Retention Categories. The District shall determine the positions to be retained and the 13 certification/endorsement requirements for such positions. Such certification/endorsement 14 requirements shall form the basis for the establishment of district-wide retention categories:
15 1. Elementary P-5 classroom teachers (including Title, LAP and Special Education 16 teachers) or current grade level configuration;
17 2. Elementary subject-area specialists, currently music, physical education, and library;
18 3. Secondary subject-area teachers (such as but not limited to, science, math, music and 19 library);
20 4. Education staff associates (such as counselor, nurse, school psychologist or others with 21 ESA certification);
22 5. Other categories as agreed to by District and Association Leadership Team. 23

Retention Categories. Surplussing and reduction in force will be determined based on seniority within qualifying categories. Administrators shall be considered for retention in the followingcategories.

Retention Categories. 1529 In the event that there are more qualified employees than available positions in a 1530 given category or specialty the following criteria shall be used to determine which 1531 employees shall be recommended for retention.

27 2. Middle school (6-8) subject-area teachers
28 3. High school (9-12) subject-area teachers
29 4. Support Staff (counselors, instructional coaches, learning specialists, librarians, 30 occupational therapists, physical therapists, speech and language pathologists, and
32 5. Special Education teachers
Retention Categories. Employees shall be considered for retention in available positions within the categories for which they qualify. In the event that there are more qualified employees than available positions, the following criteria shall be used to determine which employees shall be recommended for retention:
A. Total seniority as a certificated administrator less any seniority attributable to any position of lower rank than the position under consideration shall be the basis for retention for those categories in 6.4.
B. Total seniority as a certificated employee shall be the basis for retention in category 6.4 (A). Within each such category the senior employee(s) shall be recommended for retention.
C. In the case of equality of seniority within categories identified in 6.5 (B) above, the employee(s) with the most number of years in the Washington Public Schools shall have preference. If equality of seniority should still exist, the employee with the most number of years in the Peninsula School District shall have preference. If ties remain, the employees to be retained shall be determined by the employees involved by flipping a coin.
Retention Categories. If there are more qualified employees than available positions in a given category or specialty the following criteria shall be used to determine which employees shall be recommended for retention.
1. An employee must be qualified for a position as provided in this procedure.
2. An employee retained shall be the most senior employee available in the category or specialty.
3. In case the District must locate an employee for retention or recall with unique qualifications, the District may retain, or recall said employee provided that no employee with more seniority qualifies for said position.
4. The District shall have the right to assign and transfer employees during the implementation of this procedure to positions for which they qualify.
5. The District shall not partially layoff an employee. Employees will not be offered recall to less than full-time employment until all more senior employees in the appropriate employment category have been employed on a full-time basis. An employee shall have the right to refuse recall to a part- time position without losing recall rights.
6. The list of proposed retention and lay-off shall be delivered to the Association and all employees by May 15th of the year that this procedure is being implemented.

(f) Other K-12 certificated staff by specialty (such as, but not limited to, librarian, district-level specialist);
(g) Special education teachers, and
(h) Other categories as agreed to by the District and Association leadership.
Section 6.8.9 Retention List All retired, resigned, and current leave replacement employees will be removed from the seniority list referred to in Section 6.8.3. Provisional employees, starting with the most senior, will be moved to the bottom of this list starting below the least senior non-provisional employee. This revised seniority list will be used during the process of placing employees who have been moved to the “displaced employee” list into positions.
Section 6.8.9.1 The District will provide the Association a preliminary list of transferred and laid off employees seven (7) days before notifying employees of transfer or layoff.
