Step Two (Formal). On proper written notice, the education association's fact-finding committee, hereafter referred to as the Grievance Committee, shall within five days transmit the complaint to the Superintendent. The Superintendent or his designated representative shall then work with the Grievance Committee in a full good faith effort to seek an equitable solution. A written copy of the proceedings of all meetings held concerning a given complaint under this step shall be furnished to the aggrieved teacher, to the Superintendent or his representative, to each member of the Grievance Committee and the president of the education association. The parties involved must resolve any complaint under consideration within ten days after the Grievance Committee has transmitted the complaint to the Superintendent.
Step Two (Formal). 1. If, after informal discussion with their immediate supervisor, the complaint is not resolved at Step One, the grievance shall be committed to writing. In order to be deemed timely, the written grievance must be delivered in person or by certified mail, return receipt requested, to the grievant’s grievance administrator within fifteen (15) working days after the grievant knew or should have known of the occurrence on which it is based. The grievance form to be used shall be furnished by the Union. The written grievance must contain the following information: (1) the date of the occurrence of the alleged grievance; (2) the contract article(s) and specific sections of the Article allegedly violated; (3) a reasonably complete statement of the facts giving rise to the grievance; (4) the names of witnesses, if applicable; and, (5) the relief sought. Both parties recognize the importance of providing as complete information as possible specific to the grievance and agree that items 1, 2, and 3 must be completed in order for management to process the grievance. A copy of the formal grievance, stated in writing, shall be submitted to the designated work site grievance administrator, the Union, and, the Superintendent or designee, with one (1) copy retained by the grievant. Copies shall be distributed at each level of the grievance procedure following this provision.
Step Two (Formal). If the matter is not satisfactorily resolved at Step One, the Union may submit the grievance to the applicable Division head within twelve (12) days of receipt of a decision in Step One. The Division head shall meet with the Union within ten (10) days unless there is Agreement of both parties not to meet. The Vice President - Human Resources or designate shall attend this meeting. The Division head shall render their decision within ten (10) days after the matter has been heard, or if a meeting was waived by mutual agreement, the date from which the grievance was received. Extensions to respond at Step Two may be mutually agreed on. The grievor shall be entitled to have a representative of the Union present at any meeting pertaining to their grievance. The Corporation and the Union will cooperate with each other in exchanging relevant information and reasons for their respective positions at this step of the grievance procedure.

If the grievance is not resolved, the aggrieved teacher, the chairperson of the Grievance Committee, and the director will meet with The Board concerning the grievance.

Step Two (Formal). If the grievance is not resolved to the employee's satisfaction in accordance with Step One, the employee may submit a formal written grievance to the director of food and nutrition services, with a copy to the Human Resources Department, within seven (7) working days of the Step One informal meeting. The grievance will describe the facts upon which the grievance is based, the provision(s) of the Agreement allegedly violated, and the remedy sought. The director of food and nutrition services or his designee shall meet with the grievant and his/her union representative to discuss the grievance and shall make a written response to the grievant, with a copy to the Union, within fourteen (14) working days of the Step Two formal meeting.
Step Two (Formal). The Campus Grievance Officer will, within fourteen (14) calendar days of the filing of the grievance, arrange a formal conference between the appropriate campus representative(s) and the grievant and the Union. If the conference results in resolution of the grievance, the grievance will not be processed further. The Campus Grievance Officer will notify the grievant or Union President as appropriate of any resolution reached as a result of the conferences. The Campus Grievance Officer will issue a written decision within fourteen (14) calendar days following conclusion of the conference.

  • Level Two – Formal If the Grievant is dissatisfied with the disposition of the grievance at Level One – Formal, the Grievant may complete Level Two Grievance Form and submit to the Superintendent within ten (10) days of written disposition of Level One – Formal. Within ten (10) days of receipt of the Level Two Grievance Form, the Superintendent shall meet with the Grievant. The Superintendent shall execute written disposition of the grievance within ten (10) days of such meeting.

A written decision shall be given by local management designated to handle Step 2 within five (5) working days of the date of such meeting. If this written decision does not satisfactorily adjust the grievance, it may be appealed to Step 3 following. Step No. 3 – Notice of appeal must be given in writing by dating and signing the grievance forms within ten (10) working days from the written decision of local management, or their designate, through the Manager, Labour and Employment Relations, setting forth the areas or points of disagreement with the Step 2 written decision. The Manager, Labour and Employment Relations, will arrange a Management Committee to meet with up to two (2) members of the Grievance Committee and the Local President, or Bargaining Unit Chairperson, or his/her designated alternate, within seven (7) working days or a time mutually agreed upon. The two committees jointly will discuss the grievance and may request the attendance of any person or persons interested or involved. The Management Committee will render its decision in writing within seven (7) working days from the date of such meeting to the Local or Bargaining Unit. If the Committee’s decision does not bring about a satisfactory settlement, the grievance may be referred by either party to arbitration as provided for in Article 8.

  • Step Movement During the period from September 1, 2009 through August 27, 2011, there shall be no non-probationary step movements, including any step movement provided for in other provisions of this Agreement. Step movement shall resume on August 28, 2011. Employees hired or promoted between September 1, 2009 and August 27, 2011 shall not receive a probationary step increase. Upon resumption of step movement, the employee’s step date shall be the employee’s date of hire or promotion. No retroactive movement shall occur for the two (2) years that have been skipped. Upon resumption of step movement, newly hired employees will move to the next step in their pay range after completion of their probationary period. In periods other than September 1, 2009 through August 27, 2011, newly hired employees hired on or after November 1, 2015 will move to the next step in the pay range after completion of one hundred eighty (180) days in active pay status, and every year thereafter provided the employee has successfully completed his/her probationary period.
