Use of Seniority. Seniority shall be used to determine the relative rights of employees within an occupational group as expressly set forth in this Agreement. Seniority shall not be deemed to establish any right to the continuation of the performance of any work at the Company nor to the continuation of any particular job classification or arrangement of duties within any job classification at the Company.
Use of Seniority. Seniority shall be used to accommodate employees' preferences where the collective agreement so provides.
Use of Seniority. Department Seniority is used to determine the order of layoff and recall within a classification within a particular department. Classification seniority is used for preference for scheduled shifts within a classification with a particular department.
Use of Seniority. Insofar as practicable, employees covered by this Agreement shall have seniority rights in grade, and insofar as practicable, seniority shall prevail with respect to the following:
a. Transfers to any position within the department; provided, however, that with respect to transfers from one division to another division within the department, the only bid position will be the lowest ranking one in the division. All positions above the lowest ranking one in the division shall be filled, if vacant, by either promotions from within the division or by a transfer made by the Chief of the Department.
b. Days off, holidays, and any and all circumstances or situations by whatever name they may be given, except as provided in Paragraph (a) above; provided, however, that an employee may reject the position or benefit at his or her discretion without the need of any explanation on his or her part. Further, in the event that an employee shall reject a position or benefit, it shall not be construed as a waiver of his or her seniority rights in any subsequent situation where seniority would prevail.
c. In order to implement the foregoing, a bid system is hereby established under which employees may bid for jobs or positions. Whenever there is a vacancy, the vacancy shall be posted and all employees in the order of their seniority shall have an opportunity to bid on said position. The senior employee shall be awarded the bid. The successful bidder for any job shall be entitled to a reasonable trial period of not more than sixty (60) calendar days to determine whether he or she can acquire the skills necessary for the performance of said job in a reasonably satisfactory manner; provided, however, that in cases where the City and Local 2748 so mutually agree, such trial period shall not be mandatory. At the end of sixty (60) calendar days from the date of trial transfer, the employee shall be considered as being transferred in accordance with the provisions of this Section except in cases where the City and Local 2748 may mutually agree to extend such trial period.
Use of Seniority. Classification seniority shall prevail in scheduling annual leave, holiday leave, days off, and shift preference, subject to availability as determined by the Department Chief.
A. Shift bids shall begin December 1st and shall be completed by January 15, based on classification seniority, and peace officers shall receive new assignments, if any, beginning the first full two-week pay period in February of each year. At the completion of the initial shift selection, a peace officer's selected shift preference cannot be changed by the peace officer for a period of one year unless good cause is shown and approval given by the Department Chief. Transfer requests between area commands will be submitted in writing, through the chain of command from September 1st through October 15th of each year and approval will be at the discretion of the Chief of Police or designee. Any approved transfer request will be implemented at the implementation of shift bid.
B. Seniority shall be considered exercised when a peace officer uses it to secure the following: • Annual leave request of four (4) or more consecutive days of accrued annual leave, holiday leave, or combination of both. • Holiday leave request of three (3) or fewer consecutive days of accrued annual, holiday, or combination of both. Peace officers must submit leave requests thirty (30) calendar days prior to the beginning of the requested leave to secure their seniority rights. The beginning of the leave shall be on the first day of leave taken. The exercising of Seniority shall be allowed only on one occasion for Annual leave and one occasion for Holiday leave during a one-year period beginning the second pay period in February of each year. Annual leave requests shall have priority over Holiday leave requests.
Use of Seniority. Employees shall use their seniority to access positions within their own program area. Employees shall not be permitted to bump or bid on positions outside of their respective programs. For the purposes of this provision, the programs shall be defined as Transition House programs.
Use of Seniority. 9.03.01 Seniority shall govern all Flight Attendants in their retention in case of reduction in force, vacations, their assignment, or re-assignment due to expansion or reduction in schedules consistent with the employee scheduling procedures, their re-employment after release due to reduction in force and their choice of vacancies.
9.03.02 This clause will apply, except as otherwise stipulated in this Agreement.
