Site Stability. The Parties acknowledge that this Agreement is intended to achieve labour relations stability on the Project. It is a violation of this Agreement for any of the Parties, the Employers or their respective Employees or members to do anything to harm, delay, or otherwise impede the performance of the Capital Works or the construction of the Project. Any individual(s) engaging in such conduct shall be subject to immediate removal from the Project Site and discipline in accordance with the applicable Agreement-Based LOUs.

Site Stability. 4.01 The Parties acknowledge this Agreement is designed to achieve labour relations stability on the Work Site. It is a violation of this Agreement for any of the Parties to do anything to harm, delay, or otherwise impede construction of the Site C Clean Energy Project including a failure to adequately understand and follow safety rules and procedures applicable to the Work Site. Any individual acting in violation of this Article may be subject to immediate removal from the Work Site if there is an emergent safety or emergency situation arising from such behaviour. Any removal from the Work Site is subject to the grievance procedure contained in this Agreement. 4.02 The Unions agree that Employees will not engage in any form of violence, harassment, intimidation, bullying, or any other disparaging or demeaning conduct directed by an Employee to another Employee for any reason including based on any union affiliation or lack of union affiliation, including any verbal or written communications, or gestures. The Proponent will have a policy that prevents discrimination on the BOP Project on the basis of prohibited grounds as outlined in applicable human rights legislation and Workers Compensation Act of BC. 4.03 The Proponent may establish uniform and consistent rules and policies including rules and policies with respect to accommodation, health and safety, security, workplace conduct and access for the BOP Project. All Employees and Union representatives attending at the Project Site will be required to undergo orientations and agree to such rules and policies as the Owner and/or Proponent may reasonably establish from time to time.

The parties acknowledge that the Owner has the right to remove any Employee or other person from the Project should they engage in any such activities. c) No Employee shall refuse to work with or alongside any other individual on the basis of their union affiliation, non-union affiliation or other status. d) No employee will refuse, or threaten to refuse to perform work for their employer for reason that other work was or will be performed, or was not or will not be performed by any persons who were or were not or are or are not members of a particular trade union.

The Parties will not tolerate any form of violence, harassment, intimidation, bullying, or any other disparaging or demeaning conduct directed by Employees, Union representatives, or other persons, against other Employees, Union representatives, or other persons based on Union affiliation, or lack of Union affiliation. This prohibition includes all verbal communications, written materials, and gestures. The Owner and HCML have the right to remove any Employee, Union representative, or other person from the Project site should they engage in any such activities. 2.10.4 The Parties agree it is in the best interests of the Owner, the Parties, Employers, and Employees to have Employees working on the Project who are free to work for any Employer, regardless of Union affiliation, or lack of Union affiliation. The Parties are aware that certain Unions have Sanctioned their members for working for Employers who do not have a Bargaining Relationship with that Union. The Parties wish to discourage such Sanctions against Employees. Therefore, the following will apply: (a) HCML will refuse to allow on the Project site any representative of a Union which has Sanctioned one or more of its members for working on the Project for an Employer who does not have a Bargaining Relationship with that Union; (b) If any Union Sanctions an Employee for working on the Project for an Employer who does not have a Bargaining Relationship with that Union, then HCML may direct that any check-off, or other Emp...
Site Stability. 4.01 The Parties acknowledge that this MOU is designed to achieve labour relations stability on the Project. It is a violation of this MOU for any of the Parties, International Unions, Employees, or Local Union members to do anything to harm, delay, or otherwise impede construction of the Project. Any individual(s) engaging in such conduct may be subject to immediate removal from the Project and any of the Parties involved in, or responsible, for such conduct may be held liable for any and all financial or other losses resulting from such a violation. 4.02 During the term of this MOU, there shall be no strikes, lockouts, work stoppages, work slowdowns, work-to-rule, or other disruptive activity, for any reason, by any Party, Local Union member (including permitted members), International Union, International Union representative(s), or Employee which in any way interferes with or otherwise restricts the progress of the Project. In the event of any such disruptive activity, the Parties will undertake immediate action and instruct the offending individual(s) to cease the disruptive activity. The Local Unions agree that in the event of any strike or lock-out commenced pursuant to the Labour Relations Code, such strike or lock-out shall not apply to the Project. The Local Unions and Council waive any right they may have at law to commence, or require that any such strike be conducted, under the Labour Relations Code as it applies to the Project. 4.03 For the purposes of this MOU, it is understood that the following circumstances will not constitute a strike, work stoppage, disruptive activities or a lock out of Employees: a) A suspension of work or a shutdown of any or of the Project which is deemed necessary for the safety, health or security of any person on the Project; or b) A suspension of any of the work or a shutdown of any or all of the Project which arises due to an emergency, environmental or other reasons beyond the control of the Contractor, including unsuitable weather conditions; or c) A suspension of work or a shutdown of any or all of the Project directed by the Owner to accommodate a declared break established for the Project; or d) A suspension of the work or a shutdown of any or all of the Project at any time during the construction Project, directed by the Owner due to economic or any other unforeseen reasons or circumstances; or e) A suspension of work or extension of the duration of the Project by the Owner.

The Employer may maintain and effectively and efficiently utilize employees with various skills to be prepared to have the skills necessary to perform the work required. Employees of various craft designations will work harmoniously together as per the assigning Employers' direction. Employers do not intend for such assignments to set a precedent or change the jurisdiction of the craft signatory to the assigning Employer.

  • Configuration Management The Contractor shall maintain a configuration management program, which shall provide for the administrative and functional systems necessary for configuration identification, control, status accounting and reporting, to ensure configuration identity with the UCEU and associated cables produced by the Contractor. The Contractor shall maintain a Contractor approved Configuration Management Plan that complies with ANSI/EIA-649 2011. Notwithstanding ANSI/EIA-649 2011, the Contractor’s configuration management program shall comply with the VLS Configuration Management Plans, TL130-AD-PLN-010-VLS, and shall comply with the following:

  • Screening After you sign and date the consent document, you will begin screening. The purpose of the screening is to find out if you meet all of the requirements to take part in the study. Procedures that will be completed during the study (including screening) are described below. If you do not meet the requirements, you will not be able to take part in the study. The study investigator or study staff will explain why. As part of screening, you must complete all of the items listed below: • Give your race, age, gender, and ethnicity • Give your medical history o You must review and confirm the information in your medical history questionnaire • Give your drug, alcohol, and tobacco use history • Give your past and current medication and treatment history. This includes any over-the-counter or prescription drugs, such as vitamins, dietary supplements, or herbal supplements, taken in the past 28 days • Height and weight will be measured • Physical exam will be done • Electrocardiogram (ECG) will be collected. An ECG measures the electrical activity of the heart • You may be tested for COVID-19 o Blood tests for human immunodeficiency virus (HIV), hepatitis B, and hepatitis C o Blood tests to see how your blood clots ▪ Fibrinogen ▪ PT/INR/aPTT o Blood tests for amylase and lipase (enzymes that help with digestion, Part B only) o Blood tests for a lipid (fats) panel (Part B only) ▪ Total cholesterol ▪ Triglycerides ▪ HDL ▪ Direct HDL o Blood tests to check your thyroid function (Part B and Part C only) ▪ TSH ▪ Free T4 o Urine to test for drugs of abuse (illegal and prescription) o Urine tests to check your albumin/ creatinine ratio o Females who have not had a period for at least 12 months in a row will have a blood hormone test to confirm they cannot have children • The study investigator may decide to do an alcohol breath test • The use of proper birth control will be reviewed (males only) • You will be asked “How do you feel?” HIV, hepatitis B, and hepatitis C will be tested at screening. If anyone is exposed to your blood during the study, you will have these tests done again. If you have a positive test, you cannot be in or remain in the study. HIV is the virus that causes acquired immunodeficiency syndrome (AIDS). If your HIV test is positive, you will be told about the results. It may take weeks or months after being infected with HIV for the test to be positive. The HIV test is not always right. Having certain infections or positive test results may have to be reported to the State Department of Health. This includes results for HIV, hepatitis, and other infections. If you have any questions about what information is required to be reported, please ask the study investigator or study staff. Although this testing is meant to be private, complete privacy cannot be guaranteed. For example, it is possible for a court of law to get health or study records without your permission.

  • Engineering Forest Service completed survey and design for Specified Roads prior to timber sale advertisement, unless otherwise shown in A8 or Purchaser survey and design are specified in A7. On those roads for which Forest Service completes the design during the contract, the design quantities shall be used as the basis for revising estimated costs stated in the Schedule of Items and adjusting Timber Sale Account. (a) A7 to show Purchaser’s performance responsibility. (b) The Schedule of Items to include costs of survey and design, as provided under B5.24, and adjust Timber Sale Account, as provided in B5.

  • Quality Improvement VRC shall develop programs designed to improve the quality of care provided by the Radiologists and encourage identification and adoption of best demonstrated processes. Practice and VRC acknowledge that, in connection with such quality improvement activities, it may be necessary to provide VRC with Protected Health Information and Practice and VRC agree to treat such information in accordance with Article 9;

  • Laboratory a. Drug tests shall be conducted by laboratories licensed and approved by SAMSHA which comply with the American Occupational Medical Association (AOMA) ethical standards. Upon advance notice, the parties retain the right to inspect the laboratory to determine conformity with the standards described in this policy. The laboratory will only test for drugs identified in this policy. The City shall bear the cost of all required testing unless otherwise specified herein. b. Tests for all controlled substances, except alcohol, shall be by oral fluid testing and shall consist of two procedures, a screen test and, if that is positive, a confirmation test. c. To be considered positive for reporting by the laboratory to the City, both samples must be tested separately in separate batches and must also show positive results on the confirmatory test. d. In the event of a positive test, the testing laboratory will perform an automatic confirmation test on the original specimen at no cost to the Covered Employee. In addition, the testing laboratory shall preserve a sufficient specimen to permit an independent re-testing at the Covered Employee’s request and expense. The same, or any other, approved laboratory may conduct re-tests. The laboratory shall endeavor to notify the designated MRO of positive drug, alcohol, or adulterant tests results within five (5) working days after receipt of the specimen.

  • Vulnerability Management BNY Mellon will maintain a documented process to identify and remediate security vulnerabilities affecting its systems used to provide the services. BNY Mellon will classify security vulnerabilities using industry recognized standards and conduct continuous monitoring and testing of its networks, hardware and software including regular penetration testing and ethical hack assessments. BNY Mellon will remediate identified security vulnerabilities in accordance with its process.

  • Research Analyst Independence The Company acknowledges that the Underwriters’ research analysts and research departments are required to be independent from their respective investment banking divisions and are subject to certain regulations and internal policies, and that such Underwriters’ research analysts may hold views and make statements or investment recommendations and/or publish research reports with respect to the Company and/or the offering that differ from the views of their respective investment banking divisions. The Company hereby waives and releases, to the fullest extent permitted by law, any claims that the Company may have against the Underwriters with respect to any conflict of interest that may arise from the fact that the views expressed by their independent research analysts and research departments may be different from or inconsistent with the views or advice communicated to the Company by such Underwriters’ investment banking divisions. The Company acknowledges that each of the Underwriters is a full service securities firm and as such from time to time, subject to applicable securities laws, may effect transactions for its own account or the account of its customers and hold long or short positions in debt or equity securities of the companies that may be the subject of the transactions contemplated by this Agreement.
