GOVERNING LAW AND JURISDICTION. In accordance with the law, it is stipulated that all actions for public liability brought with respect to voluntary public auctions are limited to five years from the auction or sale. French law exclusively governs these terms and conditions of purchase. Any dispute relating to their existence, validity, applicability to any bidder and buyer and their performance will be settled by the competent court in the jurisdiction of Paris (France).
GOVERNING LAW AND JURISDICTION. This Agreement is governed by the law of the jurisdiction set out in Table 1 corresponding to the Qlik entity identified therein as the contracting party, but excluding any conflict of law rules or the United Nations Convention on Contracts for the International Sale of Goods, the application of which is hereby expressly excluded. Any suit, action or proceeding arising out of or relating to this Agreement will be brought before the courts or arbitration boards set out in Table 1 corresponding to the contracting Qlik entity and conducted in the English language. The Parties hereby expressly and irrevocably submit to the exclusive jurisdiction of such courts or arbitral bodies for the purpose of any such suit, action or proceeding. Notwithstanding anything to the contrary in this Agreement, either Party may at any time seek injunctive or interlocutory relief in a court of competent jurisdiction in order to protect any urgent interest of such Party, including, but not limited to, the confidentiality and use restrictions of this Agreement. GOVERNING LAW AND JURISDICTION. The law applicable in the country where the Supplier’s registered office is located shall apply to the business relationship between the Supplier and the Customer. The courts with jurisdiction over the Supplier’s registered office shall have jurisdiction over any dispute that arises out of or in connection with the business relationship between the Supplier and the Customer that is not resolved out of court, even in the event of a supplemental application, a third party notice or multiple defendants, regardless of the method and terms of payment.
GOVERNING LAW AND JURISDICTION. These conditions of sale are governed by French law. Any or all disputes relating to the wording, validity and performance that is not settled amicably with the auction house or through the Sale Council will be settled by the court or competent jurisdiction in Paris. According to the law, all liability actions against the auction house or the expert of the sale are limited to five years from the auction.
GOVERNING LAW AND JURISDICTION. All matters relating to the Services and these Terms of Service, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of Saint Vincent and the Grenadines without giving effect to any choice or conflict of law provision or rule.
GOVERNING LAW AND JURISDICTION. By simply registering, any bidder expressly agrees to the present general conditions and recognizes that French law shall be exclusively applicable. If it is not amicably settled, any dispute regarding the interpretation, validity or execution of the auction of the Painting shall be referred to the courts of Compiègne, France. If any of the provisions of the present general conditions should be held to be null and void the remaining provisions will remain valid and applicable, by virtue of the principle of severability. In case of any discrepancies between the French version and a version translated into another language, the French version, which is the legal one, prevails.
GOVERNING LAW AND JURISDICTION. These terms and all matters arising from or in connection with them shall be governed by and construed in accordance with English law provided that if you are a consumer and have your habitual residence in the EU, you additionally enjoy the protection afforded to you by mandatory provisions of the law of your country of residence. We both agree to submit to the non-exclusive jurisdiction of the courts of England & Wales, which means that you may bring a claim to enforce your consumer protection rights in connection with these terms in England or in the EU country in which you live.
GOVERNING LAW AND JURISDICTION. 13.1 This Charter shall be governed by and construed in accordance with the laws of France. 13.2 The courts of Paris, France, shall have exclusive jurisdiction to settle any dispute arising from or in connection with this Charter (including any dispute regarding the existence, validity or termination of this Charter).
GOVERNING LAW AND JURISDICTION. ORDERS ARE RULED BY FRENCH LAW. THE 1980 VIENNA CONVENTION ON CONTRACTS FOR THE INTERNATIONAL SALE OF GOODS SHALL NOT APPLY. THE LANGUAGE OF INTERPRETATION IS THE FRENCH LANGUAGE. ALL LAWSUITS INVOLVING THE PRESENT TERMS WILL BE SUBMITTED TO THE COMPETENT LAW COURTS WITHIN
GOVERNING LAW AND JURISDICTION. 10.1 Les CGV forment un ensemble contractuel soumis à la loi française, à l’exclusion de toute autre loi étrangère ou convention européenne ou internationale, quels que soient la nationalité du Client ou le lieu d’exécution des commandes qu'elles régissent. 10.2 Le Client consommateur est informé qu’en cas de différend entre les Parties relatif à la validité, l’interprétation, l’exécution ou la cessation de leurs relations contractuelles soumises aux CGV, il dispose du droit de saisir un médiateur de la consommation, en application de l’article L.612-1 du Code de la consommation. A défaut de résolution amiable ou de médiation, tout différend entre les Parties relèvera de la compétence exclusive des tribunaux de Paris, même en cas d’appel en garantie ou de pluralité de défendeurs. 10.1 The GTC form a contractual whole to which applies French law, and excludes the application of any other foreign law, European or international law or convention, whatever the Client’s nationality or the place of execution of the orders that they govern. 10.2 The consumer Client is informed that in case of dispute between the Parties regarding the validity, interpretation, execution or termination of the contractual relationship submitted to the GTC, they have the right to refer to the French Médiateur de la consommation, in accordance with article L.612-1 of the French Code de la consummation. If no amicable resolution to the dispute or no mediation is found, any dispute between the Parties shall fall within the exclusive competence of Paris Courts and jurisdictions, even in case of multiple defendants or third-party proceedings.
