THE FOREST SERVICE WILL. 1. Xxxx Xxxxxx prior to commencement of work for deposits sufficient to cover the estimated costs, including overhead, for the specific payment period. Xxxxxxxx will be made according to the fee collection schedule established in the Special Use Permit issued to the Holder, and shall be sent to: .
2. Deposit the payments received from the Holder into a Forest Service Suspense Account.
3. Refund to the Holder funds equal to the value of the work projects completed by the Holder, as specified on the attached Xxxxxxx-Xxxx Financial Plan.
4. Upon receipt of notice from the holder of any project or projects the holder will be unable to complete, deposit any remaining funds into the Forest Service Cooperative Work Fund, and complete such projects.
5. Upon completion of these projects, make available for other maintenance or reconditioning projects any funds deposited in excess of the cost of the projects. Such projects shall be authorized pursuant to a separate agreement between Holder and the Forest Service. If no further maintenance or reconditioning work is performed for offset against the permit fee, the excess amounts shall be deposited to the Treasury.
6. Refund to the Holder any remaining funds collected in excess of the final 2002 permit fee as calculated following receipt of Holder's end-of-year financial operating statement submitted in accordance with requirements of the Special Use Permit issued to the Holder.
7. Supply Holder with appropriate standards for work projects to be performed for offset of permit fees, and specifications for equipment, supplies, or materials to be provided by the Holder.
THE FOREST SERVICE WILL a. Participate in the field review of the selected route and provide assistance and counsel to the STATE on environmental protection matters.
b. Furnish available data and information on such matters as land corner location, property line boundaries, maps, and access routes.
c. Explain FOREST SERVICE organization and regulations pertaining to fire prevention and suppression to the party performing the survey.
d. Review and approve requirements and limitations related to clearing survey lines and material source investigations.
THE FOREST SERVICE WILL a. Provide the STATE with existing and planned Forest Service land uses and the relationship between these uses and the travel they generate.
b. Notify the STATE of changing uses that might affect the function of components of the National Forest road system.
c. Provide the STATE with Forest Service long range road plans that identify needed connecting points to the State system.
THE FOREST SERVICE WILL. (1) Participate in the final plan-in-hand review.
(2) Advise the STATE, within 30 days, of any recommended changes in the proposed final designs.
(3) Advise the STATE of appropriate arrangements for disposal of merchantable timber.
(4) If needed, suggest or designate sites for storage and disposal of clearing and grubbing debris and designate sites for disposal of excess excavation material.
(5) Provide information on probable limits of fire season, inherent fire hazards, fire prevention and control requirements, possible use of contractor's forces and equipment for fire suppression to be included in the Fire Protection Plan.
(6) Provide information on the need for detours for National Forest traffic, maintenance of Forest Service roads used for detours during construction, use of Forest Service roads for work roads, replacement of Forest Service facilities and signs. The temporary use of such Forest Service roads will be authorized under special use permit.
(7) Collaborate with the STATE to determine the extent and type of control needed to minimize dust, noise, objectionable odors, air and water pollution, or contamination associated with construction work.
(8) Develop stipulations to cover conditions or needs not adequately covered by plans or the general contract provisions.
THE FOREST SERVICE WILL. 1. Advise Wal-Mart on the availability of public information on rural and community development issues, and conservation and management issues pertaining to the natural resources and recreation opportunities on National Forest System lands.
2. Advise Wal-Mart of opportunities to participate in the public involvement process and events related to planning and implementing outdoor recreation, environmental education activities, community development, conservation of natural resources on National Forest System lands, and enhancement of outdoor recreation opportunities.
3. Include in their documents and announcements appropriate recognition of Wal-Mart's participation and/or contribution to improved natural resource conditions, user opportunities, and rural community stability.
THE FOREST SERVICE WILL a. Provide UDOT with FOREST SERVICE long-range road plans that identify needed connecting points to the State system.
b. Respond to UDOT-planned transportation and route reconnaissance studies.
THE FOREST SERVICE WILL a. Participate in the field review of the selected site or route; furnish available data and information on such matters as archeological resources, land corner locations, property line boundaries and access routes; review requirements and limitations related to clearing survey lines and material source investigations; and provide assistance and counsel to UDOT on environmental protection matters.
b. Participate and assist in UDOT actions which require either an EIS or a FONSI.
THE FOREST SERVICE WILL a. Participate in the UDOT-FOREST SERVICE field review of the preliminary design.
b. Xxxxxx XXXX of any recommended changes in preliminary design.
c. Explain FOREST SERVICE organization and regulations pertaining to fire prevention and suppression.
d. Participate in the Plan-in-Hand field review.
e. Xxxxxx XXXX within two weeks after the Plan-in-Hand review of any recommended changes in the proposed plans and specifications.
f. Enter into a separate stipulation (if needed) relative to details of construction agreed to by both FOREST SERVICE and UDOT not considered to be adequately covered in the final plans and specifications.
g. Review and approve the construction plans and specifications. (Such approval does not relate to engineering functional items, but acknowledges that FOREST SERVICE requirements relating to service needs and impacts on National Forest lands have been met.)
h. Issue a letter of consent for occupancy of proposed right-of-way for construction purposes.
THE FOREST SERVICE WILL. 1. Provide the necessary space at 000 Xxxxxxxxx Xxx, Xxxx Xxxx Xxxx, Xxxx to house an Interagency Fire Center and related Interagency Fire Cache Facility.
2. Provide Clerical assistance as needed for the facility.
3. Provide a Fire Warehouse Person for the Wildfire Cache.
4. Provide a Coordinator at the facility to supervise Interagency Personnel.
5. Provide a Fire Dispatcher.
6. Provide a Computer Terminal.
THE FOREST SERVICE WILL a. Concur with the STATE'S suggested date, or work out a mutually acceptable date, for completing the final evaluation of the potential impact.
