Matters Subject to Grievance Procedure. Any employee in the competitive service shall have the right to appeal, under this Rule, a decision affecting his/her employment over which his/her appointing power has partial or complete jurisdiction and for which appeal is not provided by other laws, regulations or is not prohibited.

Matters Subject to Grievance Procedure. A. Violation of a specific term of this Memorandum of Understanding between the City and the Association; B. Improper application of rules, regulations and procedures; C. Unfair treatment, including coercion, restraint or reprisal; D. The impact of a reduction in force action (layoff); E. Promotion procedures unfairly implemented; F. Discrimination because of race, religion, color, creed, disability, sex, marital status, national origin or sexual orientation; or G. Any other matter affecting the terms and conditions of employment.

Matters Subject to Grievance Procedure. A "grievance" is a formal, written allegation by a grievant that he/she has been adversely affected by an existing violation, misinterpretation, or misapplication of the specific provisions of the Agreement and/or provisions of Chapter 2.80 of the Municipal Code, known as the Civil Service System. To challenge or change the policies of the City as set forth in the rules and regulations, procedures must be undertaken under separate legal processes. Other matters for which a special method of review is provided by law, ordinance, resolution or by administrative regulations and procedures of this City, are not within the scope of this procedure.
