Nature and Terms. The Board of Education of the Ithaca City School District, having determined that the Ithaca Teachers Association is supported by a majority of the employees in a unit composed of all employees of said district, professionally certified by the Department of Education of the State of New York or occupying positions for which such professional certification is normally required and all licensed Occupational Therapists, except for the Superintendent of Schools, Central Office Staff, Principals, Vice Principals, Supervisor of Attendance, and per diem substitutes, hereby recognizes the Ithaca Teachers Association as the exclusive representative of the employees in such unit for the purposes of negotiations regarding wages, hours, and terms and conditions of employment and in the settlement of grievances and for all other lawful purposes under the laws of the State of New York.

Nature and Terms. 1. The Board of Education of the Syracuse City School District, having determined that the Syracuse Teachers Association, Incorporated, is supported by a majority of the employees in Unit 7 (Food and Nutrition Services), and that the Syracuse Teachers Association, Incorporated, was certified as the said employees’ bargaining agent on February 17, 1981, by the Syracuse City School District Employment Relations Council, hereby recognizes the Syracuse Teachers Association, Incorporated, as the exclusive representative of all employees in the Unit, and hereby extends to the Syracuse Teachers Association, Incorporated, the following rights: a. to represent exclusively Unit 7 employees in negotiations regarding wages, hours, and terms and conditions of employment; b. to represent Unit 7 employees in the settlement of grievances; c. to unchallenged representation status for the duration of this Agreement with the exception that the statutory period of challenge shall be observed. 2. During the period of recognition hereunder, the Board agrees not to negotiate in any way with any other organization representing, or attempting or seeking to represent, or claiming to represent, employees in the negotiating unit represented by the Association. 3. In the event that any competing employee organization claims the right to represent the employee in said Unit, the selection of an employee’s representative shall be determined in accordance with the New York State Public Employees Fair Employment Act (“Xxxxxx Law”).

The Association will be the sole representative of the negotiating unit until a formal challenge is made and until such time as the Board agrees not to negotiate with any organization or individual other than the Association concerning any provision of this Agreement.

During the period of recognition hereunder, the Board agrees not to negotiate in any way with any other organization representing, or attempting or seeking to represent, or claiming to represent, employees in the negotiating unit represented by the Association. 3. In the event that any competing employee organization claims the right to represent the employees said Unit, the selection of employee representative shall be determined by the Public Employment Relations Board. 4. Insofar as practicable, no summer school or adult evening school position shall be filled by an employee not regularly employed by the District, if there is an equally qualified and available applicant for such position who is regularly employed by the District in this, the bargaining Unit.

During the period of recognition hereunder, the Board agrees not to negotiate in any way with any other organization representing or attempting or seeking to represent, or claiming to represent, employees in the negotiating Unit represented by the Association. 3. The Board of Education of the Arlington Central School District, having determined that the Arlington Teachers’ Association is supported by a majority of the employees in a unit composed of all professional staff members other than the Superintendent of Schools, Assistant Superintendent, Director of Pupil Personnel Services, Supervisor of Special Education, Assistant to the Superintendents, Principals, Assistant Principals, Administrative Assistants, Business Administrator, Director of Personnel, Curriculum Director, Director of Professional Development and Program Evaluation, Building Curriculum Administrator, Director of Library Services, Elementary Curriculum Specialists, Elementary Teacher Assistants to the Principals, Attendance Teacher, Adult Education Teachers, Substitute Teachers, per diem personnel, aides, monitors, school nurses, dental hygienist, teachers’ assistants and those positions yet to be created which do not include people working directly with students, has recognized the Association as the exclusive representative of the employees in such unit for the purpose of negotiations regarding wages, hours and terms and conditions of employment and in the settlement of grievances and for all other lawful purposes under the laws of the State of New York. Such recognition shall extend for the maximum period allowed by law, and this contract shall determine the conduct between the Board of Education and the professional staff members who comprise this unit. 2. In the event that any competing employee organization claims the right to represent the employees in said unit and furnishes the proof of membership and support as above specified, then the selection of employee representative shall be determined in accordance with the Public Employees Fair Employment Act and the rules of the Public Employment Relations Board. 3. During the period of recognition hereunder or under any renewal of such recognition, the Board agrees not to negotiate or deal in any way with any other individuals or organizations representing or claiming to represent the employees within the employer - employee negotiating unit represented by the Association.
