Leave Administration. (a) Any leave rights or benefits under this Article shall not be available to probationary Employees, as defined in Article 11 of this Agreement. In extenuating circumstances (e.g. bereavement, jury duty, serious personal illness) the Employer may grant probationary Employee unpaid leave time.
(b) Time absent on unpaid leave shall not be regarded as time worked for any purpose under this Agreement, with the exception of seniority rights to the extent provided in Article 11 and as is referenced in subparagraph (d), below.
(c) Upon the termination of an unpaid leave of twelve (12) weeks or less under this Article the Employee shall be returned to the job (if still in existence) held prior to the commencement of leave. All Employees returning to work after twelve (12) weeks shall first displace any substitute who is on a regular schedule of runs. If there are no substitutes to displace, the Employee returning from leave shall serve as a utility driver until the next open route becomes available, to which they shall be assigned.
(d) Employees on unpaid leave shall retain and/or accrue seniority during those intervals in accordance with the provisions of Article 11 of this Agreement. Employees shall not accrue sick leave or personal leave entitlement while on unpaid leaves of absence. In regards to step increases, the employee must complete at least 50% of their scheduled work requirement to be eligible to advance to the next step the following year.
(e) To the extent required by the Family and Medical Leave Act, an eligible Employee shall be granted leave and the other rights specified by that law. All such leaves shall run concurrently with paid or unpaid leaves taken for the same purposes under this Agreement. When leave is taken by an Employee under the Family and Medical Leave Act, the Employer shall likewise enjoy all rights afforded it by that law, whether or not the same are specifically enumerated in this Agreement. The parties intend that the provisions of the Family and Medical Leave Act, including Employer and eligible Employee rights and responsibilities, shall prevail over the terms of this Agreement to the extent of any conflict or inconsistency. This provision does not confer upon Employees or the Employer greater or fewer rights or benefits than those for which they are otherwise eligible under the Family and Medical Leave Act. Leave Administration. 1. An employee shall, at the earliest practicable time, give the Employer notice of his/her desire to be granted a leave so that the Employer will have the maximum time to provide for the employee's absence. A leave for elective health care, civic responsibilities, jury duty, or Association leave, shall be requested at least seven (7) work days prior to the requested leave date, except that a shorter notice may be permitted because of unforeseeable circumstances. The Employer shall ordinarily respond within three (3) work days, unless Board action is required.
2. The Employer shall have the right to have an employee examined by a physician of its choice at the sole expense of the Employer in those cases where an employee's physical or mental state is in question.
3. An employee who becomes President of the Michigan Education Association may be given leave of absence for a period of not more than three (3) school years for the purpose of performing duties for that Association in accordance with Article 10, D, 1.
4. The Employer may, at its discretion, grant a leave of absence to any employee to campaign for his/her own election to or to serve in public office in accordance with Article 10, D. 1.
5. An employee who is on an approved leave of absence for fifty percent (50%) or more of any semester will not advance on the salary schedule for that semester.
6. An employee shall not lose sick days, personal days, or experience a reduction in pay on days when attendance is not required by the Employer due to inclement weather.
Leave Administration. Family medical leave will be administered in accordance with the applicable law and the Employer’s policy regarding use of accrued sick leave, use of vacation benefits and continuation of benefits. All leaves of absence are unpaid except to the extent that an employee uses accrued sick leave and/or vacation time during the otherwise unpaid portion of the leave. No vacation or sick time will accrue during the unpaid portion of family leave.
Leave Administration. A. A teacher shall give the Board notice of his/her desire to be granted a leave as soon as he/she is aware that a leave will be required so that the Board will have the maximum time to provide for the teacher's absence.
B. Any leave granted pursuant to this Article shall be agreed to in writing by the Board and the teacher. Each leave agreement which extends for a period of more than ninety (90) calendar days shall require that the teacher notify the Board in writing at least thirty (30) days before the termination of the leave that the teacher intends to return. If the teacher fails to give such notice, the teacher shall be considered to have resigned.
C. A leave granted pursuant to this Article shall not be terminated early without the prior permission of the Board.

Leave Administration. 25.02(a). Short Term. Employees working short term on a higher level assignment or detail will be entitled to approved sick leave or annual leave at the higher level rate for a period not to exceed three (3) days, provided they resume work on the higher level assignment or detail upon return to work from the sick leave or annual leave. Short term shall mean that an employee has been on a higher level assignment or detail for a period of not more than 29 consecutive workdays at the time the leave is taken. All short term assignments or details will automatically be canceled if replacements are required for the absent detailed employees.
Leave Administration. Employees assigned to this schedule will be charged for 10 hours of leave for each full day of annual leave or sick leave taken.
