Council Obligations. The Council shall establish and maintain during the currency of this Agreement the arrangements for the Joint Transportation Board as set out in the First Schedule.
Council Obligations. The Council agrees to notify all employees in the bargaining unit of their obligation and responsibility for maintaining compliance with this Article, including their responsibility to remain at work during any interruption, which may be caused or initiated by others, and to encourage employees violating this Section of the Agreement to return to work. Upon compliance with the provisions of this Section neither the Council nor any of its agents or representatives shall be liable for the actions of employees who violate this Article.
Council Obligations. The Council will provide technical support and assistance to the Provider to increase its capacity to offer victims/survivors of sexual assault the highest quality of services.
Council Obligations. 16.1 It is agreed that this Agreement is conditional upon the Council providing suitable Council Premises (including a lease or other rights of occupation) to enable the Company to undertake its obligations under this Agreement.
16.2 The Council agrees to:
16.2.1 provide the Council Assets for the provision of the Services on the terms set out in clause 15.4;
16.2.2 transfer to the Company the Transferring Assets set out in Schedule 5 on the terms set out in clause 8.3;
16.2.3 transfer to the Company any Assigned Supplier Contracts in accordance with the provisions of clause 15.6;
16.2.4 provide the Council Services from the Commencement Date in accordance with the service level agreements set out in Schedule 10; and
16.2.5 Permit the Company to use the Council's ICT System on the terms set out in clause 15.3; and
16.2.6 enter into the Premises Licence(s) with effect from the Commencement Date.
16.3 The Council shall be responsible for the following:
16.3.1 The discharge of all statutory functions which may not be undertaken by the Company;
16.3.2 policy and strategy development for the Services;
16.3.3 strategic planning of Variations in the Services;
16.3.4 with the assistance of the Company to identify changes in statute and Government Guidance which require strategic change to policy and procedure;
16.3.5 enforcement policy, investigation and action;
16.3.6 setting Council tax and business rates;
16.3.7 setting charges for chargeable Council services; and
16.3.8 with the assistance of the Company, debt recovery for non-payment for Council services provided to third parties.
Council Obligations. 4.1. The Council hereby agrees with the Tenant that the Tenant observing and performing the conditions and obligations on his part contained in this Agreement may peaceably use and enjoy the Allotment Garden without any interruption by the Council or any person claiming under or in trust for the Council.
4.2. The Council shall pay all rates, taxes, dues or other assessments which may at any time be levied or charged upon the Allotment Garden.
Council Obligations. 5.1.1 In supplying the XXXX Services, the Council shall (and in accordance with the embedded service specification in this paragraph 5):
(a) Ensure that the provision of the XXXX Services is consistent with the Service User’s needs as identified in the Referral Process;
(b) perform the XXXX Services with the highest level of care, skill and diligence in accordance with best practice and appropriate clinical standards;
(c) co-operate with the CCGs in all matters relating to the XXXX Services, and comply with all reasonable instructions of the CCGs;
(d) use personnel who are suitably and appropriately registered, qualified, skilled, competent, experienced and appropriately trained in the application to the Service of the Health & Social Care Protocol and where revalidation is required by the appropriate professional regulatory body this is completed to perform tasks assigned to them, and in sufficient number to ensure that the Council's obligations are fulfilled and are covered by the Council’s (and/or any subcontractor that is approved by the CCGs) indemnity arrangements for the provision of the XXXX Services;
(e) ensure that it obtains, and maintains all consents, licences and permissions (statutory, regulatory, contractual or otherwise) it may require and which are necessary to enable it to comply with its obligations;
(f) comply where applicable with the registration and regulatory compliance guidance of any relevant Regulatory or Supervisory Body and any standards and recommendations issued from time to time by any such Body;
(g) comply with the standards and recommendations issued from time to time by any relevant professional body and agreed in writing between the CCGs and the Council;
(h) comply, where applicable, with the recommendations contained in the NICE Technology Appraisals and have regard to other guidance issued by NICE from time to time;
(i) respond to any reports and recommendations made by Local Healthwatch;
(j) ensure that the XXXX Services conform with all descriptions and specifications set out in this Scheme Specification;
(k) ensure that the Services are carried out so as to meet the Service User’s outcomes as identified in the Service User’s Reablement Plan;
(l) provide all equipment, tools, vehicles and other items required to provide the Services;
(m) ensure that all staff using equipment in the delivery of the XXXX Services and all Service Users and carers using equipment independently as part of the Service User’s care or treat...
Council Obligations. Councils shall provide SMC with Notice of inspections. Councils shall provide SMC with reasonable notice, usually not to be less than 24 hours, and shall include a list of Council members and representatives that will be participating in the inspection, a list of relevant SMC employees Councils would like to meet with during the inspection, and a request, if any, to inspect underground facilities. Councils shall comply with all applicable federal and state laws and regulations pertaining to occupational safety and health during such inspections.
