Section Rest Breaks. No employee will be required to operate equipment on public streets and thoroughfares that is not in compliance with the appropriate provisions of the law dealing with safety requirements for mobile equipment; i.e. brakes, steering, adequate mirrors, signal lights or other lighting equipment. It shall be the duty of the employee to report, in writing, on the appropriate forms of the company, promptly, but not later than the end of the shift, trip or tour all safety and/or mechanical defects on the equipment which they have operated during that shift, trip or tour. All trucks and tractors to be equipped with trouble sheets in triplicate book form, and the book with one (Ic)opy to remain in the vehicle at all times. The Company shall designate the person to whom all defects reports of mobile equipment are submitted, and all employees will be notified the name of such person. In the event essential repairs cannot be effected to make the equipment safe, the equipment will be correctly identified and kept out of service until repaired and it shall not be considered a violation of his employment when a Company employee refuses to operate such identified equipment. Identification red tags shall be supplied and made available by the Company. It shall be the obligation of the Company to direct the repairs as necessary to conform with the safe and efficient operation of that equipment. It shall be the duty of the maintenance shop employees to perform their duties efficiently and as instructed in such a manner that repairs having been made to correct the safety mechanical defect. Section Rest Breaks. On a regular shift, two (2) ten (IO) minute rest breaks will be taken at a location determined by mutual agreement between the Employer and the Union. On shifts of ten hours, the Employee will be given one fifteen (15) minute rest break in the middle of the first five (5) hours of the shift, and one (15) minute rest break in the middle of the second five (5) hours of the shift, unless workplace conditions require a variance in the time of either rest break on one or more days. Where work is required beyond ten hours, a second meal break of one-half (112) hour will be provided at the end of eight (8) hours, to be paid at straight rates.
