Displacement (Bumping) Rights a. An employee who is laid off from a classification and who has previously obtained permanency in an equal or lower classification shall have the right to bump the least senior employee in that classification. Where the employee is eligible to bump into more than one classification, the employee shall bump into the equal classification. If there is more than one classification which he/she is eligible to bump into, it shall be the one in which the employee has the most prior service.

Displacement (Bumping) Rights. 14.4.1 Unit members who are designated for a layoff may exercise displacement or bumping rights into any equal or lower classification which he or she currently holds or into a classification previously regularly held within the District, providing that they meet minimum qualifications and providing that the classification into which they are bumping is equal or lower than the classification from which the unit member is being laid off. A unit member possessing bumping rights need not exercise those rights; a unit member who elects a layoff in lieu of displacement or bumping maintains their reemployment rights under this Agreement. Unit members in positions which have been eliminated shall have the right to displace the least senior unit member in their classification.

The most senior employee in a class whose position has been eliminated shall be allowed to displace (bump) the least senior employee within the same class who is assigned the same number of hours per day and months per year as the affected employee. If no position exists with the same number of daily assigned hours and months per year as the affected employee, he/she may then bump the least senior employee having the next closest number of hours and months within the class. An employee bumping into a lesser work schedule shall be placed on a reemployment list for his/her former work schedule for a period of sixty- three (63) months.

Displacement (Bumping) Rights. A bargaining unit employee laid off from his/her present classification may bump into a position in the same classification if they hold more seniority than another unit member in the same classification. If no such positions exist, the bargaining unit employee may, in lieu of layoff, bump into the next lower classification in which the bargaining unit employee has previously served and completed their probationary period and in which the laid off bargaining unit employee has greater seniority in the lower classification and any higher classifications.
