WAR SERVICE SICK LEAVE. 40.1 Eligible employees will generally be granted war service sick leave while unfit for duty because of a war-caused condition.
40.2 A war-caused condition means an injury or disease of an employee that has been determined under the relevant legislation to be war-caused or defence-caused.
40.3 Eligible employees will accrue a credit of nine weeks on commencement in the APS and an annual credit of three weeks for each year of APS service. Unused credits will accumulate to a maximum of nine weeks.
WAR SERVICE SICK LEAVE. The Secretary will grant war service sick leave to employees who are unfit for duty because of a war-caused or defence-caused condition that has been determined under the Veterans’ Entitlements Act 1986 and/or the Military Rehabilitation and Compensation Act 2004.
WAR SERVICE SICK LEAVE. 100.1 Where the Department of Veteran’s Affairs has issued a statement to an employee certifying that a condition is a war-caused medical condition, absences on War Service Sick Leave may be approved on the basis of a certificate from a recognised medical practitioner stating the absence is due to that condition.
100.2 Employees may accrue two separate credits:
a) on commencement in the APS, a special credit of nine weeks War Service Sick Leave
b) annual credit of 3 weeks.
100.3 Unused annual credits accumulate, subject to a maximum credit balance of 9 weeks.
100.4 Leave may not be granted from the annual credits until the special credit is exhausted.
WAR SERVICE SICK LEAVE. (1) Employees who are unfit for duty because of:
(a) war-caused or defence-caused injury as determined by the Veterans’ Entitlements Act 1986;
(b) war-caused or defence-caused injury as determined by the Safety, Rehabilitation and Compensation Act 1988; or
(c) an illness or injury contracted during a period of warlike or non-war like service as declared under the Veterans’ Entitlements Act 1986 or the Military Rehabilitation and Compensation Act 2004; will be granted war service sick leave.
(2) Employees who are eligible war veterans will accrue two separate credits of paid war service sick leave:
(a) Special credit – 9 weeks war service sick leave credited on commencement with the APS.
(b) Annual credit – 3 weeks annual credit on commencement and again following each 12 months of service. Unused credits accumulate up to a maximum credit balance of 9 weeks. This credit cannot be accessed until the special credit has been exhausted.
(3) Employees who rejoin the APS following an earlier period of APS employment in which they had been credited with war service sick leave will be credited with:
(a) any special credit that remained unused at the final day of the prior APS employment; and
(b) any annual credit held on the final day of the prior APS employment.
WAR SERVICE SICK LEAVE. Employees with certain Defence Force Service prescribed by the Veterans’ Entitlement Act 1986 are eligible for additional sick leave in relation to war-caused medical conditions.
WAR SERVICE SICK LEAVE. The Secretary will grant war service sick leave to employees who are unfit for duty because of a war-caused or defence-caused condition that has been determined under the Veterans’ Entitlements Act 1986 and/or the Military Rehabilitation and Compensation Act 2004. Eligible employees are allotted a nine week special credit of war service sick leave on commencement of employment or on determination that the injury or disease is war-caused or defence-caused. Each year thereafter, a three week credit is allocated subject to a maximum annual credit balance of nine weeks. If the employee was eligible for war service sick leave during a previous period of Australian Public Service employment, on re-joining the Australian Public Service any unused accrued annual credits can be brought forward, subject to the maximum annual credit. Approval is subject to the provision of a medical certificate stating the nature of the medical condition and a statement from the Department of Veterans' Affairs stating the medical condition is a war-caused condition. Leave from annual credits may not be granted until the special credit has expired. Where an employee’s war service sick leave credits have been exhausted, the employee may apply for personal/carers leave in respect of a war caused injury or illness. War service sick leave counts as service for all purposes. Leave that counts as service for personal/carers leave purposes will count as service for war service sick leave purposes.
WAR SERVICE SICK LEAVE. 55.1 Employees may be eligible for war service sick leave while unfit for duty because of a war caused condition.
55.2 A war caused condition means an injury or disease of an employee that has been determined under the Veteran’s Entitlements Act 1986 to be war caused or defence caused.
55.3 Employees who have served in the Australian Defence Forces in a war, conflict or peace keeping operation will receive 9 weeks special war service sick leave credits on engagement or on return from the war, conflict or peace keeping operation.
55.4 Eligible employees shall, subject to clause 55.6, receive further war service sick leave credits 12 months after they last received war service sick leave credits using the formula in clause 53.26 but using 3 as the value for C, in place of 4.
55.5 An employee, who has previously been employed in the APS and had war service sick leave credits available at the time he/she left the APS, will be entitled to war service sick leave credits equivalent to unused credits from their previous APS employment.
55.6 War service sick leave credits, not including the special credits received on engagement, will accumulate from one year to the next up to a maximum of 9 weeks.
55.7 Approval of war service sick leave will be subject to available credits and the provision of a medical certificate stating the nature of the medical condition and a statement from the Department of Veterans’ Affairs or its successor, stating that the medical condition is a war caused condition.
55.8 Approved war service sick leave will use the special war service sick leave credits allocated on engagement before using the annual credits.
55.9 War service sick leave counts as service for all purposes.

40.4 The special credit must be used before the annual credits. Where an employee’s war service sick leave credits have expired, personal leave provisions will apply.
40.5 Approval of a grant of war service sick leave will be subject to the provision of a medical certificate stating the nature of the medical condition and a statement from the Department of Veterans’ Affairs stating the medical condition is a war-caused condition.
40.6 Leave that counts as service for personal leave purposes will count as service for war service sick leave purposes.
WAR SERVICE SICK LEAVE. 212. Employees with a war-caused or defence-caused injury as prescribed in the relevant legislation are entitled to war service sick leave.
WAR SERVICE SICK LEAVE. 43.1 An employee, who was formerly a member of the Australian Defence Force, may be entitled to be credited with War Service Sick Leave if the employee has a medical condition, accepted by the Department of Veterans’ Affairs to be war caused or Defence caused within the meaning of the Veterans’ Entitlements Act 1986, the Military Rehabilitation and Compensation Act 2004 or any future applicable legislation.
43.2 Eligible employees will accrue a special credit of nine weeks on commencement in the APS and an annual credit of three weeks for each year of APS service. Unused credits will accumulate to a maximum of nine weeks.
43.3 An eligible, affected employee may only utilise these credits when they are certified unfit for duty due to that accepted war caused or Defence caused condition specifically.
