Administration of Sick Leave. The proper administration of sick leave is a responsibility of the employee and the department head. Unless otherwise provided in the supplemental sections of this MOU, the following procedures apply:

Administration of Sick Leave. Except for the changes in accrual rates set forth in 18.1 the administrative procedures for sick leave shall continue as in effect as of July 1, 1983.

Employees are required to notify their supervisor as soon as possible of their absence due to illness or injury. Administration of Sick Leave. An employee eligible for sick leave with pay will be granted such leave with the approval of the Fire Chief for the following purposes: Personal illness or illness within the immediate family (immediate family is defined based on California Paid Sick Leave law as employee’s spouse, registered domestic partner, children and/or employee’s parents, in-laws, siblings, grandchild and grandparents) or physical incapacity resulting from causes beyond the employee’s control; or Enforced quarantine of the employee in accordance with community health regulations. Except that an employee may not use sick leave for a work-related injury and/or illness once said employee has been determined permanent and stationary. The employee is required to notify the Fire Chief according to department rules and regulations at the beginning of his/her workday if said employee will be absent under the provisions of sick leave. Every employee who is absent from his/her duties for two (2) consecutive days, under the provisions of sick leave, shall file with the Human Resources Director, if so requested, a verification in the form of a physician's certificate or the employee's personal affidavit, verifying the employee’s eligibility for sick leave. The inability or refusal by said employee to furnish the requested information, as herein required, shall constitute good and sufficient cause for disciplinary action, up to and including dismissal. In recognition of exempt status from FLSA, time off for Sick leave purposes shall not be deducted from employee’s accrual unless the employee is absent for the full workday.

Administration of Sick Leave. The following procedure will be followed in administering the sick leave policy of the City: Sick leave shall be granted in accordance with applicable state and federal laws and shall be granted only for absence from duty because of personal illness, disability, necessity for medical, dental or chiropractic care, exposure to contagious disease where such exposure may endanger the health of others with whom the employee would come into contact in the course ofperforming work duties, marriage counseling, psychiatric counseling, activities provided through the City Employee Assistance Programor legal quarantine. An employee may use personal sick leave benefits provided by the employer for absences due to an illness or injury to the employee's child, adult child, spouse, sibling, parent, mother-in-law, father-in-law, grandchild, grandparent, or stepparent, for reasonable periods oftime as the employee's attendance may be necessary, on the same terms upon which the employee is able to use sick leave benefits for the employee's own illness or injury. Sick leave will not be allowed when absence is due to use of intoxicants unless such absence is prescribed by a doctor as part of treatment. To receive approval for sick leave, the employee must communicate with the employee's immediate supervisor not later than sixty (60) minutes before the time set for beginning work or leaving work during the normal work day. However, should it be determined by the supervisor or department head that the employee was unable to contact the supervisor during the time allotted, sick leave may be approved. As deemed appropriate, the Police Chief may require a medical exam, a written statement from a Christian Science Practitioner if the employee is a Christian Scientist, a medical certificate, or a statement from a chiropractor or dentist before granting sick leave with pay. A statement attesting to the employee's ability toreturn to work may also be required before the employee returns to work. An employee gone more than three days must keepthe employer informed of their absence, in addition, an employee absent for more than three days to care for a member of their immediate family must submit a medical certificate from their attending physician. The use of sick leave will be pro-rated in units ofnot less than one (1) hour ofa work day.
