General Operating Standards. (a) O&M Contractor has read and understands the requirements of all Project Agreements provided to it by Owner and shall comply with the material requirements thereof in providing the Services, including the delivery of any required notices and obtaining any required consents applicable to any of the Services. (b) Subject to Section 6.3, O&M Contractor shall perform the Services in accordance with Applicable Law, the Permits, Prudent Industry Practice, Energy Storage 1 Note to O&M Contractor: Please provide quotes for 2-, 3-, 4-, and 5-contract year terms for ETI’s consideration. Industry Standards, the terms of all the Project Hardware Warranties, the BOT Warranty, the Project Agreements, the O&M Manuals, the Annual Operating Plan, all applicable requirements of O&M Contractor’s insurance policies in respect of the Services, and all other requirements of this Agreement, including the Exhibits hereto. Should the rules, standards or guidelines derived from the foregoing sources be inconsistent in any regard, O&M Contractor shall consult with Owner for direction, but in the interim shall follow the most stringent of such inconsistent standards. Without limiting the foregoing, O&M Contractor shall use commercially reasonable efforts to maximize net profit, energy production, and Project efficiency; to optimize the useful life of the Project; to utilize O&M Contractor’s personnel in the performance of the Services; and to minimize Project downtime and T&M Costs, including by scheduling outages during non-daylight hours and working evenings to return the Project to service to limit downtime during daylight hours. While performing any Services under this Agreement, O&M Contractor will comply with all terms and requirements applicable to the operation, maintenance and monitoring of the Project as specified (i) in the Project Hardware Warranties and the BOT Warranty, and shall not take or fail to take any action that could release, void or waive any Project Hardware Warranty or the BOT Warranty, and (ii) in the written instructions of the original equipment manufacturers or vendors with respect to equipment supplied by them included in the Project. O&M Contractor shall coordinate with the original equipment manufacturers who supplied the components for the Project to obtain any technical information letters, bulletins, or other maintenance requirements developed or provided by such original equipment manufacturers during the Term, and O&M Contractor shall incorpor...
General Operating Standards. Concessionaire shall not use or occupy or permit the Premises or any part thereof to be used or occupied, in whole or in part, in a manner which would in any way: (i) violate any present or future Legal Requirements or Port Standards, (ii) violate any of the covenants, agreements, provisions and conditions of this Agreement, (iii) violate the certificate of occupancy then in force with respect to the Agreement, (iv) constitute a public or private nuisance, (v) impair, in the Port’s reasonable judgment, with the character, reputation or appearance of the Airport or the Port, or (vi) occasion discomfort, inconvenience or annoyance to either the Port or its adjoining tenants. Without limiting the foregoing, Concessionaire specifically agrees to comply with all applicable rules and regulations of the Port, whether now in existence or hereafter promulgated, pertaining to (a) the Airport and its terminals, which exist for the general safety and convenience of the Port, its various tenants, invitees, licensees and the general public, and (b) the common food and beverage areas located within the Airport. The failure to comply with this standard shall be grounds for the imposition of Liquidated Damages as provided in Section 18.4 and Exhibit F.

Working group members should be active in recommending improvements and should understand how their contributions are used in the process and products. Expected duties include— 1. Attending working group meetings; 2. Coming to meetings prepared to discuss issues; 3. Providing input on time; 4. Staying focused on the task; 5. Clearly stating the positions and concerns of the member’s organization; 6. Providing feedback to member’s organization/management to facilitate completion of final products; and 7. Working as a team and not allowing direction from persons outside the working group process to redirect or unduly influence the team. However, it is expected that the working group members will keep their organization and/or management informed of the major issues.

User shall, at User’s expense, promptly furnish courteous and efficient services, adequate to meet all of the usual demands for the aircraft storage and other services authorized hereunder at the Airport on a fair, equal, and not unjustly discriminatory prices for each unit of sale or service, consistent with the standard operations of other aircraft storage or hangar operations. B User hereby covenants to the Authority that User shall, at User’s own expense, keep the Leased Airport Property in a reasonably safe condition and will continuously provide for the efficient and economic administration, operation, management, and repair of all Leased Airport Property.

Operator shall conduct all its operations in an orderly manner and so as not to annoy, disturb, or be offensive to other operators or patrons of the Premises. Operator warrants that any food, food products, merchandise, and other goods and services; sold or kept for sale under this Agreement will be in accordance with industry standards and will conform in all respects to applicable federal, State and local laws, regulations, ordinances, and codes. All goods and services offered for sale must be in good taste. If in ECHDC's reasonable judgement any good or service offered by Operator is not in good taste, at ECHDC request, Operator and ECHDC shall review and mutually agree upon a good or service that is in good taste.

General Operating Standards. Contractor shall perform the Services (and Additional Services, as applicable) in accordance with; (i) the terms of this Agreement and the applicable Site Subcontract Agreement Rider, (ii) all applicable laws and applicable permits for performance of the Services, (iii) all applicable warranties and guarantees provided by manufacturers, suppliers or subcontractors, (iv) all manufacturer’s maintenance instructions and specifications and (v) the requirements of any insurance policies maintained by Contractor with respect to the Systems.
General Operating Standards. 1. For as long as Lessee shall occupy and possess the Licensed Airport Property, Lessee shall continuously, at Lessee’s expense, promptly comply with the Minimum Standards and furnish courteous and efficient services which are consistent with the administration and operation of the aviation related business authorized by the Authority in Lessee’s License Agreement, and adequate to meet all of the demands thereof, on a fair, equal, and not unjustly discriminatory bases. 2. Lessee expressly assumes all risk of loss whatsoever, including, but not limited to, any decrease in the use, enjoyment or value, of the license and privileges created hereby, and of Lessee’s personal property used or located at the Airport and the Licensed Airport Property, and for any loss of rents, profits and income arising from or otherwise related to the conduct of Lessee’s business and operations at or upon the Licensed Airport Property, and from any casualty whatsoever, whether or not insurable or insured against.
General Operating Standards. Provider shall perform the Services in a good, workmanlike, and commercially reasonable manner in accordance with the requirements of this Agreement and Applicable Laws. Provider shall use commercially reasonable efforts to cause the Services to be planned and performed in a timely and cost-effective manner. Provider shall fully cooperate with Customer with respect to the requirements relating to applicable provisions of the Authorization Documents that relate to the tasks to be completed by Customer on or before the date requested by Customer.
