Estate Common Areas and Facilities definition

Estate Common Areas and Facilities means collectively the Estate Common Areas and the Estate Common Facilities.
Estate Common Areas and Facilities means the areas, systems, devices and facilities of the said land and the Estate intended for the common use and benefit of the Estate as a whole and not just any particular part thereof, and shall include but not limited to cable duct, fire service inlet, fire services control panel, hose reel water tank, fire service control cabinet, sprinkler water tank, street fire hydrant water tanks, staircases, drop gate at entrance of the Estate, Slope Structures within the said land, transformer rooms, main switch rooms, artisans’ workshop, canopies, cleansing contractor’s office, Emergency Vehicular Access, covered walkway, drainage zone for maintenance access only, electrical meter rooms, extra low voltage room, electric low voltage room, estate management office, fire services pump room, fire services water tank, flat roofs, hose reels, inaccessible void, lift, manholes, master water meter room, material recovery point, owners’ corporation office, pitch roofs, refuse collection point, loading and unloading space reserved for refuse collection vehicles, sprinkler control valve and sprinkler inlet, sprinkler pump and fire services pump room, upper part of refuse collection point, upper part of master water meter room, upper part of street fire hydrant water tanks, upper roof, water meter cupboard, reinforced concrete plinth, external walls (other than those pertaining to the Residential Blocks (if any)), and such other areas and any other systems, devices and facilities provided or installed in the Estate and intended to serve the Estate as a whole and not just any particular part thereof which, for the purpose of identification only, are shown coloured orange, orange cross hatched black and orange with black cross (insofar as such areas, systems, devices and facilities are identifiable on such plans) on the plans annexed to the DMC and such additional areas, systems, devices and facilities of the said land and the Estate intended for the common use and benefit of the Estate as a whole and not just any particular part thereof as may at any time be designated as Estate Common Areas and Facilities by the Hong Kong Housing Authority (hereinafter referred to as “HA”) in accordance with the provisions of the DMC but (unless otherwise expressly defined and provided under the DMC) shall exclude the Residential Blocks Common Areas and Facilities, those installations belonging to any Utility Company and telecommunications and broadcasting services providers and such areas...
Estate Common Areas and Facilities means those parts, areas, services and facilities which are intended for common use and benefit of the Owners of the Estate as a whole and not for the sole benefit of any Owner or group of Owners of the Estate including but not limited to :

Examples of Estate Common Areas and Facilities in a sentence

  • The Estate Common Areas and Facilities shall be deemed to be common areas and facilities for the benefit of the Owners which areas and facilities may, subject to the provisions hereof and of Sub-Deed (if any), be used by each Owner in common with all other Owners.

Estate Common Areas and Facilities means those Common Areas and Facilities which are intended for the common use and benefit of all Owners and occupiers of the Estate as a whole and their bona fide guests, visitors and invitees and not for the sole benefit of any particular Owner or group of Owners in accordance with this Deed; and shall include but not limited to:- (a) such of the Greenery Areas (Estate Common Areas and Facilities), caretakers’ quarters, caretakers’ offices, owners’ committee/owners’ corporation office, emergency vehicle access, water tank for street fire hydrant, street fire hydrant pump room, fire service and sprinkler pump rooms, sprinkle inlet, fire service inlet, transformer room, switch room, emergency generator room, fuel tank room, planters, water features, pipe ducts, electric ducts, hose reels, cable ducts; (b) the Covered Landscape Area (Estate Common Areas and Facilities), the Pink Stippled Black Area, the Slopes which are located within the Lot, foundation and all structural or load bearing elements of the Estate, the unexcavated area of the Lot, the boundary walls (including the glass balustrades forming part of such boundary walls), the external wall of the Garden Duplex (including the finishes and features thereon, curtain walls and those components of the curtain wall system) and the external wall of the Podium (including the finishes and features thereon, curtain walls and those components of the curtain wall system); and (c) such of the Common Areas and Facilities as are now or from time to time provided, installed or designated by the Manager or the First Owner (as the case may be) for the common use and benefit of the Estate as a whole in accordance with this Deed; BUT EXCLUDING those areas parts and facilities forming the Residential Common Areas and Facilities, the Tower Common Areas and Facilities, the Carpark Common Areas and Facilities and such areas within the Estate the exclusive right and privilege to hold, use, occupy and enjoy the same belongs to any particular Owner.
