Appointment Types. (1) Term-to-term appointments are one-term appointments used to hire instructors for specific courses to accommodate (1) enrollment fluctuations, (2) temporary replacements for faculty with ongoing appointments, or (3) temporary vacancies. ELU may vary from term-to-term, possibly as much as 0-16 ELU. Salary is normally paid on a per ELU basis. (2) Fixed term appointments (normally one-year) are used when there is a clear expectation of a full or part-time position being needed during successive terms in an academic year. ELU may fluctuate from term to term, but must total the correct amount for the faculty member’s rank.

Appointment Types. Faculty Members shall hold one (1) of the following appointment types: tenured and tenure-track, teaching, or a limited term appointment. a) Tenured and Tenure-Track Faculty Appointments: i. All tenured and tenure-track Faculty Members shall have an appointment at one (1) of the following ranks: Assistant Professor – a probationary appointment without tenure leading to a determination of the granting of tenure through the process set out in Article 20. Associate Professor – may be with tenure as per Article 20.01 or without tenure. If without tenure, it is a probationary appointment leading to a determination of the granting of tenure through the process set out in Article 20. Professor – an appointment with tenure as per Article 20.01. ii. Only tenured and tenure-track Faculty Members, tenured and tenure-track faculty members elected to the Board of Governors, and tenured and tenure- track faculty members appointed as Academic Administrators can hold the ranks of Assistant Professor/Associate Professor/Professor. iii. All tenured and tenure-track Faculty Members initially shall be appointed as an Assistant Professor, an untenured or tenured Associate Professor, or a Professor. The appointment of a candidate with tenure must be referred to the Tenure and Promotion Committee for a recommendation to the President. The Board of Governors must have officially confirmed the award of tenure prior to an offer of employment being made. iv. A candidate who is nearing completion of a terminal degree may be appointed to the rank of Assistant Professor conditional upon the completion of the degree.
Appointment Types. With the exception of appointments to the positions of Lecturer, Senior Lecturer, Full Lecturer and Visiting Faculty as defined in this Agreement, and the reappointment of retired Faculty Members on special conditions, all full-time appointments to the rank of Instructor or higher shall consist of two types: (1) probationary appointments; and (2) appointments with continuous tenure.

(b) The ranks assistant professor, associate professor, and professor shall be provided to employees who have tenured or tenure-earning appointments except under the following circumstances: (1) When an employee holding one of these ranks is placed on a terminal contract, the employee’s rank will be retained for the duration of that contract; (2) Up to five untenured, non-tenure earning employees appointed annually whose rank is specifically approved by the president or president’s representative; (3) Individuals who have officially retired from universities or other organizations who are least 55 years of age; (4) Tenured employees who decide to give up their tenured status to take advantage of whatever incentives might be offered by such an appointment; (5) Individuals who have held the rank of professor for at least seven years at an institution of higher education; (6) Employees with the prefix visiting, provisional, clinical, or research appended to the rank of assistant professor, associate professor, or professor; and (7) Non-tenure earning employees whose rank, as of the date of ratification of this Agreement, violates the preceding provision. (c) Terminal, non-tenure-earning multiyear appointments of two- to five-year duration may be offered. Such appointments shall not be provided to employees with the ranks of assistant professor, associate professor, or professor except under the circumstances noted in this section, and shall not be offered to visiting, research, or provisional employees.

A continuing multi-year appointment is an appointment of contingent duration, consisting of an initial three (3) year term extended annually with an overall satisfactory annual performance as determined through the criteria, standards, and procedures as stipulated in Articles 15 and 10, respectively. FGCU shall provide the option of a CMYA to all new multi-year faculty hires, with the exception of the appointment status categories listed in Section 8.4 (B) below. B. Fixed Multi-Year Appointments (FMYA). A fixed multi-year appointment is an appointment of fixed duration, two (2) to five (5) years in length, with the opportunity for successive appointments. FGCU may offer an FMYA without the option of a CMYA to bargaining unit members in the following categories: (1) Instructors and lecturers; (2) New faculty members who have not yet completed their terminal degree requirements but are required to do so as a condition of continued employment;
