The 'Rest breaks during overtime' clause establishes the right of employees to take designated rest periods when working beyond their standard hours. Typically, this clause specifies the duration and timing of breaks, such as a 15-minute rest after every four hours of overtime, and may outline whether these breaks are paid or unpaid. Its core function is to protect employee well-being and prevent fatigue by ensuring that extended work hours do not compromise health and productivity.
Rest breaks during overtime. An Employee must be allowed a paid rest break of 20 minutes after each four hours of overtime worked, if the Employee is required to continue work after the rest break. Provided that where a day worker on a five day week is required to work overtime on a Saturday, the first prescribed rest break, if occurring between 10.00 am and 1.00 pm, must be paid at ordinary rates.

58.1 Outside Ordinary Hours – Production Employees
58.1.1 Where an Employee is required to work for more than 2 hours before the ordinary starting time, or continue working for more than 2 hours after the ordinary ceasing time, such Employee shall be allowed, after the expiration of the said 2 hours, one-half hour at the appropriate overtime rate for the purpose of having a meal. At the expiration of each four (4) hours overtime worked thereafter the Employee shall be allowed one-half hour at the appropriate overtime rate for the purpose of having a meal if work is to continue.
58.1.2 After an Employee has worked two (2) consecutive hours overtime such Employee shall be given a rest pause of 10 minutes’ duration.
Rest breaks during overtime. Where overtime is to be worked immediately after the completion of ordinary hours on a day or shift and the period of overtime is to be more than one and a half hours, an Employee, before starting the overtime, is entitled to a rest break of 15 minutes to be paid at the Employee's ordinary time rate.
Rest breaks during overtime. 18d).1 An employee is entitled to rest breaks during overtime as per Clause 32.11 of the Manufacturing and Associated Industries and Occupations Award 2020.
18d).2 Employees may vary the length and frequency of rest breaks to take short rest breaks (e.g. coffee and phone breaks) as convenient. The total of such breaks to be no less that then rest breaks outlined in this clause.
18d).3 Meal and rest breaks are, in all cases, to be taken at a time that is convenient to Unipod’s business and approved by the Team Leader or Manager. It may be that in some instances an employee may be required to work through their break where this does not create any risks to health and safety and in this case a break will be taken at a mutually agreeable time.
18d).4 For the avoidance of doubt time taken as a paid rest break shall be counted as time worked and time taken for unpaid meal breaks shall not be counted as time worked.
