UNIT MEMBER SAFETY.
12.1 Employees shall not be required to work under unsafe or hazardous conditions or to perform tasks which endanger their health, safety, or well being.
12.2 An employee may use reasonable force as is necessary to protect himself/herself from attack, to protect another person or property, to quell a disturbance threatening physical injury to others, or to obtain possession of weapons or other dangerous objects upon the person or within control of a pupil.
12.3 Employees shall immediately report cases of assault suffered by them in connection with their employment to their principal or other immediate superior and to local law enforcement agencies. Such notification shall be immediately forwarded to the Superintendent who shall comply with any reasonable request from the employee for information in the possession of the Superintendent relating to the incident or the persons involved, and shall act in appropriate ways as liaison between the employee, the policy, and the courts.
12.4 If criminal or civil proceedings are brought against an employee alleging that he/she committed an assault in connection with his/her employment, such employee may request the Governing Board to furnish legal counsel to defend him/her in any civil action or proceeding brought against him/her, within the limits set by the law.
UNIT MEMBER SAFETY. 14.1 Unit members shall not be required to work in unsafe conditions or to perform tasks that endanger their health, safety or wellbeing.
14.2 In the event of an emergency closure of District facilities, including but not limited to natural disaster, quarantine, or government order, unit members shall receive their daily rate of pay and benefits.
14.2.1 If make-up days are required by law, the District shall negotiate said days with the Association.
14.3 The District shall maintain a regular maintenance schedule and keep all school grounds and facilities free of unwanted rodents, pests, and insects such as ants, roaches, and fleas. If insecticides or poisons are used, the District shall notify unit members of the names of the chemicals used at least one week in advance of their use. The District shall apply them only at times when unit members and pupils are not present, allowing sufficient time for toxic effects to wear off before humans re-enter the affected area.
14.4 Current District rules and regulations, including those relating to student behavior, for which unit members are held responsible for enforcing or following, shall be provided to unit members before the end of the second week of school.
UNIT MEMBER SAFETY. The District and ETA recognize the mandate of the California Constitution at Article I, section 28, that students and staff have the inalienable right to attend school campuses that are safe, secure, and peaceful. A unit member shall immediately report to the immediate supervisor any written, verbal or physical abuse, assault, battery, or threat of force directed toward the unit member, by a student, parent or campus visitor where such act is related to school activity or attendance. The incident shall also be promptly reported to appropriate law enforcement authorities by the District as prescribed by Education Code Section 44014(a). The District shall promptly investigate reports of abuse, battery, assault, or threat of force, and take actions it deems appropriate to provide a safe working environment for bargaining unit members. The District shall make available to unit members at each school site Board Policies and Administrative Regulations governing student discipline.

B. Unit members shall immediately report cases of assault suffered by them in connection with their employment to their immediate supervisor or designee who shall immediately report the incident to the Superintendent or designee. The Superintendent or designee shall comply with any reasonable request from the unit member for information relating to the incident or the persons involved, and shall act in appropriate ways as liaison between the unit member, the police, and the courts.
UNIT MEMBER SAFETY. The Board recognizes its responsibility for unit member safety under the Education Code. The Board further acknowledges that this responsibility includes maintaining procedures related to visitors, planning for disasters and consideration of student suspension, exclusion, and expulsion and notification of staff members as prescribed by the Education Code.
UNIT MEMBER SAFETY. A teacher may recommend to the principal that a student be excluded from any class who in the teacher’s opinion acts in such a way that the teacher believes good cause exists for such student exclusion.

2. A teacher may suspend any pupil from the teacher’s class, for any of the acts enumerated in Section 48900, for a day of the suspension and the day following. The teacher shall immediately report the suspension to the principal of the school and send the student to the principal or the principal’s designee for appropriate action. As soon as possible, per Education Code 48910, the teacher shall ask the parent or guardian of the pupil to attend a parent/teacher conference regarding the suspension.
3. A written description of the rights and duties of unit members with respect to student discipline and rights of the suspended student shall be presented to each unit member in writing annually. Updates shall be circulated to all unit members.
4. When, in the judgment of the unit member, a student requires the attention of the principal, assistant principal, counselor, psychologist, or other immediate specialist, they shall so inform their principal or immediate supervisor. The principal or immediate supervisor shall arrange, as soon as possible, for a conference between him/herself, the unit member, and the appropriate specialist to discuss the problem and to take appropriate action.
5. Unit members shall immediately report cases of assault suffered by them in connection with their employment, to their principal or immediate superior who shall immediately report the incident to the sheriff.
a. Such notification shall be immediately forwarded to the Superintendent who shall comply with any reasonable request from the unit members for information in the possession of the Superintendent relating to the incident or the persons involved.
6. As used in this Article, “connection with their employment” shall include any voluntary activities (such as field trips) which involve student contact.
UNIT MEMBER SAFETY. 1 11.1 A unit member shall not be required to work or engage in any activity which poses an 2 immediate hazard to life or limb or which is contrary to the requirements for safe 3 working conditions as established under the California Occupational Safety and Health 4 Act of 1973 (CAL/OSHA). Enforcement and rule-making authority is lodged with the 5 Department of Industrial Relations. The Division of Industrial Safety has jurisdiction 6 over inspection and the enforcement of standards; therefore, any disputes arising relating 7 to safety conditions may be processed through the Department of Industrial Relations and 8 grievances may be appealed up to Level Two of the grievance procedure. Copies of 9 safety reports from this and any other government agency shall be promptly forwarded to 10 the Association.
11 11.2 The District shall take reasonable action to identify and eliminate unsafe working 12 conditions and activities.
(a) Should a unit member feel that such a condition or activity exists, the immediate 15 five (5) days to correct the condition or shall promptly inform the unit member of the 16 reasons for inaction. Should a unit member feel that there is immediate danger to the 17 unit member’s health, the unit member shall report that danger immediately to the 18 supervisor. If the supervisor determines that such a danger exists, immediate action 19 shall be taken by the supervisor.
(b) Whenever the District receives a report on a suspected condition which may be a 21 threat to the health and safety of any bargaining unit member, such complete report 22 shall be given to the affected employee and to the Association within ten (10) 23 working days of receipt of the report.
24 11.3 Should a unit member feel that a student assigned to the unit member’s classroom has a 25 contagious disease or infestation, the unit member shall immediately send the student to 26 the site level administrator. It shall be the site level administrator’s responsibility to get 27 the student to a school nurse. Until the nurse has determined that the student does have a 28 contagious disease or infestation, the student shall not be allowed back to the classroom.
