Filling of Temporary Vacancies. 1. A temporary vacancy need not be posted unless the position is for a full school year (exception for illness/ disability leaves). 2. A temporary vacancy shall first be offered to a NCP staff on layoff under the terms set forth in Article 16. 3. If the temporary vacancy is not filled according to paragraph 2 above, the District shall promptly fill the position by a transfer.

Filling of Temporary Vacancies. (a) If the provisions of Clause 13.1(c) are not met, the Employer shall fill vacancies of a temporary nature created as a result of a regular employee using any provision of this Collective Agreement (with the exception of annual vacation or CTO) which results in an absence which exceeds 30 calendar days. (b) Where a temporary vacancy occurs pursuant to Clause 12.6 (a) above, the Employer shall on the 29th day offer the position to employees within the seniority block as follows: (1) senior qualified regular employee in the classification series; (2) senior qualified auxiliary employee. (c) Where subsequent vacancies are created as a result of Clause 12.6(b), the Employer agrees to fill those vacancies immediately and shall offer those positions to employees within the seniority block as follows: (1) senior qualified regular employee in the classification series; (2) senior qualified auxiliary employee. (d) It is understood that employees who fill vacancies temporarily shall return to their former position and status should the employee referred to in Clause 12.6(a) return to their regular position. (e) Vacancies created as a result of a regular employee's absence on long-term disability or Workers' Compensation shall be considered a regular vacancy for the purpose of Clause 12.2 on the date the employee is determined to be totally and permanently disabled from his/her own occupation. (f) Seasonal supervisory positions shall be posted and will be filled on the basis of merit and seniority in accordance with 12.

With regards to such vacancies the Employer will post all days of the temporary vacancies for a minimum of seven (7) calendar days including Saturday, Sunday and Holidays. The posting shall include regularly scheduled days of work including start and end times. During this period, all qualified part- time, float, and per diem employees may bid on any regularly scheduled day or days of the temporary vacancy. b. Posting(s) will be awarded in order of seniority by availability to work the entire position followed by seniority for the caregivers who are only available to work specific shift or shifts, provided that the scheduling of these hours does not result in the prescheduling of overtime. Shifts assigned to float employees in this manner shall count towards two prescheduled shifts per week. c. For temporary vacancies that are not filled in their entirety as described in d. Temporary vacancy assignments terminate at the point that the vacancy no longer exists, or that the assignment extends past the initially posted expiration of the vacancy unless mutually agreed to between the employer and the employee.

Filling of Temporary Vacancies. IN A LINE OF PROGRESSION (a) LINES OF PROGRESSION OTHER THAN CRANE LINES (i) Vacancies of a temporary nature shall be filled by the senior person in the Line of Progression on the crew in the job immediately below for a period of up to ten (10) calendar days, whenever possible. If the Company has prior knowledge the vacancy is to last longer than ten (10) calendar days, but less than forty-five (45) calendar days, the vacancy shall be filled in this same manner and the senior person from the Line of Progression in the job immediately below will also be paid at the higher rate. The resulting vacancy at the bottom of the line shall be filled by a Spareman on shift. If a vacancy cannot be filled in the manner above because of an inability of an employee in the line of progression to move, a Spareman may fill a resulting vacancy above the entry level position. (ii) A Crane Replacement Operator who is not required to operate a crane may be assigned to fill a temporary vacancy in a ground line of progression, but only in an entry level position. (iii) Any vacancy that cannot be filled by a Spareman or Crane Replacement Operator in the manner described above will be filled in accordance with Article 25, Overtime Opportunities. (iv) When a temporary vacancy is expected to extend beyond forty-five (45) calendar days, the senior person (job seniority) in the job immediately below the vacancy shall be entitled to move up to fill the vacancy, with those below progressing in the line in the same manner as required to fill resultant vacancies. If the senior employee(s) at each level in the line of progression declines the move, the employee at that level with the least amount of job seniority will be required to move up to fill the vacancy. When the need to fill the temporary vacancy ends, all of the moves shall be reversed, and the employees will regress down the line of progression in the same manner in which they progressed upwards. (v) Where a temporary vacancy is caused by a vacation, the time limit of ten

Filling of Temporary Vacancies. (a) Where a temporary vacancy occurs which is of a known duration of sixty (60) days or more the position will be offered to qualified employees in the seniority block in seniority order as follows: • regular employees within the classification; • regular employees within the classification series; • auxiliary employees within the classification series; • regular employees within other classification series; • auxiliary employees in any other classification series. (b) Where a temporary vacancy cannot be filled in accordance with (a) above it will be offered to qualified employees in the bargaining unit in seniority order as follows: • regular employees within the classification; • regular employees within the classification series; • auxiliary employees within the classification series; • regular employees within other classification series; • auxiliary employees in any other classification series. (c) Where a temporary vacancy cannot be filled in accordance with (a) or (b) above the Employer will hire a new employee to fill the temporary vacancy.
Filling of Temporary Vacancies. (a) Should the Employer decide to fill a temporary vacancy the following process will be followed within specific seniority blocks: (1) senior qualified regular employee in the classification series; (2) senior qualified regular employee in another classification series; (3) senior qualified auxiliary employee. (b) Vacancies created as a result of a regular employee's absence on Long-Term Disability, ICBC, or Workers' Compensation shall be considered a regular vacancy for the purpose of Clause 12.7 on the date the employee is determined to be totally disabled from their own occupation, at which time they will be removed from the seniority list. (c) It is understood that employees who fill vacancies temporarily shall return to their former position and status should the employees referred to in Clause 12.19 (a) return to their regular position.
Filling of Temporary Vacancies. 1. A temporary vacancy need not be posted. 2. A temporary vacancy shall first be offered to a person on layoff within that classification and who is qualified to perform the duties of the temporarily vacated position in accordance with the recall provisions set forth in Article 10. 3. Temporary vacancies may then be filled through temporary transfer or employment of outside temporary workers at the Employer’s discretion.
