Allocated Days Off. (a) An employee whose ordinary hours of work are arranged in accordance with sub- clause 14.2(c)(i) and (ii) shall be entitled to an allocated day off (ADO) in each cycle of 28 days or 35 days as the case may be. The ordinary hours of work on each of those days shall be arranged to include a proportion of one hour on the basis of 0.4 of one hour for each 8-hour shift worked and 0.5 of one hour for each 10-hour shift worked which shall accumulate towards the employee’s allocated day off duty on pay. (b) A full-time employee’s allocated day off duty shall be determined by mutual agreement between the employee and the employer having regard to the needs of the place of employment or sections thereof. Such allocated day off duty shall, where practicable, be consecutive with the rostered days off prescribed in sub- clause 14.2(e) and (f). Provided that allocated days off shall not be rostered on public holidays. (c) Where the employer and the employee agree, up to five (5) allocated days off may be accumulated and taken in conjunction with the employee’s annual leave or at another agreed time. (d) No time towards an allocated day off shall accumulate during periods of workers’ compensation, unpaid parental leave, long service leave, any period of unpaid leave or the first four weeks of annual leave. (e) Credit towards an allocated day off shall continue to accumulate whilst an employee is on paid personal/carers’ leave. Where an allocated day off duty falls during a period of sick leave, the employee’s available sick leave shall not be debited for that day. (f) Employees entitled to allocated days off duty in accordance with this sub-clause 14.3, shall accrue credits towards an allocated day off duty in respect of each day those employees are absent on: (i) additional annual leave in accordance with sub-clause 21.6(a) (Shift Worker as defined by the Act); (ii) additional annual leave in accordance with sub-clause 21.6(b) (Counter Leave);and (iii) leave in accordance with clause 19 (Public Holidays).

Allocated Days Off. 🗹 Full-Time 🞏 Part-Time 🞏 Casual The Employer may provide the opportunity for Full-Time Employees to access Allocated Days Off (ADOs) by accruing: • 0.4 of an hour for every eight hours worked per day; or • 0.5 of an hour for every ten hours worked per day. a. The Employee will be entitled up to 12 ADOs each year. b. The Employer will grant an ADO at a time requested by the Employee and having regard to the operational needs of the Employer. c. Where possible and by mutual agreement: • the ADO will be consecutive with the days not rostered for duty (but will not be rostered on public holidays); • the ADO must be taken as one whole day and not a part thereof, preferably one ADO per month; • no more than five ADOs may be accumulated and may be taken in conjunction with the Employee’s annual leave or at another agreed time. d. The Employer values its Employees’ work-life balance and encourages Employees to use ADOs for the purposes of rest and recreational pursuits. The Employer may direct the Employee to take an ADO when five ADOs are accrued. e. ADOs are accrued, at the normal rate, for the following: • personal/carer’s leave; • public holidays; • compassionate leave; • study leave. f. The following types of leave or absence do not accrue ADOs: • ADO • annual leave (the base four weeks); • long service leave; • paid and unpaid parental leave; • leave without pay; • workers compensation.
Allocated Days Off. (a) Full time employees who work 8 hours per day over a 19 day month are entitled to an allocated day off (ADO) on the 20th day. Neither Annual or Long Service Leave days count towards the accrual of an ADO. (b) The employee’s ADO prescribed above shall be determined by mutual agreement between the employee and FPNSW having regard to the service requirements of FPNSW. (c) ADOs may be accrued up to a total of five (5) days, subject to the service requirements of FPNSW. (d) Where practicable, an ADO can be taken adjoining an employee’s normal day(s) off.

The employee will be entitled up to twelve (12) ADOs each year. c. The ADO will be rostered and taken within the four week period in which it accrues, subject to operational requirements of Fresh Hope Care. d. Where possible and by mutual agreement: ▪ the ADO will be consecutive with the days not rostered for duty (but will not be rostered on public holidays); ▪ the ADO must be taken as one whole day and not a part thereof, preferably one ADO per month; ▪ no more than five (5) ADOs may be accumulated and may be taken in conjunction with the employee’s annual leave or at another agreed time. e. Fresh Hope Care values its employees’ work-life balance and encourages employees to use ADOs for the purposes of rest and recreational pursuits. Where five or more ADOs have been accrued by an employee Fresh Hope Care may direct the employee to take the accrued ADOs within a period of 3 months from the date of such direction. Where the employee does not take the ADOs within 3 months of such direction Fresh Hope Care may make payment to the Employee for such ADOs at the employee’s ordinary rate of pay. f. ADOs are accrued, at the normal rate, for the following: ▪ personal/carer’s leave; ▪ public holidays; ▪ compassionate leave; ▪ study leave; ▪ time off in lieu taken within the employee’s ordinary hours. g. The following types of leave or absence do not accrue ADOs: ▪ ADO ▪ annual leave (the base four (4) weeks); ▪ long service leave; ▪ paid and unpaid parental leave; ▪ leave without pay; ▪ workers compensation. h. Notwithstanding the above provisions, by agreement with Fresh Hope Care, an employee may cash out any accumulated ADO’s at the ordinary rate of pay.

The Caregiver will be entitled to 12 ADOs each year. b. The Caregiver is entitled to be paid their basic periodic rate of pay on the ADO on the basis of 7.6 hours per day. c. The Employer will, having regard to the operational needs of the Employer, grant an ADO at a time requested by the Caregiver. d. Where possible and by mutual agreement: (i) the ADO will be consecutive with the days not rostered for duty (but will not be rostered on public holidays); (ii) the ADO must be taken as one whole day and not a part thereof, preferably one ADO per month; (iii) no more than five ADOs may be accumulated and taken in conjunction with the Caregiver’s annual leave or at another agreed time. e. Caregivers must take an amount of ADO leave during a particular period should the Employer direct them to do so. f. ADOs are accrued, at the normal rate, for the following: (i) personal/carer’s leave; (ii) public holidays; (iii) compassionate leave; (iv) study leave; (v) time in lieu. g. The following types of leave or absence do not accrue ADOs: (i) ADO (ii) annual leave (the base four weeks); (iii) long service leave; (iv) paid and unpaid parental leave; (v) leave without pay; (vi) workers compensation.

(d) This sub-clause is subject to the employer informing each union which is both party to the award and which has members employed at the particular enterprise of its intention to introduce an enterprise system of ADO flexibility, and providing a reasonable opportunity for the union(s) to participate in negotiations.
