Grievance Procedure Definitions. 1. A grievance shall be defined as an alleged violation of the express terms of an Article or Section of this Agreement.
2. For the purposes of processing grievances working days shall be defined as Monday through Friday, on any day in which the employee is scheduled to work, excluding all non-session school days, and paid holidays.
3. The time elements in the grievance steps may be shortened, extended, or waived upon written mutual agreement between the parties.
4. Any grievance which is not appealed within the specified time limits set forth in that step level of the grievance procedure, shall be considered to be settled on the basis of the decision rendered at the previous step level of the grievance procedure. In the event that the Employer Representative does not furnish either the oral or written answer, depending upon the step of the grievance procedure, to a grievance within the specified time limits of that step of the grievance procedure, the grievance is deemed as denied, and the Association may process the grievance to the next step level of the grievance procedure.
5. The grievant is the employee alleging violation of the specific and express terms of this Agreement.
Grievance Procedure Definitions. A. A grievance is a complaint involving an alleged violation, misinterpretation, or misapplication of the expressed terms of this Negotiated Agreement.
B. A grievant shall mean a unit member or group of unit members alleging that a violation, misinterpretation, or misapplication of the Negotiated Agreement has occurred.
C. A "group" grievance shall have arisen out of substantially similar circumstances affecting more than one unit member.

(d) Any employee or Association grievance not presented for disposition through the Grievance Procedure within ten (10) working days of the occurrence of the condition giving rise to the grievance, or within ten (10) working days of the date it is reasonable to assume that the employee or the Association first became aware of the conditions giving rise to the grievance, unless the circumstances made it impossible for the employee or the Association, as the case may be, to know prior to that date that there were grounds for such a claim, the grievance shall not thereafter be considered a grievance under this Agreement.
(a) Any employee having a grievance shall discuss the grievance with his/her Supervisor and they shall attempt to resolve it.
(b) If the grievance is not settled verbally, the employee may, no later than ten (10) working days later, file a written grievance and request a meeting with the Association Representative and Supervisor to discuss the grievance.
(c) The Supervisor shall have ten(10) working days after the meeting to reply in writing to the grievance.

No grievance shall be processed or entertained unless it is filed within fifteen (15) days of the occurrence of the event giving rise to the grievance.

If the answer to a grievance is not given within the specified time limits of that Step Level, the appealing party may automatically appeal the grievance to the next Step Level of the Grievance Procedure.
(e) A grievance pertaining to alleged safety hazards may be processed directly to Step Three (3) of the Grievance Procedure, upon the employee having discussed the grievance orally with their immediate supervisor.
(f) Any employee or Union grievance which is not presented for disposition through the Grievance Procedure within five (5) working days of the date that it is reasonable to assume that the employee or the Union, as the case may be, first became aware of the conditions giving rise to the grievance, the grievance shall not hereafter be considered a grievance under this Agreement.
(a) Any employee having a grievance shall discuss the grievance informally with their immediate supervisor, and then if the grievance is not settled orally with their immediate supervisor, the employee may then request a meeting with the Chief Xxxxxxx to discuss the grievance.
(b) The Chief Xxxxxxx then may submit the grievance in writing to the immediate supervisor stating the remedy or correction requested, plus the facts upon which the grievance is based, and the alleged Contract violation. The employee and the Chief Xxxxxxx shall sign the grievance.
(a) The immediate supervisor shall then within two (2) working days from the date of receipt of the grievance, meet with the Chief Xxxxxxx and the grievant to discuss the grievance.
(b) The immediate supervisor shall then given his decision in writing relative to the grievance within five (5) working days from the date of the meeting with the Chief Xxxxxxx and the grievant.

Grievance Procedure Definitions. A. A grievance shall be any claim by the Association or any employee that there has been a violation, misrepresentation, and misapplication of the terms of this Agreement as it relates to the employees’ rights to fair treatment under the Agreement.
B. All time limits consist of school days. Except when a grievance is submitted fewer than ten (10) days before the close of the current school term, then time limits shall consist of all weekdays.

Grievance Procedure Definitions. 1. The term Agrievance@ means a claim by an employee or the Association concerning the interpretation, application or alleged violation of this Agreement. Minor discipline shall be subject to the grievance procedure, but not subject to arbitration under step three of this Article.
2. An Aaggrieved person@ is the person or persons making the claim.
3. A Aparty in interest@ is the person or persons making the claim and any person(s) who might be required to take action or against whom action might be taken in order to resolve the claim.
4. AEmployee@ is defined as a full-time or part-time employee represented by the Association. The procedure shall be as follows:
Step 1. An aggrieved person shall notify his/her immediate supervisor in writing of the nature of the grievance within ten (10) work days of the event giving rise to the grievance. If the grievance is against the immediate supervisor, the aggrieved employee may file a grievance directly at Step 2. Within five (5) work days of the receipt of the notice, the immediate supervisor shall meet with the aggrieved person and attempt to adjust or resolve such grievance. The immediate supervisor shall render his decision, in writing, within five (5) days after such meeting.
Step 2. If the grievance is not resolved to the satisfaction of the aggrieved person at Step 1, an aggrieved person shall notify his/her Department Head in writing of the nature of the grievance within ten (10) work days of receipt of the immediate supervisor=s decision or the event giving rise to the grievance, if applicable. Within five (5) work days of the receipt of the notice, the Department Head shall meet with the aggrieved person and attempt to adjust or resolve such grievance. The Department Head shall render his decision, in writing, within five (5) days after such meeting.
Step 3. If the grievance is not resolved to the satisfaction of the aggrieved person, he/she may present the grievance to the Township Administrator, in writing, within ten (10) work days after receipt of the decision of the Department Head.
Step 4. If such grievance is not resolved to the satisfaction of the Association, the Association may, within fifteen (15) days after receipt of the Township Administrator=s decision, notify the Township Administrator, in writing, that the Association wishes to take the matter to binding arbitration.
