BY PAY. An employee who is required to “stand-by” for possible re-call to work shall receive two (2) hours pay at their regular rate of pay for each stand-by period of twenty-four (24) hours or fraction thereof (Example: one (1) to twenty-four (24) hours = two (2) hours pay; twenty-four (24) to forty-eight (48) hours = four (4) hours pay). Employees placed on stand-by status shall provide management with a telephone number where they can be reached during the stand-by period. If the employee changes locations during the stand-by period, they shall provide management with the new number where they can be reached. Employees who have been placed on stand-by status who management cannot reach at the number provided, or are unable to report when reached, shall be subject to disciplinary action. Stand-by pay does not count as hours worked for the purpose of overtime computation.
BY PAY. In the event an employee is required to stand-by for any reason, such employees be paid their regular rate of pay for such hours, or two (2) hours pay, whichever is greater.
BY PAY. Any member of the Fire Prevention Division who is required to stand-by shall receive one (1) hour's pay at straight time rates for nights falling on Mondays through Fridays. Stand-by pay for each Saturday, each Sunday and each Statutory Holiday shall be at the rate of three and one-half (3½) hours straight time. Payment for stand-by shall be on the employees’ pay cheque. On any call-out from stand-by, the employee shall be paid at a rate of time and one-half over and above his stand-by time. Payment shall be on the employees’ pay cheque.
BY PAY. In accordance with the provisions of this Agreement the Company shall schedule the sailing of all trawlers which shall be the scheduled sailing time. Within the turnaround period the Company may: Set a scheduled sailing time for any scheduled sailing period; Advise that the trawler will not be scheduled to sail within six days from the end of the turnaround period due to mechanical problems, in that event stand-by pay shall not apply unless the trawler is actually scheduled to sail within the six day period, at which time for the purpose of calculating stand-by-pay, the trawler will be deemed to have been scheduled to sail in the first scheduled sailing period following the turnaround period; Not schedule the trawler to sail due to mechanical problems in which case, for the purpose of calculating stand-by-pay, the trawler will be deemed to have been scheduled to sail in the first scheduled sailing period following the turnaround. BY PAY. An employee who is required to remain available for duty on stand-by, outside the normal working hours for that particular employee, shall receive stand-by pay in the amount of per shift.

When a scheduled sailing of a vessel is delayed because of mechanical problems (problems related to hull and machinery, navigation and fish finding aids), refit except- ed, the Company will pay, at the commencement of the next calendar day, the crewmembers who were available for the scheduled sailing, up to a maximum of three (3) days’ stand-by pay at the rate of fifty dollars ($50.00) per day prorated to the nearest hour, effective November fifty-two dollars ($52.00) per day prorated to the nearest hour. When a vessel sails and returns to port within two (72) hours due to mechanical problems (problems related to hull and machinery, navigation and fish finding aids) and the crew is released, the Company will pay at the commencement of the next calendar day up to a maximum of three (3) days at the rate of fifty dollars ($50.00) per day prorated to the nearest hour, effective November fifty-two dollars ($52.00)per day prorated to the nearest hour. In order to qualify for payment under and crewmembers must be available to sail and sail on the resche- duled sailing time, provided such rescheduling takes place wi- thin fourteen (14) days of the original tie-up. When an employee is required to be on stand-by duty the employee shall receive per hour for each hour of stand-by in addition to any monies received by virtue of being called in to perform work on account of the stand-by duty. The Employer will provide transportation expenses to and from the Hospital for each required during the periods of stand- Effective the start of the first pay period following ratification (February 1989) when is required to be on stand-by duty the employee shall receive two dollars and ten cents per hour for each hour of stand-by in addition to any monies received by virtue of being called in to perform work on account of the stand-by duty. However, it is understood and agreed that stand-by pay will no longer be payable when the employee is called in. Any unit member who is placed on stand-by duty other than on a recognized holiday shall receive pay at the rate of 1/2 times their straight time hourly rate of pay for all hours they are on stand-by. On recognized holidays the unit member assigned to stand- by shall be paid 3/4 times their straight time hourly rate of pay.

Where the Employer requires an employee to be available on stand-by during off-duty hours, an employee shall be entitled to a stand-by payment of equivalent to three- quarters of regular straight time hourly rate for each eight (8) consecutive hours or portion thereof, that is on stand-by; An employee designated by letter or by list for stand-by duty shall be available during period of stand-by at a known telephone number and be available to return for duty as quickly as possible if called. If designating employees for stand-by, the Employer will endeavour to provide for the equitable distribution of stand-by duties; No stand-by payment shall be granted if an employee is unable to report for duty when required; An employee on stand-by required to report for work shall be paid in addition to the stand-by pay, the greater of: The applicable overtime rate for the time worked; or The minimum of four (4) hours pay at the straight time rate, except that this minimum shall only apply once during a stand-by period; Where, during any eight (8) consecutive hours of stand-by, an employee is required to report to work on more than one (1) occasion and has already utilized option above, the employee shall be paid for hours worked the greater of:
