Temporary Filling of Vacant Positions. Section 4.1 The District reserves the right to temporarily fill the position by hiring a substitute employee, or by temporarily reassigning a bargaining unit employee. Section 4.1.1 Substitute employees shall not be utilized for more than sixty (60) calendar days unless the District and CSEA agree to an extended period of time. Section 4.1.2 Bargaining unit members may be utilized to fill a vacancy on a temporary basis for no more than sixty (60) calendar days unless the District and CSEA agree to an extended period of time. Section 4.1.3 The District shall attempt, whenever possible, to offer the open position, during recruitment, as additional duty and/or overtime work to current bargaining unit employees. Section 4.1.4 If additional hours are given to part-time employees to temporarily fill a vacant position, accrual of additional vacation and sick leave begins on the first day of the increased hourly assignment. Section 4.1.5 If a promotional vacancy has been filled on an interim basis by temporary reassignment of a bargaining unit employee, and said employee is the successful candidate for the promotion, then the time spent in the interim assignment shall be credited toward the employee’s promotional probationary period.

Temporary Filling of Vacant Positions. If the District advertises or initiates any hiring procedure to fill any vacant position in the classified bargaining unit with a permanent employee, the District may fill the vacancy through the employment of one or more substitute employees for not more than a total period of sixty (60) calendar days unless no eligible qualified candidate is identified during that period. If no eligible qualified candidate is identified within the sixty (60) calendar day period, the parties may mutually agree to continue to fill the position with one or more substitute employees for an agreed upon period of time to identify a qualified candidate for the position. Should the District determine, after advertising or initiating the hiring procedure not to fill the vacancy, the District may not extend the period of substitution beyond the sixty (60) calendar day period.

Temporary employees will be hired for the applicable classification and wage rate as per Appendix A of the Collective Agreement. Should a temporary employee apply for a job posting and be successful as per Article 9.07 of the Collective Agreement the temporary employee shall then become a probationary employee. The seniority date of a temporary employee who is awarded a full-time position will equal the date the full-time position is awarded. No person, who is or has been employed by the Company outside of the bargaining unit, shall be eligible to work as a temporary employee within the bargaining unit, unless his record of employment with the Company has been severed in excess of one week.

  • Temporary Layoffs A. The Employer may initiate a temporary layoff for up to twelve (12) working days per fiscal year. Employees will be given thirty (30) days’ notice before the effective date of a temporary layoff. Employees may request alternative temporary layoff days from their manager or supervisor and any requests will be considered and approved or denied in writing. B. A temporary layoff will not affect an employee’s incremental movement, vacation and sick leave accrual rates, or seniority. C. A temporary layoff is leave without pay. An employee may not use any leave for a temporary layoff day(s).

The Hospital will outline to employees selected to fill such temporary vacancies and the Union, the circumstances giving rise to the vacancy, and the special conditions relating to such employment.
