If the CPI Increase exceeds three percent (3%) then the Employer shall pay Grid A employees (except Service Clerks and Demonstrators) at top rate of their classification, one cent ($0.01) per hour paid and one half cent ($0.005) per hour paid for all other employees for each one-third of one percent (.333%) that the CPI Increase exceeds three percent (3%). Hours paid shall mean the hours paid in the fifty-two (52) weeks prior to March 28, 2004. Cost of Living Clause. For the term of this Agreement, all classifications of employees, except Courtesy Clerks, indicated in Exhibit A Wages shall be covered by the provisions of a Cost-of-Living allowance as set forth below. The amount of the Cost-of-Living allowance shall be determined and redetermined as provided below on the basis of the “ Revised Consumer Price Index for Urban Wage earners and Clerical Workers” published by the BLS, U.S. Department of Labor (1067 - 100) and referred to herein as the “ Index” . Cost of Living Clause. All employees covered by this Agreement shall be entitled to receive a cost-of-living allowance to be determined in the following manner based on the Consumer Price Index (United States average 1967=100) published by the United States Department of Labor. Effective October 1, 1980, the One dollar and forty-eight cents ($1.48) per hour cost-of-living (COLA) which has accumulated from March 1, 1978, through September 30, 1980, (which was being paid on September 1, 1980) shall be added to the base rate. All COLA accumulation between October 1, 1980, and September 30, 1981, shall be paid to all employees.

Cost of Living Clause. (a) Effective January 1, 2017, in the event that the percentage increase in the cost of living [Consumer Price Index for the City of New York - Metropolitan Area (New York-New Jersey) Urban Wage Earners and Clerical Workers] from November 2015 to November 2016 exceeds 6.5%, then, in that event, an increase of $.10 per hour for each full l% increase in the cost of living in excess of 6.5% shall be granted effective for the first full work week commencing after January 1, 2017. In no event shall said increase pursuant to this provision exceed $.20 per hour.

  • SAVING CLAUSE If any provision(s) of this Agreement shall be determined to be illegal or unenforceable, such determination shall in no manner affect the legality or enforceability of any other provision hereof.

  • Penalty Clause a. Non-execution of supply order - For the reasons of failure to supply partially or completely within 30 days, if the Procurement cell has to buy the items from the RC 2 (L-2), RC 3 (L-3) or approved local vendor firm, the rate difference in cost will be recovered from XX xxxxxx i.e. L1 /Billing Agency as appointed by the Rate Contract Holder. The difference amount will be deducted from the forthcoming bills of the supplier pertaining to any product. Repeated failure (Three times) to supply in part or in full may amount to termination of rate contract for the product (s) and forfeiture of Performance Security. Reasons of failure to supply the material will be communicated by the firm to the Procurement cell timely.

  • ZIPPER CLAUSE 303. This Agreement sets forth the full and entire understanding of the parties regarding the matters herein. This Agreement may be modified, but only in writing, upon the mutual consent of the parties.
