Contractual Service a) The scope of services and quality of the contingents for API calls arise from the respective description of the contingents in Mercedes-Benz B2B Connect at the time of the order.
b) Contingents for API calls can generally only be used for the Project ID disclosed at the time of the order.
c) The use of the contractual service requires an effective Data Release by the End Customer in accordance with Section 2.3 of these GTC RS-API. The right of use for the contractual service is limited to the respective data and purpose listed in the Customer's request.
d) The support is limited to responding to the Customer’s queries in the regular course of business. Customers can contact sales support (Customer Service Center) on xxxxxx.Xxxxxxxx.xxxxxxx@xxxxxxx.xxx.

4.4 The scope of services and the condition result in each case from the item description in the Service Info Mercedes- Benz Trucks Portal when the order is placed. This contains a detailed list of the Open Shell software and services to be leased, and the inextricably linked agreements concerning qualifications and the provision of product information.
4.5 Delivery dates and periods are only binding if expressly agreed as binding by the Supplier and the Customer in the individual case: All other delivery dates or periods are non-binding.
4.6 The Supplier is entitled to supply the Services owed in parts and part-deliveries, unless this is unreasonable for the Customer.
4.7 The Open Shell software is provided only in executable form, including a user manual (user documentation or online help) and the installation instructions. The operating instructions and installation instructions will be provided to the Customer electronically.
4.8 To the extent the Open Shell Software contains interfaces with software not supplied by the Supplier, Section 69 d of the German Copyright Act (Urheberrechtsgesetz) applies. Before decompiling, the Customer must first request the necessary information from the Supplier.
4.9 The Software will be installed and put into operation by the Customer. Customers are entitled to support with the Open Shell Software if they have an ongoing agreement and up-to-date data. The data status is deemed to be current if the last update of the Open Shell software with the latest software release was no more than 6 months ago.
4.10 When installing the Open Shell Software on your own hardware, support is only provided for the software. The Supplier does not provide any support with the Customer’s hardware and technical infrastructure, e.g. networking terminals via WLAN or the Internet connection.

d) A call of the API without output of RDS or RMS data will not be set off against a purchased contingent. The use of a contingent through API calls with an output of RDS or RMS data is defined in its description in the Mercedes- Benz /developers Portal.

The Products are supplied as used by the Supplier. Any further claim is excluded. Liability regardless of culpability for procurement risks related to the Products is excluded.
4.2 Delivery dates and periods are only binding if expressly agreed as binding by the Supplier and the Customer in the individual case: All other delivery dates or periods are non-binding.
4.3 Partial deliveries and partial services by the Supplier are permitted, unless this is unreasonable for the Customer.
4.4 Products are supplied subject to reservation of title. Said Products shall remain the Supplier’s property until all their claims due under the agreement have been settled. The reservation of title shall also cover any substitute deliveries. If the Customer defaults on payment, the Supplier is entitled to withdraw from the agreement at any time. The Customer must bear any costs incurred as a result hereof.

Bookstore Services are also handled by an outside contract service; it is overseen by a Bookstore Advisory Committee, and a Textbook Affordability Committee; net revenues from this enterprise support the operation of the Falcon Center.

Contractual Service. 15.1 The District may enter into an agreement with unit members desirous of entering the Contractual Service program. The following conditions must be met:
15.1.1 The Service must be purely voluntary.
15.1.2 The unit member must resign from the District.
15.2 Unit members opting and qualifying for this service shall receive annual contracts subject to satisfactory performance as determined by evaluation.
15.3 The participant shall become an independent contractor. Independent contractor services rendered are services that are special and unique and cannot be performed by the unit members of the District.
15.3.1 The independent contractor shall serve the number of days per year as may be mutually agreed upon.
15.3.2 The independent contractor(s) is (are) free to enter into contractual arrangements with other agencies, private and public.
15.3.3 The independent contractor shall have his specific tasks mutually agreed upon by him/her or Superintendent and/or designee.
15.3.4 The District will not direct the independent contractor’s activities in their pursuit of the result required by the District.
15.3.5 Some of the tasks to be performed by the independent contractor may be:
15.3.5.1 Participate in the development of progressive and/or advanced demonstration teaching methods.
15.3.5.2 Working on and supervising progressive and advanced staff development and in-service programs.
15.3.5.3 Supervision over designated testing programs.
15.3.5.4 Coordination and/or supervision in the compiling of test data.
15.3.5.5 Other unique services that would benefit the District.
15.4 The compensation for the contracted services is negotiable between the independent contractor and the Board. It is anticipated the compensation shall be in the range of the contractor's daily rate at the time of retirement.
15.4.1 The independent contractor must obtain their own Workers’ Compensation Insurance.
15.5 The unit member contractor or participant is not entitled to sick leave, vacation benefits, health and welfare benefits, or the grievance procedure as the District’s regular employees.
15.6 Applications for participation in this program must be made to the Superintendent in writing ninety (90) calendar days prior to the effective date of resignation.
15.7 As independent contractors, they will be responsible for their own Social Security.
