Health and Safety Program.
(a) The parties agree that health and safety is of the highest priority. The Union and Company recognize the importance of maintaining a safe and healthful work environment and shall cooperate to further improve the health and safety programs and to encourage employees to follow safety policies and procedures as established in order to achieve these objectives. The company will maintain an ALARA program.
(b) The Company is responsible for maintaining a safe and healthful work place. The Company shall maintain a monitoring program that effectively determines exposure levels to all chemicals or physical agents, which are known to be hazardous in the work place. The present practice of providing the Union with copies of monitoring reports shall be continued. Results of such surveys will be made available to employees who request such information through their supervision.
(c) Employee(s) may present to appropriate supervision or through the suggestion system their recommendations in writing on matters relative to safe, sanitary, and healthful working conditions. They will be advised in writing of the disposition of such written recommendations and may discuss such written recommendations with appropriate safety representatives.
(d) No employee shall be required to perform work under conditions which are unsafe beyond the normal hazards of the operation in question. In such cases, the employee may discuss the matter with supervision and appropriate Company health and safety personnel. If the problem is not resolved, the employee may contact the appropriate Company manager for a decision. Any health or safety problem can be a proper subject for the grievance procedure after it has first been reviewed by the Company-Union Health and Safety Committee.
(e) All employees shall be given Health and Safety training appropriate to their work environment.
Health and Safety Program. (a) The parties agree that health and safety is of the highest priority. The Union and Company recognize the importance of maintaining a safe and healthful work environment and shall cooperate to further improve the health and safety programs and to require employees to follow safety policies and procedures as established in order to achieve these objectives. The Company will maintain a Health and Safety program.
Health and Safety Program. The Employer shall attempt to provide a safe work environment consistent with the standards set by the Illinois Department of Labor. To this end, the Employer and the Union shall act cooperatively with the Department of Corrections to develop workplace violence programs designed to eliminate violence in the workplace.
Health and Safety Program. Contractor shall develop, publish, and implement the overall Health and Safety Program for the Project. This Program shall conform to all applicable codes. Contractor shall submit the written Health and Safety Program to Metro for review and comment within fourteen (14) days after the receipt of the written Notice to Proceed. Metro’s review and comment, if any, and Contractor’s changes to the Health and Safety Program, based on Metro’s Metro Contract # review, if any, shall not constitute an endorsement or approval of same by Metro such that Contractor is relieved of sole responsibility for content of the Health and Safety Program and its implementation. Metro is expressly released of any implied liability therefore. The Health and Safety Program shall subsequently be distributed to and implemented by Contractor's personnel, as well as its Subcontractors and Suppliers. Contractor shall fully implement and comply with the Contractor’s Health and Safety Program. Under no circumstance will the contractor commence work prior to submitting and implementing the Health and Safety Program.
Health and Safety Program. The parties agree that a Joint Occupational Health and Safety program will be established, and be governed in accordance with the provisions of the Industrial Health and Safety Regulations made pursuant to the Workers Compensation Act.
Health and Safety Program. 9.4.1 Notwithstanding any limitation in the OHS Regulation regarding the number of workers in any work force, the Concessionaire will prepare and at all times throughout the Contract Period maintain in respect of the Full Concession Area, a formal health and safety program that:
9.4.1.1 complies with Good Industry Practice and all applicable Laws and Regulations (including all applicable specifications and standards in the Workers Compensation Act and the OHS Regulation) and is satisfactory to the Province;
9.4.1.2 satisfies the requirements of section 3.3 of Part 3 of the OHS Regulation;
9.4.1.3 is designed to prevent injuries and occupational diseases within the contemplation of the Workers Compensation Act and the OHS Regulation; and
Health and Safety Program. 9.4.1 Notwithstanding any limitation in the Occupational Health and Safety Regulations regarding the number of workers in any work force, the Concessionaire will prepare and during the Contract Period maintain in respect of the Site and the Adjacent Areas and, while it is in occupation of the same, the Graving Dock Site a formal health and safety program, satisfactory to the Province, that:
9.4.1.1 complies with Good Industry Practice and all applicable Laws and Regulations (including all applicable specifications and standards in the Workers Compensation Act and the Occupational Health and Safety Regulations);
9.4.1.2 satisfies the requirements of section 3.3 of Part 3 of the Occupational Health and Safety Regulations;
9.4.1.3 is designed to prevent injuries and occupational diseases within the contemplation of the Workers Compensation Act and the Occupational Health and Safety Regulations; and
9.4.1.4 provides for the establishment and maintenance of a system or systems and a process or processes to ensure compliance with the Workers Compensation Act and the Occupational Health and Safety Regulations.
Health and Safety Program. The Contractor shall, as required by Project, on a demand basis, prepare and implement site- specific health and safety plans for all phases of the work activity for its employees, subcontractor’s or subcontractors’ employees as required. Health and Safety Program is not required for Contractors in Section E3-7. The Contractor shall have an existing health and safety program which shall comply with all Occupational Safety and Health Administration (OSHA, reference Title 29 Code of Federal Regulations, Part 1910 29 CFR 1910.120, and/or 29 CFR 1926.1101 as applicable) and Environmental Protection Agency (EPA) standards (reference 40 CFR, particularly the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) and/or Resource Conservation and Recovery Act (RCRA)), and any other applicable federal, state and/or local laws, rules, regulations, and ordinances.
Health and Safety Program. Notwithstanding any limitation in the OHS Regulation regarding the number of workers in any work force, Project Co shall prepare and submit to the Province’s Representative in accordance with the Review Procedure prior to mobilization by Project Co to the Project Site a formal written health and safety program (the “Health and Safety Program”) in respect of the Project Site that:
(a) complies with Good Industry Practice and all Laws (including all applicable specifications and standards in Health and Safety Laws);
(b) satisfies the requirements of Section 3.3 of Part 3 of the OHS Regulation;
(c) is designed to prevent injuries and occupational diseases within the contemplation of the WCA and the OHS Regulation;
(d) provides for the establishment and maintenance of a system or systems and a process or processes to ensure compliance with all Health and Safety Laws and to satisfy Project Co’s obligations in respect of occupational health and safety under this Agreement;
(e) without limiting the foregoing, deals specifically with controlling the hazards of the Project Site, including such hazards as may be identified in hazard identifications provided in the Disclosed Data, and as such hazard identifications are updated by Project Co from time to time throughout the Access Period for the relevant portion of the Project Site;
(f) implements the Health and Safety Policy and Program (as defined in the BCIB- Contractor Agreement); and
(g) satisfies and addresses all health and safety requirements contained in the Conditions of Access. Project Co shall prepare and submit to the Province’s Representative in accordance with the Review Procedure updates to the Health and Safety Program as required from time to time to ensure that the Health and Safety Program at all times complies with the requirements of this Agreement, including this Section 4.13.
Health and Safety Program. The contractor shall establish and administer a health and safety program in accordance with GPR 1700.
