Retiring Leave Clause Samples
The Retiring Leave clause defines the entitlements and procedures for employees who are retiring to take accrued leave before their official retirement date. Typically, this clause outlines the types of leave that can be used, such as annual or long service leave, and specifies the process for notifying the employer and scheduling the leave period. Its core function is to provide a clear framework for both employees and employers to manage the transition to retirement, ensuring that accrued benefits are used appropriately and reducing ambiguity around end-of-service arrangements.
Retiring Leave. 3.10.1 Except as provided by 3.10.2 below, a full-time caretaker on completion of 40 years’ service, or on completion of 10 or more years’ service at age 60 or over, is entitled to qualify for retiring leave. The entitlement in working days ranges from 22 days after 10 years' eligible service to 131 days after 40 years' service. Service in excess of 40 years does not attract a greater retiring leave entitlement.
3.10.2 A permanent part-time caretaker who meets either criteria set out in 3.10.1 above and who was previously full-time but had his/her hours reduced as a result of clause 6.1 of this Agreement, shall also remain entitled to qualify for the Retiring Leave based upon his/her average weekly hours set over the five years immediately preceding the date of retirement (e.g, a full-time caretaker whose set hours are reduced to 30 exactly two years six months before retirement and who would have been entitled to 100 days, is entitled to 87.5 days i.e., the midpoint between 0.75 and 1).

Retiring Leave. An employee entitled to retirement leave as pursuant in Part 2 (“Transition to Collective Agreement”) of the Secondary and Area Groundstaff Collective Agreement 2002-2003, will continue to maintain that entitlement, as set out in Appendix B.
Retiring Leave. 7.8.1 The following shall be entitled to retiring leave as set out in Schedule B. Retiring leave shall be calculated on a pro rata basis according to the employee’s record of service.
a) Permanent employees (including part time and full-time permanent employees) who have attained eligibility for NZ Superannuation and completed at least 10 years' service; or
b) Permanent employees who have established eligibility for retirement on medical grounds. Such employees shall be entitled to retirement leave of 65 working days where the length of service does not exceed 25 years, and retirement leave in accordance with Schedule B otherwise.
7.8.2 For employees whose services are dispensed with through no fault of their own, before reaching eligibility for New Zealand Superannuation, the employer will consider granting retiring leave in accordance with this Table: Qualification Required Retiring Leave (working days) Completion of 15 years' service 65 days Completion of 10 and under 15 years' service 44 days Completion of 5 and under 10 years' service 22 days
7.8.3 Instead of granting retirement leave as above, an employer may, on application from the employee, pay a lump sum equivalent in value to that leave.
7.8.4 An employee who has more than 20 years' continuous service, or is eligible to retire on the grounds of age or service, shall be entitled to anticipate retiring leave in terms of Schedule B.
7.8.5 On the death of an employee the employer may approve a cash grant in lieu of retiring leave to the spouse or dependants or the estate of the deceased employee.
Retiring Leave. These provisions are applicable only to employees who started in MAF before 1 January 2001 and to those who were covered by the MFish Collective on 2 May 2013.
Retiring Leave. 13.2.1 Retirement leave is only available to those staff appointed to the Education Review Office prior to 1 July 2003. Upon retirement an Employee with at least 10 years continuous service shall be granted retirement leave of 22 days for 10 years continuous service. 13.2.2 An Employee, who has more than 20 years continuous service, may anticipate retiring leave.
Retiring Leave. (a) Retiring leave, as set out in Schedule B, may be granted to a permanent Employee who retires.
(b) Only permanent Employees who are within ten (10) years of reaching the age eligibility for National Superannuation may apply for retiring leave.
19.2 The amount of retiring leave granted to an Employee shall be reduced by the amount of long-service leave taken by the Employee.
19.3 Retiring leave shall be calculated on a pro rata basis according to the Employee's record of service.
Retiring Leave. 3.2.1 It is agreed that Employees may retire from employment at any time after having qualified for national superannuation. Where the Employee has provided the Employer with a medical opinion from a registered medical practitioner nominated by the Employer, the Employer may permit an Employee to retire prior to qualifying for national superannuation.
3.2.2 Only Employees engaged as at 16 September 1998 will be eligible for retiring leave subject to meeting the provisions of Schedule B.
Retiring Leave. 6.10.1 The following shall be entitled to retiring leave as set out in Schedule B. Retiring leave shall be calculated on a pro rata basis according to the employee's record of service
6.10.2 Full-time employees who have attained the age of 60 years and completed at least 10 years' service; or
6.10.3 Full-time employees who have established eligibility for retirement on medical grounds. Such employees shall be entitled to retirement leave of 65 working days where the length of service does not exceed 25 years, and retirement leave in accordance with Schedule B otherwise.
6.10.4 North Tec may approve the early retirement of an employee who has attained the age of 50 with 10 years' service
Retiring Leave of the expired 1991/92 collective employment agreement will continue to apply.

17.1.1 Permanent employees who have attained the age of qualification for Guaranteed Retirement Income and completed at least 10 years' service; or
17.1.2 Permanent employees who have completed at least 10 years' service and who have established eligibility for retirement on medical grounds. Such employees shall be entitled to retirement leave of 65 working days where the length of service does not exceed 25 years, and otherwise retirement leave in accordance with Schedule B.
17.2 On the death of an employee, the employer may approve a cash grant in lieu of retiring leave to the spouse or dependents or the estate of the deceased employee.
