Update Service. Subject to product version, improved versions of the programme will be made available to the client for downloading from the internet. This service is only available for customers that have signed a service & support contract.
Update Service. In consideration for the District’s performance under this Agreement including, but not limited to, performance of all applicable obligations set forth in the Addenda hereto and payment of all applicable fees provided in the Addenda hereto, and in accordance with the District’s desires stated above, and to the extent that Xxxxx prepares Update Templates, Xxxxx and the District shall, according to the protocol set forth in Addendum C, update the Board-Adopted Edition of the Bylaws and Policies and the Superintendent-Approved Edition of the Administrative Procedures based upon the Update Templates, which updated version will be licensed to the District as provided below. Xxxxx shall, according to the protocol set forth in Addendum C, digitally publish this updated version of the Board-Adopted Edition of the Bylaws and Policies and/or Superintendent-Approved Edition of the Administrative Procedures and Forms.

Update Service. 7.6.1 Updates will be provided by Trace to the Client free of charge as follows:
a) where an Update is required in order to correct a Fault;
b) where an Update is required to remedy a breach of warranty under clause 2.4 of this Agreement;
c) where an Update is supplied under clause 2.7.4 of this Agreement; or
d) Trace makes an Update generally available to other licensees of the Licensed Software.
7.6.2 Where the Software Hosting Service is used updates will be installed by Trace free of charge if they are supplied free of charge under clauses 7.6.1 b) or c).
Update Service. Midwinter will use reasonable efforts to provide, on request by the Licensee, reasonable quarterly updates to the information contained on the publicly accessible portion of the Custom Site with new information provided to Midwinter by the Licensee on or before the end of each quarter based on the date of this agreement. Midwinter may determine whether a requested update is reasonable at its sole discretion and, where it determines that it is unreasonable to provide an update at no additional charge, will provide the Licensee with an estimated cost for performing the update at Midwinter’ then current time and materials rates. The Licensee accepts all liability and indemnifies Midwinter against any claims made against Midwinter in connection with updates requested by the Licensee.
Update Service. At a date determined by DR XXXXX, DR XXXXX will make available to the client program updates of the licensed products. These updates comprise repair of mistakes, correction of possible program problems that did not occur either during the test run or during use within the warranty period, enhancement of the performance, changes in the software programs consequent on legal changes. Legal changes that result in new program logic, that is, changes in existing functions that lead to new programs and program modules, as well as possibly necessary additions to the hardware, are not included in the performance obligations covered by this contract. These programs will be offered separately to the client along with the required data carriers and documentation.

Update Service. 9.1 PRICE Charges for Update Service are, per year per site, $16,043 for the current Application System or the two previous releases, and $32,086 for older releases. The prices cover any reasonable travel and living expenses incurred if site visits are required to implement a maintenance release. Equipment needed on ITC's AXE sites to facilitate remote electronic delivery is not included in the price. The remote patch delivery requires a high speed data connection using X.25/MTP protocol.
9.2 COVERAGE All AXE Software purchased under this Agreement. Update Service for TMOS systems and other OAM&P systems are not included in this contract. If ITC wishes to purchase OAM&P Update Service, Ericsson can provide a quote for that service.
Update Service. The provider publishes a new software version every year and reserves the right to publish one or more subversions in the same year. The versions will be available for download in the customer center.
Update Service. At a date determined by him, NOA will free of any extra charge deliver, and make available to the Customer the Software updates as provided by the producer. NOA shall inform the Customer on the so call Critical Patches, which are necessary to install in order to maintain the productivity and stability of the Software.
