Amount of compassionate leave. 49.1.1 Employees are entitled to two days compassionate leave on each occasion when a member of the employee's immediate family or a member of the employee's household: (a) contracts or develops a personal illness that poses a serious threat to his or her life; (b) sustains a personal injury that poses a serious threat to his/her life; or (c) dies; 49.1.2 Any unused portion of compassionate leave will not accrue from year to year and will not be paid out on termination. 49.1.3 Such leave does not have to be taken consecutively.

An Employee may take compassionate leave for a particular permissible occasion if the leave is taken: to spend time with the member of the Employee’s immediate family or household who has contracted or developed a personal illness or sustained a personal injury referred to in clause 50.2(a); or after the death of a member of the Employee’s immediate family or household referred to in clause 50.2(a). An Employee is not required to take compassionate leave in respect of a permissible occasion consecutively. Compassionate leave will not accrue from year to year and will not be paid out on termination of the employment of the Employee.

The initial three days of compassionate leave taken in any year of service shall be deducted from the 18 days personal/carer’s leave entitlement herein (pro rata for part time and fixed term employees). Subsequent occasions of paid compassionate leave during a year of service shall not be deducted from an employee’s personal/carer’s leave entitlement. Where an employee’s accrued personal leave has been exhausted, the employee is entitled to up to three days paid compassionate leave on each occasion of serious illness, injury or death of a member of the employee’s immediate family or household.

Amount of compassionate leave. An Employee, other than a Casual Employee, is entitled to up to three (3) days paid compassionate leave on each occasion when: a member of the Employee's immediate family: • contracts or develops a personal illness that poses a serious threat to their life; • sustains a personal injury that poses a serious threat to their life; or • dies; a child is stillborn within the meaning of clause 36.2(g), where the child would have been a member of the Employee’s immediate family if the child had been born alive; or the Employee, or the Employee’s spouse or de facto partner, has a miscarriage, each of which constitutes a permissible occasion for the purposes of this clause 34. Clause 34.2(a)(iii) does not apply: if the miscarriage results in a stillborn child within the meaning of clause 36.2(g) to a former spouse, or former de facto partner, of the Employee. An Employee may take compassionate leave for a particular permissible occasion if the leave is taken: to spend time with the member of the Employee’s immediate family who has contracted or developed a personal illness or sustained a personal injury referred to in clause 34.2(a); or after the death of a member of the Employee’s immediate family referred to in clause 34.2(a). An Employee may request additional leave for travel, up to two (2) days either side of each occasion, upon the approval of the people leader. An Employee is not required to take compassionate leave in respect of a permissible occasion consecutively. Compassionate leave will not accrue from year to year and will not be paid out on termination of the employment of the Employee.

(b) Employees can take compassionate leave as: (i) a single continuous 2 day period (ii) 2 separate periods of 1 day each (iii) any separate periods as agreed with their employer. (c) Employees don't accumulate compassionate leave and it's not a part of their sick and carer's leave entitlement. Employees can take compassionate leave any time they need it. (d) If an employee is already on another type of leave (for example, annual leave) and needs to take compassionate leave, they can use compassionate leave instead of the other leave. (e) In addition to the entitlement at subclause (a), an employee will have access to an additional day of compassionate leave to be taken out of the employee’s personal leave entitlements, subject to satisfying the notice and evidence requirements in this clause.
Amount of compassionate leave. (a) Full time and part time Employees are entitled to up to five days compassionate leave without loss of pay on each occasion where the entitlement to compassionate leave arises under the Act. (b) Casual Employees are not entitled to compassionate leave but are entitled to unpaid compassionate leave in accordance with the NES.
