Transfer Without Posting. The Labour Management Committee may recommend lateral transfers or voluntary demotions within the company, for compassionate or medical reasons. Compassionate or medical reasons shall be defined as but not restricted to the following:
(a) Illness of employee or family members requiring medical attention which is unavailable in the immediate area, e.g. spouse or dependent with kidney problems requiring dialysis on a regular basis.
(b) Handicapped family members who require attention, which is unavailable in the immediate area; for example, blind or deaf dependents who require special schooling.
(c) Health circumstances which leave the member in a position where he is unable to work at the existing location.
Transfer Without Posting. The Employer and President of the Union or designate jointly have the authority to grant lateral transfers or voluntary demotions, to vacancies, without posting for:
(a) compassionate or medical grounds to employees who have completed their probationary period; or
(b) employees who have become incapacitated by illness or injury. Such jurisdiction is not limited to initial placement but is retained for subsequent moves should it become necessary.
Transfer Without Posting. The Labour/Management Committee may recommend a lateral transfer or voluntary demotion for: compassionate or medical grounds to employees who have completed their probationary period; employees who have become incapacitated by an illness or industrial injury. The Committee will recommend the placement of an employee into a vacancy prior to posting pursuant to Clauses 12.1 and 12.2.
Transfer Without Posting. The College and Union jointly have the authority to grant lateral transfers or voluntary demotions, to vacancies, without posting for:
(a) compassionate or medical grounds to employees who have completed their probationary period.
(b) all employees who have become incapacitated by industrial illness or industrial injury arising out of employment at the College. Such jurisdiction is not limited to initial placement but is retained for subsequent moves should it become necessary.
Transfer Without Posting. The parties agree to discuss requests received under this article. The Employer and Union jointly have the authority to grant lateral transfers or voluntary demotions, to vacancies, without posting for:
(a) all employees who have become incapacitated by industrial illness or industrial injury arising out of employment at the University. Such jurisdiction is not limited to initial placement but is retained for subsequent moves should it become necessary,
(b) medical grounds to employees who have completed their probationary period,
(c) compassionate or special circumstances to employees who have completed their probationary period. Each situation will be considered on an individual basis by Human Resources and the Union. Where requests for transfers are for compassionate reasons or special circumstances, and suitable vacancies do not currently exist, employees shall be placed on a transfer list until a suitable vacancy becomes available. Employees may opt to remain in their current position or apply for leave of absence under Clause 25.8. In the case of an employee who seeks the benefit of this provision as the result of medical problems, illness, or injury, the employee will be placed on the transfer list when the employee has been declared by their physician to be medically fit to return to work. Suitable vacancies will be determined jointly by the Union and the Employer.

Transfer Without Posting. The Labour/Management Committee may grant lateral transfers or voluntary demotions for compassionate or medical reasons or in recognition of the joint duty of the parties to accommodate employees in accordance with the Human Rights Code. In the event that the Committee has granted a transfer or demotion at the request of the employee, the employee shall not be eligible for any job posting for a period of six months without the approval of the Labour/Management Committee. Part-time employee transfer requests will be considered based on the following criteria:
(a) The request is submitted in writing;
(b) There is a need for staff at the location where the employee wishes to transfer;
(c) It must be operationally feasible;
(d) It does not cause seniority displacement;
(e) If seniority displacement is a concern, the case will be reviewed at Labour Management.
Transfer Without Posting. (a) Lateral transfers or voluntary demotions may be granted, without posting for:
(1) compassionate or medical grounds to regular employees who have completed their probationary period;
(2) all employees who have become incapacitated by industrial injury or industrial illness.
(b) In such cases the Joint Labour/Management Committee shall consider any applications or requests presented to the Committee. Each request for special consideration shall be judged solely on its merit.
Transfer Without Posting. The Labour/Management Committee may grant lateral transfers or voluntary demotions within the Company, for compassionate or medical reasons. The Labour/Management Committee may place an employee into a vacancy prior to filling as per Clauses 12.1 and 12.2.
