Administrative Initiated Transfers. 5.3.1 Notice of an involuntary transfer or reassignment shall be given to teachers as soon as possible. A list of these teachers, current positions, and new assignments, when made, shall be given to the ETA President.

Administrators will consider skill level, experience, certification/licensure, and other teachers who may volunteer for open positions when initiating a teacher transfer. Consideration will also be given to the last time the teacher was moved. If not notified prior to two weeks in advance of the school year, the teacher making the involuntary move (building, room, or grade) will be paid $250.00 for consideration of lost time during the move.

Administrative Initiated Transfers. 1. An administrative initiated transfer (duties as assigned) shall be made only after a meeting between the certified employee and the building administrator. Where applicable, the certified employee will be given verbal/written the reason(s) for the transfer in writing at the time of meeting. Transfers will be made only to positions in which they are properly certified.

Administrative Initiated Transfers. When an enrollment decrease necessitates transfer or when another school has a greater need for an employee’s specialized services, the local administrator shall determine if there are volunteers from the designated subject field(s) by communicating with all members of the department at a school site. In designating the transferee, the local administrator shall consider the following criteria: credentialing, years of service in the District, experience, extracurricular assignment, and department leadership. An employee who has received an unsatisfactory evaluation in any assignment may be transferred to provide an opportunity for improvement. The proposed transferee will be notified of his/her pending transfer in a personal conference with the local administrator. The reasons for this transfer will be explained at this conference at which an Association representative may be present if requested by the employee or the local administrator. An employee being transferred via an administrative initiated transfer, may request a written rationale for the transfer, which will be provided within twenty (20) working days of the transfer meeting. Normally, transfers will be processed according to the above criteria. However, if in the opinion of the Superintendent a transfer becomes necessary, the Superintendent or his designee will notify the employee and offer a personal conference, at which an Association representative may be present (at the request of the transferee) to explain the reasons for the transfer. If requested, a transferred employee will be provided written rationale as to why a transfer is necessary and how the relevant criteria were applied in choosing the transferee. A transferred employee shall not be involuntarily transferred again for at least three school years if an appropriate assignment exists at the school. All administrative initiated transfers are subject to the grievance procedure.
