TEACHER TRANSFER. Transfer shall be defined as reassigning a teacher to a different building, subject area, or grade level (elementary). The transfer of staff members in the Mentor School District shall be made by the Superintendent of Schools. The prime factor in making transfers will be the school system's needs. The factors that the Superintendent is to consider in affecting transfers of professional personnel will be:
a. Contributions that staff members could make toward the fulfillment of the goals and objectives of the school system.
b. Satisfying personnel needs.
c. Meeting the needs of the pupils.
d. Qualifications of personnel available, involved, and/or interested in a new or vacant position as well as a position to be vacated.
e. The desires of an individual staff member, his/her tenure in the school system, and the potential for continued growth and development in an assigned position.
TEACHER TRANSFER. During the first six (6) weeks of a school term, teachers will be advised of the transfer criteria to be used during the school term. Changes and/or modifications in the transfer criteria will be communicated to the teachers. Teachers wishing to voluntarily transfer positions must follow District application procedures by applying for open posted positions. Before the Board affects the transfer(s) of any teacher(s), it shall notify the Association regarding such transfer(s). Written notification of transfer(s) will be given to the teacher(s) not less than thirty (30) calendar days before the end of the school year. In the event of transfer(s) occurring during the summer months, or in special situations where such notice is not possible, this requirement may be waived, provided that the Board shall notify the teacher(s) and the Association of the transfer(s) as soon as possible.
TEACHER TRANSFER. For the purpose of this section, transfer means a change in position from one school to another operated by an Employer after first having been employed by the Employer. School buildings within administrative consolidations shall be considered as individual schools for purposes of this section.
28:01 A teacher who is under contract with an Employer may be transferred or request a transfer to a different school. Any transfer under this subsection shall be by mutual consent of the Employer and teacher, and after consultation among the Director and principals involved.
TEACHER TRANSFER. 7:1 Recognizing that in the New Britain Public School District there exists a need for a transfer policy based upon seniority and qualifications, and that teachers will plan their movements, aspirations and professional development in accordance with this policy, the details of an orderly transfer policy based upon these principles are set forth in the procedures which follow.
7:2 A list of the specific vacancies that occur in each building or responsibility center shall be made available to all staff by the Superintendent within ten (10) days following the adoption of a proposed budget, but in no event later than August 1. The Superintendent may post earlier vacancy lists in all schools for a minimum of ten (10) school days and fill such vacancies in accordance with Section 7:3, below, in order to hire new teachers earlier than the main vacancy list is distributed. Once a position is posted and filled, it does not have to be re-posted on any subsequent lists. Additional hours that become available for Adult Education Teachers will be posted and offered to the most senior qualified Adult Education Teacher on a rotating basis. The parties agree that the Board may post at any time during the school year vacant positions which were not posted by August 1 of the prior school year. Any additional posting by the Board shall be posted in all schools for a minimum of ten (10) school days and those vacancies will be filled in accordance with Article 7:3 of the labor agreement. Once a position is posted it does not have to be re-posted on any subsequent vacancy list, (although the Board may choose to post any remaining vacancies on the final vacancy list in July.)
7:3 Teachers may submit a list to the Personnel and Talent Management Department of the specific positions on the vacancy list to which the teacher requests transfer. Major consideration shall be given to teachers having seniority in the District, so long as a system-wide balance of experienced teachers is maintained, and so long as the best interests of the School District are consistent with such voluntary transfer(s). Newly hired teachers must remain in the position for which they were hired until they achieve tenure. Newly hired teachers who are displaced must post for the position in which they were hired and once awarded a position from the vacancy list will not be permitted to transfer until they achieve tenure.
TEACHER TRANSFER. Whenever it is necessary to transfer a teacher from one school to another, it is agreed:
a. The Superintendent shall take into consideration seniority and the wishes and convenience of individual teachers to the extent that they do not conflict with the best interest of the system.
b. When an involuntary transfer of a teacher is necessary, the Superintendent or designee shall consider areas of competence, major and/or minor fields of study, quality of teaching performance and length of service in the system. An involuntary transfer will be made only after a meeting with the teacher involved and the Superintendent or designee (or the employee’s designee), at which time the teacher will be notified of the reason for the transfer. When the above areas are relatively equal, the least senior teacher shall be transferred.
c. No teacher shall be involuntarily transferred, except to a position for which the employee has been licensed pursuant to General Laws (Ter. Ed) Chapter 71.
d. Notice of transfer will be given to the teacher concerned as soon as practicable and, in normal circumstances, not later than July 1st, if the transfer is intended to take effect in September.
e. In the event that a teacher desires to be transferred, the employee shall file a written statement thereof with the office of the Superintendent or designee not later than April 1st. The Superintendent or designee shall, as soon as practicable and under normal circumstances, at least one (1) week prior to the end of the school year, inform the teacher of the action taken relative to the request.
f. No teacher shall be assigned or transferred to any school unless the principal thereof has been consulted relative to such assignment or transfer.
g. It is agreed that the final decision as to the transfer of a teacher is the responsibility of the Superintendent.
TEACHER TRANSFER. Teachers desirous of transfer may inform the Superintendent by completing the "Teacher Intent Form" (Exhibit “C”). The intent form will be kept on file for the school year indicated on the form.
5.07.5.1 When a teacher is interested in a posted vacancy the teacher shall apply, in writing, by the given deadline to the administrator indicated in the posting.
5.07.5.2 All current teacher applicants for the posted vacancies shall be offered an interview.

26:01 A teacher who is under contract with an Employer may be transferred or request a transfer to a different school. Any transfer under this subsection shall be by mutual consent of the Employer and teacher, and after consultation among the superintendent and principals involved.
(a) Notwithstanding 26:01, a teacher under contract with an Employer may be transferred to a different school if:
1. The number of teaching positions allocated to the school is reduced;
2. The school is permanently closed; or
3. A change in curriculum makes the position non-existent.
(b) If a transfer is to occur under this subsection, the teacher involved shall be advised by registered letter from the Employer at least one (1) month in advance of the date of the transfer and, wherever possible, no later than October 31 of the relevant school year. To the extent that it is possible, the position to which the teacher is being transferred shall be similar to the position which the teacher is leaving. If a transfer is to occur under this subsection, the teacher involved shall have the right to take a leave of absence which shall not exceed one year in duration or resign without prejudice within twenty (20) days of the receipt of notice of transfer.
(a) A teacher may initiate a request to transfer to any position posted in accordance with Subsection 32:02 of this Agreement.
(b) The decision of the Employer with respect to the request initiated under Subsection 26:03 (a) shall be based upon the qualifications, ability and suitability to fill the requirements of the position to which the teacher has requested to transfer. In the event the qualifications, ability and suitability of two or more teachers are determined by the Employer to be equal, the teacher with the greatest amount of service with the Employer shall be granted the transfer.
26:04 A teacher who holds an administrative position may be transferred only to another administrative position which has the same designation and if the teacher meets the minimum qualifications established for the position. TEACHER TRANSFER. A teacher transfer to which the provisions of this Article apply is limited to the following situations.
a. A change in a teacher's teaching assignment which results in the location of the teacher's duties being changed from the building(s) in which the teacher has been teaching to one or more other buildings;
b. A change in a teacher's teaching assignment which results in the teacher's duties being shifted for more than half of his/her contracted time from one or more teaching assignment categories in which the teacher has been teaching to another or other teaching assignment categories; or
c. Change in a teacher's teaching assignment which results in the teacher teaching in a grade level(s) different from those in which she or he has been teaching where said change is across three or more grades. The grade level(s) in which the teacher has been teaching shall not be included as one of three grades.
TEACHER TRANSFER. I. It is agreed that the Principal of a school, at his/her request, shall have the right to discuss the assignment of a teacher to his/her staff whenever possible before the assignment takes place. Information concerning a teacher's qualifications, background and experience shall be made available to him/her on request. If, in the opinion of the Principal, the proposed teaching assignment is inappropriate, the Principal's request that the assignment not be made shall be reviewed by the Superintendent. It is agreed that the Principal of a school shall have the right to discuss the removal or transfer of a teacher from his/her staff before such action is taken except where the teacher asks that his/her request for transfer be held in confidence.
II. The policy of giving consideration to the request of a Principal that a teacher be transferred from his/her staff for cause shall be employed.
TEACHER TRANSFER. A. Requests for transfer should be submitted in writing using the District’s intent form. Consideration shall be given to internal candidates. If the transfers are to be made, the teacher shall be notified prior to the last day of school whenever possible.
B. A teacher who is involuntarily transferred will receive written notification of the reasons, which shall not be arbitrary, capricious, or unreasonable. If an involuntary transfer is necessary, consideration will be given to seniority, certification/licensure, and experience in the areas of transfer.
