Yard Closure. During the term of this Collective Agreement, the Employer shall not close any existing highways yards except by mutual agreement between the Employer and the Union unless the highways yard closure is brought on by the B.C. Provincial Government. If the B.C. Provincial Government and the Employer are engaged in any discussions that involve a proposed closure or closure of a current highway yard the Employer will at the earliest possible time call a meeting of the Joint Labour/ Management Committee to discuss all related matters involved in the yard closure as it would relate to employees. If it is determined that the B.C. Provincial Government is going to close a yard the following shall occur:
(1) The Employer shall call for a meeting of the Joint Labour/Management Committee at the earliest possible time upon being aware of a closure.
(2) The Joint Labour/Management Committee shall assess the impact on the employees and shall review options available under this Collective Agreement for the employees affected. These options shall include but not be limited to:
(i) Other work assignments that may be available within the seniority block where the highway yard closure is to take place;
(ii) Relocation to another highways yard;
(iii) Options under Article 13;
(iv) The Parties may review other options outside of the Collective Agreement. If options are agreed to by the Joint Labour/Management Committee, the effected employees would have to also be in agreement before implementation.
(3) If the Parties are not able to agree on a remedy to a B.C. Provincial Government sponsored closure of an Employer's highway yard operation, the Parties shall refer the matter to arbitration as outlined in Article 9.
Yard Closure. Should operational requirements or change in required work result in the decision to close a yard or office, the Employer agrees to advise and consult with the Union in accordance with the requirements of Section 54 of the Labour Relations Code, at least sixty (60) days before the closing, so that an understanding may be reached regarding affected employees. Additionally, the Employer agrees to maintain at least one (1) permanent point of assembly in each of the Vancouver Island seniority blocks.
Yard Closure. Should the Employer decide to close a yard, and/or mechanical facility and/or classification series, those regular employees so affected may be offered work in another seniority block and be offered relocation expenses, upon production of receipts, to a maximum of four thousand dollars ($4,000). Employees already residing in the new seniority block will not be entitled to relocation expenses.

Yard Closure. The Employer is committed to continued improvement in providing services for the public. Should a yard closure or relocation occur, the Employer and the Union shall meet to ensure that the resultant transition is smooth. All redundancies, if created, will be dealt with through attrition or early retirement. Where consolidations occur, the following actions will be undertaken:
1) Maintain separate holiday schedules for two years.
2) Integration of crews, with respect to work assignments and substitution, will take effect after one year at new yardsites.
3) Auxiliary crews will be integrated immediately.
4) Regular dispatch will utilize local knowledge and experience.
5) The Joint Labour Management committee is charged with resolving with the implementation process during the transition period.
6) In the event that there are vacancies in the consolidated yardsite, qualified regular employees outside the core group shall be entitled to fill the vacancy. Issues resulting from amalgamation shall, if not resolved locally, be dealt with at the Joint Labour Management Committee.
Yard Closure. Except for circumstances beyond the control of the Employer, there will not be a closure of any existing yards, mechanical facility or office. Permanent and seasonal camps shall remain operational as per past practise except by mutual agreement between the Employer and the Union.
Yard Closure. In the event of a yard closure auxiliary employees shall be entitled to bump junior employees in unaffected yards.
Yard Closure. It is not the intent of the Employer to close any existing yard, mechanical facility, bridge yard, or office. However, where yard adjustments are initiated or required by the Province of British Columbia, the Union and the Employer shall meet to ensure that any changes shall not result in the layoff or reduction of any bargaining unit member or positions.
Yard Closure. During the term of this Collective Agreement, there will not be a closure of any existing yard, mechanical facility or office. Permanent and seasonal camps shall remain operational as per past practice, except that mechanical maintenance in 50 Mile Camp will be subject to operational requirements.
