EMPLOYER'S RIGHTS AND OBLIGATIONS. Notwithstanding the procedures contained below, Council shall:
(i) Be entitled to suspend an employee with or without pay during the investigation process provided that:
(a) suspension without pay during an investigation shall be for a period of not more than two weeks, except where the progress of the investigation is delayed due to the unavailability of the employee and/or their representative in which case the period of suspension without pay may be extended for a further period of up to 7 days or such greater period by agreement.
(b) If, after investigation, the reasons for the suspension are found to be inappropriate, the employee shall not suffer any loss of pay for the period under suspension.
(c) The suspension shall not affect the employee's continuity of service for the purposes of accruing leave entitlements.
(d) Council shall not unreasonably refuse an application for paid leave under this provision.
(e) By agreement an employee may be transferred to another position or place of work.
(ii) Properly conduct and speedily conclude an investigation into the alleged unsatisfactory work performance or conduct.
(iii) Be entitled to take other disciplinary action before and/or during the procedures in cases of misconduct or where the employee's performance warrants such action.
(iv) In appropriate circumstances be entitled to terminate an employee's services in accordance with Clause 30, Termination of Employment of the BCCMCBE agreement.
(v) Be entitled to request the presence of a union representative at any stage.
EMPLOYER'S RIGHTS AND OBLIGATIONS. Notwithstanding the procedures contained below, the employer shall:
EMPLOYER'S RIGHTS AND OBLIGATIONS. The Agency retains its statutory right to determine when a furlough will be con- ducted and what positions will be affected by such action. When conducting furloughs, the Agency will adhere to the terms of this Agreement, as well as all requirements mandated by applicable law, rule, Government-wide regulations, and Departmental Regulation or guidance that does not conflict with this Agree- ment.
EMPLOYER'S RIGHTS AND OBLIGATIONS. Notwithstanding the procedures contained below, a Council shall:
EMPLOYER'S RIGHTS AND OBLIGATIONS. 9.1. Since the date of establishment of the employment relationship, the Employer is obliged to allocate to the Employee work in accordance with the provisions hereof, to create for the Employee all conditions necessary for successful performance of the determined work tasks and to comply with all other duties prescribed by the Employer by applicable laws.
9.2. During the existence of the employment relationship, the Employer shall provide to the Employee an automobile for business and private purposes. Fuel costs shall be covered by the Employer, except for fuel consumed by the Employee on private trips, which shall be covered by the Employee.
9.3. During the existence of the employment relationship, the Employer shall provide to the Employee working aids and instruments necessary for the performance of the Employee’s work tasks, which shall be further specified in the wage assessment or in another corporate document.
9.4. During the existence of the employment relationship, the Employer shall pay health insurance for the Employee and his family members.
9.5. During the existence of the employment relationship, the Employer shall pay IAPA insurance for the Employee.
9.6. The Employer shall withhold from the Employee’s wages all amounts prescribed by applicable laws.
EMPLOYER'S RIGHTS AND OBLIGATIONS. When conducting a RIF, the Employer shall fulfill all requirements of the law, Government-wide regulations, Executive Orders, and Department of Justice regulations. RIFs shall not be used to discipline an employee or group of employees nor for the purpose of circumventing merit promotion procedures. However, the Employer retains its statutory right to determine when a RIF, furlough or transfer of function will be conducted and what positions will be affected.

Pursuant to all applicable law, regulations, and this Agreement, the Employer retains its statutory right to determine when a furlough will be conducted and what positions will be affected. When conducting furloughs, the Employer will fulfill all requirements of applicable law, regulations, as well as the terms of this Agreement.

6.2.4 In appropriate circumstances be entitled to terminate an employee's services in accordance with Clause 4.1 of this agreement.
6.2.5 Be entitled to request the presence of a union representative at any stage.

i) the suspension shall not be for longer than is reasonably necessary to conduct a proper investigation.
ii) the suspension shall be limited to circumstances where suspected unsatisfactory work performance or conduct, if substantiated, would constitute a serious breach of the employer’s code of conduct, policies, procedures, or the employee’s contract of employment.
iii) suspension without pay during an investigation shall be for a period of not more than two weeks, except where the progress of the investigation is delayed due to the unavailability of the employee and/or their representative in which case the period of suspension without pay may be extended for a further period of up to seven days or such greater period by agreement.
iv) If, after investigation, the reasons for the suspension are found to be inappropriate, the employee shall not suffer any loss of pay for the period under suspension.
v) The suspension shall not affect the employee’s continuity of service for the purposes of accruing leave entitlements.
vi) The employer shall not unreasonably refuse an application for paid leave under this provision.
vii) By agreement an employee may be transferred to another position or place of work.
b) Be entitled to request the presence of an Association and/or union representative at any stage.
