Security Screening. The parties to this letter understand that security screening of passengers will be transferred from airline control to an independent security authority as contemplated by Xxxx C-49. Within ninety (90) day of this transfer, or at another mutually agreeable time, the employees performing security duties who become surplus will be given notice of layoff. Security Screening. The Contractor must: screen all Contractor personnel prior to Contractor authorizing access to Province or Contractor Systems; conduct criminal record checks on all Contractor personnel who have access to any Province or Contractor Systems; make a reasonable determination of whether the individual constitutes an unreasonable security risk taking into consideration the duties of the individual, the type and sensitivity of information to which the individual may be exposed, and all applicable laws; and require all Contractor personnel to proactively disclose criminal offences to the Contractor unless prohibited by applicable law. The Contractor must ensure that its suppliers and subcontractors involved in the provision of Services meet or exceed the standards set forth in this Schedule. The Contractor must: implement and maintain encryption of Province Information while at rest and in transit; offer the Province the technical capability of cryptographic key management to allow the Province to manage encryption keys in relation to Province Information at rest and in transit; not hold or have access to encryption keys if such encryption keys are managed by the Province to encrypt Province information at rest or in transit; and not provide encryption keys used to secure Province Information to a third party or the ability to break such encryption. The Contractor must: implement and maintain the logical isolation of Province Information, even in the case of equipment or technology failure; implement, where supported by available technology, the logical isolation of audit records related to Province Information and activities, even in the case of equipment or technology failure; segregate tenancy traffic from management network traffic; and not use Protected Information for test or development purposes without the written approval of the Province.

Security Screening. All radiation workers, prior to them being allowed to commence work under the service, satisfactorily pass security screening by the Contractor in terms of the Contractor’s own security regulations and the Contractor’s conditions of employment. All the Contractor’s personnel are subject to and conform to the Employer at KNPS's security system and processes. When requested by the Service Manager, the Contractor furnishes the Service Manager with the curriculum vitae, security records, police clearance, and where applicable, medical records and radiation exposure histories of all personnel. A valid SA identity document or a valid passport in respect of foreign nationals is required for a security permit to gain access to the Employer`s premises. The Contractor complies with the stipulations of the Immigration Act (Act 13 of 2002) and the Immigration Amendment Act (No 19 of 2004, Section 11 (2) Visa, and Temporary Residence Permit) that stipulates requirements that requires foreign workers:  Must be in possession of a valid passport when entering the Republic of South Africa (RSA);  Must access the RSA through an officialPort of Entry”, and  Must have a “Letter of Invitation” to work at KNPS received from the Contractor. The violation of any security measures will result in the withdrawal of access permits. The Contractor remains responsible for the retrieval and return of all the Employer`s security permits upon Completion or earlier termination of the contract. A cost of R50,00 per permit will be levied on the Contractor, should permits not be returned after Completion or earlier termination of the contract. Security Screening. 48.1 In acknowledgement of the heightened security concerns common to the commercial real estate industry, the Employer and the Union agree to cooperate in complying with any and all security measures implemented by the Employer’s customers. 48.2 All employees shall be subject to security background checks at any time based on a customer requirement. An employee shall cooperate with an Employer as necessary for obtaining security background checks. Any employee who refuses to cooperate shall be subject to termination. Employees who fail such security background check shall be subject to termination. 48.3 To this end, the Union agrees that current employees shall, as a condition of continued employment, execute a release authorizing the Employer or an authorized agent of the Employer to conduct an investigation into the following: a. Credit history, criminal history, verification of previous residence(s), employment verification(s), school references(s) and any lawful inquiries into immigration status. The aforementioned sample release is annexed to this Agreement as Appendix “C”. 48.4 The Employer shall notify the Union of any and all customer requirements for such security background checks and shall apply such requirements equally to all its employees working in the customer’s building(s). 48.5 If the results of information gathered during such a security background check are such that they would cause the Employer to remove a bargaining unit member from or not allow them access to a customer’s building(s) that member shall be informed of the results of the background check and given the opportunity to challenge the accuracy of that information. 48.6 The Employer will treat any and all information collected as a result of security screening or background checks as private information and utilize a secure storage procedure with access limited to the appropriate Human Resources personnel. The Employer further warrants that this information if retained will be kept in a manner to insure its privacy. 48.7 For the purpose of this provision, just cause to terminate an employee who has failed a security background check exists only if it is established that one or more of the findings of the background security check is directly related to his/her job functions or responsibilities, or that the continuation of employment would involve an unreasonable risk to property or to the safety or welfare of specific individuals or the general public or constitute a violat...
