ACCELERATED GRIEVANCE PROCEDURE. Section 1. Where an employee of the Commonwealth represented by the OPEIU has the right to process a grievance through either the procedure provided herein or through the Pennsylvania Civil Service Commission and files an appeal with the Commission, either the memorandum grievance procedure shall cease, if the employee has submitted a memorandum grievance, or the employee shall not be entitled to institute proceedings under the memorandum grievance procedure. If the appeal to the Commission is withdrawn by the employee or not accepted by the Commission within the time limits prescribed in Section 3 of this Recommendation, the processing of a timely filed memorandum grievance shall be permitted. Additionally, if the appeal to the Commission is not accepted outside the time limits prescribed in Section 2 of this Recommendation, the employee shall be entitled to institute proceedings under the memorandum grievance procedure within fifteen (15) working days of the date of the Commission's denial of appeal. Any grievance appealed outside the fifteen (15) working day limit shall be considered untimely filed.
ACCELERATED GRIEVANCE PROCEDURE. Section 9. Where an employee has the right to process a grievance through either the procedure provided herein or through the Pennsylvania Civil Service Commission and files an appeal with the Commission, either the contract grievance procedure shall cease, if the employee has submitted a contract grievance, or the employee shall not be entitled to institute proceedings under the contract grievance procedure. If the appeal to the Commission is withdrawn by the employee or not accepted by the Commission within fifteen (l5) working days of the date of the occurrence of the action giving rise to the grievance, the processing of a contract grievance filed within the time limits set forth in Section 10 shall be permitted.
ACCELERATED GRIEVANCE PROCEDURE. 1. Employees or the Union may directly raise a Health and Safety problem in writing on complaint forms provided by the Employer and available from the Union designate. Such written complaints shall be forwarded directly to the designated University Representative (per Section B. 1.).
ACCELERATED GRIEVANCE PROCEDURE a. Any grievance bearing on the interest of a number of employees shall be reduced to writing on the grievance form and may be introduced at Step Two of. the grievance procedure.
ACCELERATED GRIEVANCE PROCEDURE. When an employee discharged or laid off for cause is given a written reprimand or warning, or where discipline is to be made a matter of permanent record, the Union will be promptly notified by the Employer of the action taken. In such cases, the time limits for filing a grievance shall begin to run from the date of such notice to the Union and shall be filed beginning with Step 2. Grievances affecting a number of employees may be treated as a policy grievance and entered directly at the second step of the griev- ance .procedure.
