time where a vote is required, an equal number of representatives from each side shall be entitled to vote. (c) Such Committee shall identify potential dangers and hazards, institute means of improving health and safety programs and recommend actions to be taken to improve conditions related to safety and health. (d) The Employee agrees to co-operate reasonably in providing necessary information to enable the Committee to fulfill its functions. (e) Meetings shall be held quarterly or more frequently at the call of the Chair if required. The Committee shall maintain minutes of all meetings and make the same available for review. (f) Any representative appointed or select in accordance with (b) hereof shall serve a term of one (1) calendar year from the date of appointment which may be renewed for further periods of one (1) year. The Union will encourage its representative(s) to serve at least one (1) year. Time off for such representative(s) to attend meetings of the Accident Prevention – Health & Safety Committee in accordance with the foregoing shall be granted and time so spent attending such meetings shall be deemed to be work time for which the representative(s) shall be paid by the Employer at his regular or premium rate as may be applicable. (g) The Union agrees to endeavour to obtain the full co-operation of its membership in the observation of all safety rules and practices. (h) Pregnant employees may request to be transferred from their current duties if, in the professional opinion of the employee’s physician, the pregnancy may be at risk. If such a transfer is not feasible, the pregnant employee, if she so requests, will be granted an unpaid leave of absence before commencement of the maternity leave referred to in Article 16.04

  • Pollution Control The Employer and the Union agree to limit all forms of environmental pollution.
