Charter Service. ‌ (a) Prohibitions. The Recipient agrees that neither it nor any Third Party Participant involved in the Award will engage in charter service, except as permitted under federal transit laws, specifically 49 U.S.C. § 5323(d), (g), and (r), FTA regulations, “Charter Service,” 49 CFR Part 604, any other federal Charter Service regulations, federal requirements, or federal guidance.
Charter Service. Except as FTA determines otherwise in writing, the Recipient understands and agrees that:
Charter Service. Charter service will be listed on the Extra Board Mark-Up and filled off the Extra Board, as shown in Article 13 of this Contract.
Charter Service. The Bus Company shall be the nonexclusive provider of charter bus service to the schools of the District.
Charter Service. The Bus Company agrees to furnish, upon request and in accordance with rates provided for in the Transportation Proposal Form and made part of this Agreement, such buses as the school system may need for transporting school children on field trips during the school day, for transporting students to athletic events, and to other school-sponsored activities in or outside the District. The District shall have the first priority for the use of the buses of the Bus Company for services specified in this Agreement, including field trips and extra-curricular activities. The District shall attempt to provide a minimum of five (5) days’ notice to the Bus Company for field trip and athletic transportation requests. CHARTER / LATE BUS INTERFERENCE WITH REGULAR SERVICE The Bus Company is obligated to provide service for charters and/or late busses only up to the maximum spare factor as defined in section 2.07 of this Agreement during route time for regular AM and PM transportation service. The Bus Company shall make all reasonable attempts to fulfill charter and late bus service during high capacity situations but has the right to refuse charter or late bus service that exceeds the spare bus requirements during AM and PM routes. The Bus Company also has the right to charge a premium for bringing equipment/drivers in from operations from outside the local Elmbrook terminal to fulfill the service in these situations. The intent of this maximum is busses that are running concurrently and not intended to be a daily maximum. LATE BUS/CHARTER CANCELLATION The District reserves the right to cancel charter and/or Late Bus service on those days on which they are not needed or desired. The District shall notify the Bus Company of such cancellation no later than four (4) hours in advance of the scheduled trip or service. A charge of $150.00 will be assessed to the District for cancellations less than four (4) hours’ notice. For weather-related cancellations, the District will be assessed a $75.00 charge. No charge shall be made by the Bus Company to the District for charter and/or Late Bus service that has been canceled with more than four (4) hours’ notice. The Bus Company shall not cancel a charter or alter its schedule once it has been con- firmed to the District, without District approval. Any failure by the Bus Company to perform confirmed charter service on schedule shall result in a $150.00 fine payable by the Bus Company to the District within 30 days. SUMMER SCHOOL TRAN...

Contractor shall comply with 49 USC 5323(d) and (r) and 49 CFR part 604, which state that recipients and subrecipients of FTA assistance may not provide charter service using equipment or facilities acquired with Federal assistance if there is at least one private charter operator willing and able to provide the service, except as permitted by:
Charter Service. A. When a driver is taken off his/her regular run to fulfill charter service hours in excess of regular run the employee shall be paid at the regular rate of pay. Under this condition the driver shall not receive less than his/her regular scheduled run pay. Out-of-District charters shall pay a minimum of 4 hours pay. Out-of-District charters where the employee is required to be away from home overnight shall receive a minimum of 8 hours pay in each 24-hour period away from home. This period time shall start when the driver is required to report for work or charter. All charters required to be away from home overnight shall receive meal and lodging accommodations as per School Board policy. Daily charters after 8 hours operating within the District will be paid for at least 1 meal. Meal allowance will be in accordance with the District's current travel policy. The employee will receive 2 times the current hourly rate of pay for any driving time after 12 o'clock midnight. If any combination of regular runs and daily charters results in more than 8 consecutive work hours, the driver will be paid for at least 1 meal. B. When available, District buses must be used before subcontracted buses for District funded trips for travel under 100 miles from Butte. For travel over 100 miles from Butte, a District liner(s) will be called out first. If District liner(s) is not available, a liner(s) will be sub-contracted except when District bus(ses) have been specifically requested. When district and subcontracted buses are on the same trip, district buses must be loaded first and subcontracted buses must be sent back first. C. Charter assignments will be done in accordance with Board policy. If you are employed with another department with the District, you cannot accept a Charter assignment that conflicts with the scheduled hours of your other position. Meal allowances shall be in accordance with Montana Code Annotated. D. Local charters will receive a minimum of two (2) hours. Drivers will be paid 15 minutes before departure and 15 minutes after return. In the event that a local charter’s return time is within two and a half hours of departure time, a driver will stay on site or return to the bus barn. If a local charter’s return time is three hours after departure time, the driver will be paid four (4) hours minimum.
Charter Service. 1. Charter service will operate off the rotating extra board nearest the point of origin of the charter. Pay for charter work will be in accordance with Article 47 of this Agreement. 2. District requests for a particular driver or drivers will be honored for VIP charters only.
