Employee Consultation. 19.1 The University is committed to workplace participation, through employee consultation at the workplace level. To facilitate such consultation, the University will use a range of measures which may include the University’s web facilities and email system, employee focus groups, workplace/work unit meetings and an Employee Consultative Committee (ECC) as provided for in this clause.
19.2 This Agreement establishes an Employee Consultative Committee to provide a forum for consultation between management and employees on matters pertaining to this Agreement and to monitor the implementation of this Agreement and other workplace relations issues including policies. New and amended policies will be referred to the ECC.
19.3 The ECC shall Comprise:
(i) three (3) employees, comprising one (1) employee nominated by each of the unions covered by this Agreement; and
(ii) up to three (3) nominees of the Vice-Chancellor, who are employed by the University, one (1) of whom shall be the Presiding Officer.
19.4 Meetings of the ECC will be convened at least four (4) times a year, or as otherwise required, and employees nominated in accordance with sub-clause 19.3 will be allowed reasonable time off during working hours to attend and prepare for meetings. In making such arrangements, the employees shall discuss the need to leave their work area with their supervisor before doing so.
19.5 The University will provide adequate resources to facilitate employee consultation processes including, but not limited to, data collection and assessment of implementation of the Agreement.
Employee Consultation. The Seller shall be satisfied that a reasonable information and consultation process has taken place as required by applicable Law:
(a) with UK Employees or the representatives of the UK Employees, in accordance with Section D-1.3 of Exhibit D-1 ; and
(b) with the representatives of the France Employees, in accordance with Section D-2.3 of Exhibit D-2.
Employee Consultation. Parent and the Company shall cooperate in respect of consultation obligations and similar notice and bargaining obligations owed to any employees or consultants of Parent or the Company and their respective Subsidiaries in accordance with all applicable Laws and works council or other bargaining agreements, if any.
Employee Consultation. The completion, to the reasonable mutual satisfaction of the Parties, of any Employee Consultation Process in any relevant jurisdiction.
Employee Consultation. (a) The Seller shall have delivered to the Purchaser as applicable to the relevant Facility/ Design Closing:
(i) a certificate confirming that the information and consultation process with the representatives of the UK Employees required by applicable Law shall have taken place, in accordance with Section D-1.3 of Exhibit D-1; and
(ii) a document stating the opinion of the representatives of the France Employees provided following the completion of the information and consultation process with the representatives of the France Employees, in accordance with Section D-2.3 of Exhibit D-2;
Employee Consultation. The Parties agree that consultation is important in maintaining positive working relationships between Australia Post, its employees and the relevant Unions. Australia Post acknowledges that consultation prior to any significant change and on the consequences of that change is critical to maintaining positive workplace relationships and positive business outcomes.
Employee Consultation. Subject matters which the District determines are directly related to the working conditions of one or more employees will be brought to their attention and their advice sought prior to board action. A copy of the proposed changes will also be sent to the LEA President.
Employee Consultation. (a) The consultation with the competent works council of Comet (the “Comet Works Council” and such consultation procedure, the “Comet Works Council Consultation Procedure”) will be deemed completed upon the Comet Works Council having rendered an unconditional advice or an advice with conditions acceptable to each of Comet and Moon, permitting the Parties to pursue the sale and transfer of the CT Entity 3 Equity Interests and the CT Entity 6 Equity Interests and the documents related thereto; or
(b) To the extent neither of the situations described in Section 7.25(a) occurs, the Comet Works Council Consultation Procedure will be deemed completed upon the Comet Boards adopting a resolution that deviates from the relevant advice, if rendered, and:
(i) The Comet Works Council having unconditionally waived (A) the applicable waiting period in accordance with article 25 paragraph 6 of the Dutch Works Councils Act (Wet op de Ondernemingsraden) and (B) its right to initiate legal proceedings pursuant to article 26 of the Dutch Works Councils Act;
(ii) The applicable waiting period pursuant to article 25 paragraph 6 of the Dutch Works Councils Act having expired without the Comet Works Council having initiated legal proceedings pursuant to the Dutch Works Councils Act; or
(iii) Following the initiation of legal proceedings pursuant to article 26 of the Dutch Works Councils Act, the Enterprise Chamber of the Amsterdam Court of Appeals (Ondernemingskamer van het gerechtshof Amsterdam) having dismissed the Comet Works Council’s appeal to the effect that no measures obstructing the sale and transfer of the CT Entity 3 Equity Interests and the CT Entity 6 Equity Interests and the documents related thereto are imposed and the dismissal of the Enterprise Chamber of the Amsterdam Court has immediate effect (uitvoerbaar bij voorrraad).
(c) The Parties shall use their reasonable best efforts to complete the Comet Works Council Consultation Procedure, it being understood that Comet will have the primary responsibility for, and take all steps reasonably necessary to, in consultation with Moon and its advisors, as soon as practicable following the date hereof, initiate, conduct and complete the Comet Works Council Consultation Procedure. Comet and Moon shall consult with each other closely with a view to seeking and obtaining the Comet Works Council’s advice and discuss in good faith to expeditiously resolve any relevant issues raised by the Comet Works Council during the Comet...
Employee Consultation. The Company will consult with all affected employees when a shift change is contemplated, and where practical, the employees will be given preference for shift assignments. In the event that two (2) or more employees within the same classification request the same shift, the Company will assign the shift to the senior employee.
Employee Consultation. Seller and Purchaser shall, and shall cause their respective Affiliates to, comply with all obligations either under the Transfer Regulations or other national laws to provide information to the other party for onward transmission to Transferred Employees or employee representatives and/or to provide such information directly to Transferred Employees or employee representatives. Seller and Purchaser shall indemnify each other against all Losses resulting from any failure to provide such information in a timely manner. Purchaser shall accept and be responsible for the outcome of any consultation procedures under applicable codetermination legislation applicable in member countries of the European Union.
