Vacation Leave Policy. Vacation leave is a benefit, and the use of same shall be approved by the City Manager or designee, taking into account the desires and seniority of employees and, more particularly, the workload requirements of the department. Employees shall take vacation leave regularly each year and shall be encouraged to take vacation at least a full week at a time. In order to give effect to this policy and to realize the greatest benefit from vacation for both employee and the City, limitations shall be placed upon the amount of unused vacation leave an employee is allowed to accumulate. If an employee exhausts their vacation leave, the employee may apply for another eligible paid or unpaid leave (excluding sick leave) as provided for in this Memorandum of Understanding. If vacation leave is approved and then it is determined that the employee does not have enough vacation leave available to cover the request and no other leave is requested, Payroll will deduct the excess time from another eligible paid leave balance. No vacation leave accruals will be credited in advance. No vacation leave will be earned while on an unpaid leave. If vacation leave is used to remain in a paid status while on approved leave under the Family Medical Leave Act/California Family Rights or Pregnancy Disability Leave, the vacation hours used will run concurrently with the state and/or federal leave entitlement.

Employees must elect to cash out their vacation leave prior to the last pay period of the fiscal year.

Hours of leave may be granted at any time throughout the layoff notice period and shall not be subject to the Application and Reinstatement provision of this Article.
