SUBSTANCE ABUSE TESTING AND ASSISTANCE PROGRAM. A. The Individual Employers and the Union are committed to providing a safe and productive work environment. Substance abuse decreases efficiency, increases the risk of property loss or damage, and increases the risk of injury to employees.

SUBSTANCE ABUSE TESTING AND ASSISTANCE PROGRAM. This substance abuse policy and assistance program has been adopted and implemented pursuant to the negotiations between the Tri-County Contractors’ Association (“Employer Association”) and the Laborers International Union of North America Local #113 or (“Union”). The term “Contractor” or “Company” when used herein refers to the construction industry contractors who are signatory to a Collective Bargaining Agreement with the Union. Should any dispute arise with respect to the application or implementation of this policy and program as to employees employed by Contractors, such disputes shall be submitted to the grievance and arbitration provisions of the Collective Bargaining Agreements (“Agreements”) covering Kenosha and Racine Counties.
SUBSTANCE ABUSE TESTING AND ASSISTANCE PROGRAM. Section 29.1 The parties to this Agreement recognize the problems created by drug and alcohol abuse and the need to develop prevention and treatment programs. All companies signatory to this Agreement and the signatory Unions have a commitment to protect people and property, and to provide a safe working environment. The purpose of the program is to establish and maintain a drug free, alcohol free, safe healthy work environment for all employees. The AGC of Wisconsin Construction Trades Substance Abuse Testing & Assistance Program, the full terms and conditions of which are hereby incorporated into this Section by this reference, details the program to which all companies and Unions signatory to this Agreement endorse and agree to abide by.

The Construction Trades Substance Abuse Testing & Assistance Program, the full terms and conditions of which are hereby incorporated into this Section by this reference, details the program to which all companies and the Union’s signatory to this Agreement endorse and agree to abide by. The Employers hereby agree to pre-fund the costs of the testing pursuant to the Construction Trades Substance Abuse Testing & Assistance Program through a cents-per- hour contribution, as determined by the Drug Testing Committee and to pay the sum established for such program.
SUBSTANCE ABUSE TESTING AND ASSISTANCE PROGRAM. This substance abuse policy and assistance program has been adopted and implemented pursuant to the negotiations between the Wisconsin Underground Contractors Association and the Wisconsin Laborers’ District Council and its Affiliated Unions in Wisconsin of the Laborers’ International Union of North America (“Union”). The term “Contractor” or “Company” when used herein refers to the construction industry contrac- tors who are members of WUCA. Should any dispute arise with respect to the application or implementation of this policy and program as to Employees employed by Contractors, such disputes shall be submitted to the grievance and arbitration provisions of this Agreement.
SUBSTANCE ABUSE TESTING AND ASSISTANCE PROGRAM. The Union and the Employers agree that both parties have an interest in establishing and maintaining a drug-free workplace and resolve to establish a Substance Abuse Testing and Assistance Program (“Program”) that is maintained on an industry basis. The parties agree to meet on a labor- management basis to formulate the terms of this program during the period of the agreement. The funding of this program will be through a $.xx per hour contribution into a joint labor-management trust formed for the purpose of administering the program. Copies of the trust agreement will be provided upon request. The funding will begin upon the date May 1st immediately prior to the implementation of the program. (For example, if the program is to be implemented November 2008, then a $.xx contribution will commence May 1, 2008). This is an Employer contribution; in the event that the program is terminated, then the contribution will discontinue for the Employers. Under no circumstances will this article or any negotiations, signing, or implementation of the program pursuant to this article be considered an opener or re-opener of the Agreement, or subject to any work stoppage.

SUBSTANCE ABUSE TESTING AND ASSISTANCE PROGRAM. Notwithstanding the program described in this Exhibit, the employer is permitted to adopt its own lawful drug testing program in compliance with applicable state and federal law. Any such program shall operate in conjunction with any applicable industry program as possible to avoid duplicative testing requirements. This substance abuse policy and assistance program has been adopted and implemented pursuant to the negotiations between the Associated General Contractors of Greater Milwaukee, Inc., the Allied Construction Employers Association, ("Employer Associations"), the Eastern Wisconsin Erectors Association, Inc.(“Employer Associations”) and the Milwaukee Office of the North Central States Regional Council of the United Brotherhood of Carpenters & Joiners of America, ("Union"). The term “Contractor” or "Company" when used herein refers to the construction industry contractors who are signatory or bound to a Collective Bargaining Agreement with the Union. Should any dispute arise with respect to the application or implementation of this policy and program as to employees employed by Contractors, such disputes shall be submitted to the grievance and arbitration provisions of the current Collective Bargaining Agreements ("Agreements").
SUBSTANCE ABUSE TESTING AND ASSISTANCE PROGRAM. 17.1. The parties agree to be bound by the terms of the Associated General Contractors of Missouri Substance Abuse Testing and Assistance Program attached hereto and marked Exhibit "A".
